pfTrackEvent(&#039;Kavanaugh Declines To Order Citizen-Only Voting Initiative On Michigan\u2019s Fall Ballot&#039;); return false;\" title=\"Printer Friendly, PDF &#038; Email\">                     <span id=\"printfriendly-text2\" class=\"pf-button-text\"><i class=\"mdi mdi-printer\" aria-hidden=\"true\"><\/i><\/span>                     <\/a>                 <\/span><\/li>\n<\/ul><\/div>\n<div class=\"pf-content\">\n<p class=\"wp-block-paragraph\">Supreme Court Justice Brett Kavanaugh rejected an emergency request on Thursday to order Michigan to include a constitutional amendment that includes proof-of-citizenship requirements for voting on the state\u2019s 2026 ballot.<\/p>\n<p class=\"wp-block-paragraph\">In a newly released <a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/DocketFiles\/html\/Public\/26A275.html\" target=\"_blank\" rel=\"noreferrer noopener\">order<\/a>, Kavanaugh denied Americans for Citizen Voting\u2019s <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/26\/26A275\/422446\/20260831090954276_ACVM%20Emergency%20App%20for%20an%20Injunction%20Pending%20Appeal.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">emergency application<\/a> to instruct Wolverine State election officials to place their initiative on the November ballot. The <a href=\"https:\/\/ballotpedia.org\/Michigan_Require_Voter_Photo_Identification_And_Require_Proof_of_Citizenship_for_Voter_Registration_Amendment_(2026)\" target=\"_blank\" rel=\"noreferrer noopener\">proposal<\/a> would require Michigan voters to verify their American citizenship when registering to vote and mandate photo ID for in-person voting.<\/p>\n<div id=\"fdrlst__b89e9-2836530431\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">According to <a href=\"https:\/\/www.detroitnews.com\/story\/news\/local\/michigan\/2026\/08\/31\/michigan-citizenship-group-asks-u-s-supreme-court-to-rescue-ballot-bid\/91555028007\/\" target=\"_blank\" rel=\"noreferrer noopener\">The Detroit News<\/a>, the state\u2019s Board of Canvassers deadlocked in a 2-2 vote along party lines last month \u201cin determining whether the group had collected enough valid signatures for the issue to move forward.\u201d Per the outlet, \u201cThe group needed 446,198 signatures to advance the measure and said it collected more than 700,000. But a review of a 1,000-signature sample found that Americans for Citizen Voting fell a handful of signatures short of the necessary threshold.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cMuch of the debate at the Aug. 24 canvassing board meeting focused on five signatures that were deemed invalid. Supporters of the ballot proposal turned in affidavits from the people behind the signatures, saying they had signed the petition and were qualified to do so, but they were turned in after the deadline for challenges,\u201d the report reads. \u201cThe group has also complained that its signatures were submitted March 4, but the Bureau of Elections did not issue its staff report until Aug. 17, more than five months later.\u201d<\/p>\n<p class=\"wp-block-paragraph\"><strong>[READ:[READ:<a href=\"https:\/\/thefederalist.com\/2026\/07\/17\/trumps-declassified-docs-detail-massive-michigan-voter-registration-fraud\/\" target=\"_blank\" rel=\"noreferrer noopener\">Trump\u2019s Declassified Docs Detail Massive Michigan Voter Registration Fraud<\/a>]<\/strong><\/p>\n<p class=\"wp-block-paragraph\">As noted in their emergency application, Americans for Citizen Voting initially sought relief at the Michigan Supreme Court but ultimately brought its filing to SCOTUS because the former \u201cconstructively denied the request \u2026 by failing to act timely.\u201d The group noted how the Michigan Supreme Court \u201chas done nothing \u2014 not even to request a response from Respondents\u201d to its Aug. 27 filing, despite state law requiring the fall ballot to be certified \u201cno later than\u201d Sept. 4. <\/p>\n<p class=\"wp-block-paragraph\">The Wolverine State <a href=\"https:\/\/www.courthousenews.com\/supreme-court-refuses-to-put-proof-of-citizenship-amendment-on-michigan-ballot\/\" target=\"_blank\" rel=\"noreferrer noopener\">asked<\/a> in its response brief that the Supreme Court reject the group\u2019s application. <\/p>\n<p class=\"wp-block-paragraph\">As is custom with such orders, Kavanaugh \u2014 who oversees applications from the 6th Circuit (which includes Michigan) \u2014 did not provide a reason for his denial of Americans for Citizen Voting\u2019s emergency request. Given its rejection, the application will not be referred to the full court for consideration. <\/p>\n<p class=\"wp-block-paragraph\">As The Federalist\u2019s Matt Kittle previously <a href=\"https:\/\/thefederalist.com\/2025\/08\/11\/michigan-citizen-only-voting-effort-kicks-off-under-watch-of-terrible-elections-chief\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, state Democrats have regularly opposed efforts to ensure only U.S. citizens are voting in Michigan elections \u2014 despite such policies enjoying wide support across ideological lines.
