pfTrackEvent(&#039;Biden Judge Blocks Trump\u2019s Renewed Efforts To Curb Birthplace Citizenship&#039;); return false;\" title=\"Printer Friendly, PDF &#038; Email\">                     <span id=\"printfriendly-text2\" class=\"pf-button-text\"><i class=\"mdi mdi-printer\" aria-hidden=\"true\"><\/i><\/span>                     <\/a>                 <\/span><\/li>\n<\/ul><\/div>\n<div class=\"pf-content\">\n<p class=\"wp-block-paragraph\">The same Biden-appointed judge who gave Justice Brett Kavanaugh\u2019s attempted killer a sweetheart prison sentence is now seeking to block President Trump\u2019s renewed efforts to stop America\u2019s <a href=\"https:\/\/thefederalist.com\/tag\/birthplace-citizenship\/\" target=\"_blank\" rel=\"noreferrer noopener\">birthplace citizenship<\/a> crisis. <\/p>\n<p class=\"wp-block-paragraph\">Maryland-based District Judge Deborah Boardman <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mdd.574698\/gov.uscourts.mdd.574698.181.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">issued<\/a> a preliminary injunction on Wednesday against Trump\u2019s August executive order cracking down on the practice in ways the administration says are not covered by the Supreme Court\u2019s recent <em><a href=\"https:\/\/thefederalist.com\/2026\/06\/30\/scotus-says-babies-of-illegal-aliens-ccp-birth-tourists-are-us-citizens-because-of-magic-dirt\/\" target=\"_blank\" rel=\"noreferrer noopener\">Trump v. Barbara<\/a><\/em>  decision. While six justices found Trump\u2019s 2025 birthplace citizenship directive to be unlawful, five justices went as far as to rule that children born to illegal aliens and foreign \u201cbirth tourists\u201d on U.S. soil are citizens. <\/p>\n<div id=\"fdrlst__b89e9-3416865536\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">As The Federalist\u2019s Breccan Thies <a href=\"https:\/\/thefederalist.com\/2026\/08\/07\/trump-moves-to-shut-down-birth-tourism-industry-after-scotus-affirmed-squatter-citizenship\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, Trump\u2019s post-<em>Barbara<\/em> order \u201cclarifies situations the president does not believe are covered by the high court\u2019s ruling, including cases of children born to an \u2018alien enemy,\u2019 such as the children of terrorists, namely those found to be members of a Foreign Terrorist Organization or Specially Designated Global Terrorist.\u201d The new edict \u201calso clarifies that the children of foreign government employees, like ambassadors and embassy workers, are not entitled to birthplace citizenship.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The order was accompanied by a <a href=\"https:\/\/thefederalist.com\/2026\/08\/07\/trump-moves-to-shut-down-birth-tourism-industry-after-scotus-affirmed-squatter-citizenship\/\" target=\"_blank\" rel=\"noreferrer noopener\">directive<\/a> aimed at curbing \u201cbirth tourism.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Having <a href=\"https:\/\/marylandmatters.org\/2025\/08\/08\/judge-again-blocks-ban-on-birthright-citizenship-extends-order-nationwide\/\" target=\"_blank\" rel=\"noreferrer noopener\">blocked<\/a> the president\u2019s 2025 birthplace citizenship order last year, the Biden-appointed Boardman (unsurprisingly) wasn\u2019t convinced by the administration\u2019s new arguments. In her 35-page opinion, she argued that challengers are likely to succeed on the merits of their claims that the August order \u201cinfringes on the class members\u2019 Fourteenth Amendment right to citizenship by birth.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cThe 2026 Executive Order is almost certainly unconstitutional as applied to the certified class for the simple reason that the Supreme Court in <em>Barbara<\/em> already decided that the children in the class are citizens at birth,\u201d Boardman wrote. \u201cThis Court must, once again, preliminarily enjoin enforcement of the President\u2019s most recent attempt to strip the right to citizenship from them.\u201d<\/p>\n<p class=\"wp-block-paragraph\">She further noted that the injunction \u201cdoes not enjoin the issuance of public guidance on the [order\u2019s] implementation; it enjoins the denial of citizenship to members of the class whom <em>Barbara<\/em> declared were citizens.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Boardman granted plaintiffs\u2019 request to certify a class of individuals covered by the president\u2019s order. Justice Samuel Alito notably <a href=\"https:\/\/thefederalist.com\/2025\/11\/11\/ongoing-judicial-coup-proves-alito-thomas-were-right-about-weak-scotus-injunction-ruling\/\" target=\"_blank\" rel=\"noreferrer noopener\">penned<\/a> a concurring opinion (joined by Justice Clarence Thomas) in the Supreme Court\u2019s <em><a href=\"https:\/\/thefederalist.com\/2025\/06\/27\/supreme-court-nukes-nationwide-injunctions-against-trumps-birthright-citizenship-order\/\" target=\"_blank\" rel=\"noreferrer noopener\">Trump v. CASA<\/a><\/em>  (2025) decision warning that federal judges could weaponize class certification to effectively sidestep <em>CASA<\/em>\u2018s limitation on lower courts\u2019 use of nationwide injunctions.<\/p>\n<p class=\"wp-block-paragraph\"><strong>[READ:[READ:<a href=\"https:\/\/thefederalist.com\/2026\/07\/29\/white-house-congress-need-to-assert-their-dominance-over-supreme-court-on-birthplace-citizenship\/\" target=\"_blank\" rel=\"noreferrer noopener\">White House, Congress Need To Assert Their Dominance Over Supreme Court On Birthplace Citizenship<\/a>]<\/strong><\/p>\n<p class=\"wp-block-paragraph\">Boardman is most widely known for giving a lenient sentence to the man who attempted to assassinate Justice Kavanaugh following the leak of the court\u2019s 2022 draft <em>Dobbs<\/em> opinion. While prosecutors <a href=\"https:\/\/thefederalist.com\/2025\/10\/04\/biden-judge-gives-would-be-kavanaugh-assassin-light-sentence-as-left-wing-violence-skyrockets\/\" target=\"_blank\" rel=\"noreferrer noopener\">recommended<\/a> at least 30 years in prison, the Biden appointee sentenced the wannabe killer to just eight years behind bars \u2014 a decision seemingly stemming from her sympathies for the man\u2019s \u201ctransgender\u201d status and concern that he would be placed in a prison incongruent with his gender-bending delusions.<\/p>\n<p class=\"wp-block-paragraph\">Rep. Chip Roy, R-Texas, <a href=\"https:\/\/roy.house.gov\/media\/press-releases\/rep-roy-files-articles-impeachment-against-us-district-judge-deborah-l\" target=\"_blank\" rel=\"noreferrer noopener\">introduced<\/a> articles of impeachment against Boardman for her activism from the bench last year. The Texas congressman also <a href=\"https:\/\/thefederalist.com\/2026\/01\/14\/46-house-republicans-help-democrats-defeat-measure-defunding-activist-judges-boasberg-boardman\/\" target=\"_blank\" rel=\"noreferrer noopener\">proposed<\/a> a bill amendment to a January spending package that sought to strip funding from Boardman and fellow judicial activist <a href=\"https:\/\/thefederalist.com\/tag\/james-boasberg\/\" target=\"_blank\" rel=\"noreferrer noopener\">James Boasberg\u2019s<\/a> offices \u2014 a move that House Democrats defeated with help from 46 Republicans.<\/p>\n<p class=\"wp-block-paragraph\">To date, the GOP-run House has not initiated impeachment proceedings against Boardman, Boasberg, or any other rogue judges for their egregious actions on the bench. <\/p>\n<p class=\"wp-block-paragraph\">\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
