Known as the \u201cKeep Nine Amendment,\u201d the measure sought to require SCOTUS to \u201cbe composed of nine justices.\u201d <\/p>\n<div id=\"fdrlst__b89e9-457670336\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The House Judiciary Committee previously <a href=\"https:\/\/thefederalist.com\/2026\/06\/03\/not-a-single-house-judiciary-dem-supports-amendment-keeping-scotus-at-9-justices\/\" target=\"_blank\" rel=\"noreferrer noopener\">cleared<\/a> the amendment in a party-line vote in June.<\/p>\n<p class=\"wp-block-paragraph\">Wednesday\u2019s vote came <a href=\"https:\/\/clerk.house.gov\/Votes\/2026293\" target=\"_blank\" rel=\"noreferrer noopener\">mostly along party lines<\/a>, with 211 Republicans and Rep. Don Davis, D-N.C., voting in favor of the amendment. Meanwhile, 205 Democrats and Rep. Kevin Kiley, I-Calif. \u2014 who caucuses with Republicans \u2014 voting in opposition.<\/p>\n<p class=\"wp-block-paragraph\">The Federalist previously <a href=\"https:\/\/thefederalist.com\/2026\/07\/23\/vulnerable-house-dems-refuse-to-say-if-theyll-back-anti-court-packing-amendment\/\" target=\"_blank\" rel=\"noreferrer noopener\">asked<\/a> 16 vulnerable House Democrats in July about their stance on court-packing and whether they would support HJR 1 on the House floor. Only Rep. Henry Cuellar, D-Texas, responded. While the Texas congressman claimed that he opposes court-packing, the <a href=\"https:\/\/clerk.house.gov\/Votes\/2026293\" target=\"_blank\" rel=\"noreferrer noopener\">roll call<\/a> for Wednesday\u2019s vote shows that he voted against HJR 1.<\/p>\n<p class=\"wp-block-paragraph\">Introduced by Rep. Andy Biggs, R-Ariz., the Keep Nine Amendment was aimed at staving off Democrats\u2019 <a href=\"https:\/\/thefederalist.com\/tag\/court-packing\/\" target=\"_blank\" rel=\"noreferrer noopener\">growing calls<\/a> to pack the Supreme Court if given power in the 2026 midterms. The goal, as it seems, is to change the makeup of the court in order to achieve Democrat-favorable outcomes in future decisions. <\/p>\n<p class=\"wp-block-paragraph\">House Minority Leader Hakeem Jeffries has all but promised that his party will move to stack the high court with left-wing activists should he obtain the speaker\u2019s gavel in January. While trashing SCOTUS last month, the New York leftist <a href=\"https:\/\/thefederalist.com\/2026\/08\/17\/while-trying-to-avoid-court-packing-question-jeffries-all-but-admits-he-supports-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> that Rep. Jamie Raskin, D-Md., and other court-packing supporters on the House Judiciary Committee \u201care going to take the lead on what dramatic reform of the Supreme Court looks like.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Rep. James Clyburn, D-S.C., followed suit weeks later, <a href=\"https:\/\/thefederalist.com\/2026\/09\/01\/friends-dont-let-friends-vote-for-dems-gambit-to-destroy-scotus\/\" target=\"_blank\" rel=\"noreferrer noopener\">telling<\/a> NBC News on Sunday that he backs his party\u2019s efforts to add four new justices to the Supreme Court. Several potential 2028 presidential contenders, such as <a href=\"https:\/\/thefederalist.com\/2026\/05\/14\/dem-frontrunner-floats-packing-scotus-nuking-electoral-college-as-2028-platform\/\" target=\"_blank\" rel=\"noreferrer noopener\">Kamala Harris<\/a> and <a href=\"https:\/\/thefederalist.com\/2026\/06\/12\/pete-buttigieg-throws-support-behind-democrats-extreme-court-packing-gambit\/\" target=\"_blank\" rel=\"noreferrer noopener\">Pete Buttigieg<\/a>, have similarly touted such a radical proposal. <\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-x wp-block-embed-x\">\n<div class=\"wp-block-embed__wrapper\"> <span class=\"ImnptAvBZKTQl4iak\"><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">If a sitting majority can change the size of the Supreme Court the moment it dislikes its rulings, what happens the next time the other side is in power?<\/p>\n<p>That&#39;s why I&#39;m urging my colleagues to support my resolution for a Constitutional Amendment to permanently fix the number of\u2026 <a href=\"https:\/\/t.co\/pGlo7kyKBk\">pic.twitter.com\/pGlo7kyKBk<\/a><\/p>\n<p>\u2014 Rep Andy Biggs (@RepAndyBiggsAZ) <a href=\"https:\/\/x.com\/RepAndyBiggsAZ\/status\/2095226694789730414?ref_src=twsrc%5Etfw\">September 2, 2026<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.x.com\/widgets.js\" charset=\"utf-8\"><\/script><\/span> <\/div>\n<\/figure>\n<p class=\"wp-block-paragraph\">HJR 1 enjoined support from the Keep Nine Coalition, an organization comprised of several grassroots groups and former bipartisan elected officials seeking to protect the Supreme Court\u2019s long-term independence. While <a href=\"https:\/\/thefederalist.com\/2026\/06\/03\/as-dems-renew-court-packing-scheme-activists-push-keep-nine-amendment-to-protect-scotus\/\" target=\"_blank\" rel=\"noreferrer noopener\">speaking<\/a> with The Federalist in June, Keep Nine Director Roman Buhler acknowledged the unlikelihood of Congress ratifying the amendment, but expressed hope that enough support for the amendment among a \u201chandful\u201d of Democrats could stymie the left\u2019s court-packing gambit in the short term.<\/p>\n<p class=\"wp-block-paragraph\">\u201cOur thinking is that if a handful of Democrats in Congress stand up and say [they\u2019re] not going to allow the independence of the Supreme Court to be undermined \u2026 and they\u2019re not going to go along with court expansion, then the leaders of whatever Democratic majority might be elected in the future might \u2026 realize [they] don\u2019t have the votes to expand the court,\u201d Buhler said at the time. \u201cEven a handful of Democrats that are willing to stand up now and say, \u2018Let\u2019s not do this,\u2019 could have a big impact because it could change the strategic calculation for all Democrats.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The House is <a href=\"https:\/\/www.majorityleader.gov\/house-legislative-calendar-2026\/\" target=\"_blank\" rel=\"noreferrer noopener\">scheduled<\/a> to wrap up business on Thursday before heading out for a week-long vacation.
