The lawsuit followed a determination by the Department of Education on July 1 that the district was out of substantial compliance with the Family Educational Rights and Privacy Act, or FERPA. The Department of Education <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.ed.gov\/about\/news\/press-release\/trump-administration-announces-additional-actions-protect-parental-rights-kansas\">reached the same conclusion<\/a> under the Protection of Pupil Rights Amendment on Aug. 25.<\/p>\n<p class=\"wp-block-paragraph\">The district\u2019s guidance directs staff members who learn that a student identifies as <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/transgender\/\">transgender<\/a> or \u201cgender nonconforming\u201d to alert the school principal. It says a planning meeting may cover a student\u2019s preferred name, preferred gender, preferred pronouns, school records, locker room and restroom use, sports participation, field trips, and staff training.<\/p>\n<p class=\"wp-block-paragraph\">Parents are listed among the people who may attend the meeting. But the policy says a student\u2019s request to exclude a parent, or not disclose the student\u2019s claimed transgender status to a parent, \u201cwill be evaluated on a case-by-case basis.\u201d<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The policy says district officials should consider the student\u2019s age, grade level, welfare, and other relevant information when deciding whether to withhold the information from parents.<\/p>\n<p class=\"wp-block-paragraph\">The federal <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.justice.gov\/crt\/media\/1459841\/dl\">complaint<\/a> argues that those procedures can deny parents access to education records created through the process. It also alleges that district meetings and evaluations involving a student\u2019s claimed gender identity can reveal sensitive information without the written parental consent required under the Protection of Pupil Rights Amendment.<\/p>\n<p class=\"wp-block-paragraph\">It further seeks a court order stopping enforcement of the guidance, requiring the district to give parents a chance to challenge or correct information in their children\u2019s records, and requiring written consent before any covered student evaluation.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-3\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-3\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cThis lawsuit should not come as a surprise,\u201d U.S. Attorney Ryan A. Kriegshauser said. \u201cPublic education functions effectively only when schools and parents engage in a genuine partnership. When schools withhold information from parents, they undermine trust and disrupt the essential balance between families and public educators.\u201d<\/p>\n<p class=\"wp-block-paragraph\">While the school district told the Education Department last year that its policy was \u201cirrelevant because the board of education \u2018never adopted, approved, or utilized&#8217;\u201d it, the complaint says the district maintained versions of the guidance since at least 2017. Ferguson<\/a><\/em>, the justices will consider whether parents have standing to challenge the state\u2019s law, which currently allows officials to delay notice and reunification when a \u201crunaway minor\u201d seeks gender-related drugs or surgeries.
