The complaint claims Amazon falsely represented its auction process as using a second-price model, but instead added undisclosed surcharges, leading to over $20 billion in illegally extracted revenue from approximately 1.2 million advertising clients. In 2019, Amazon reportedly changed its auction rules to include these hidden fees, betraying advertisers’ trust and increasing their costs. Amazon, the third-largest digital advertising business globally with over $68 billion in revenue, disputes the allegations, claiming advertisers adjust bids based on performance and that they saved billions by optimizing ad relevance. The lawsuit is part of ongoing legal actions against Amazon, including a separate antitrust trial scheduled for February 2027, which alleges the company used its market power to inflate prices and diminish competition.

The Federal Trade Commission and a bipartisan coalition of 22 states sued Amazon on Monday for allegedly misleading advertisers over the past seven years by imposing “hidden surcharges.”

The complaint, filed in the Western District of Washington, where the online retailer’s main headquarters is based, alleges Amazon secretly inflated the prices that roughly 1.2 million advertising customers were required to pay for placing ads on its shopping platform.
