The 5-4 ruling allowed the Trump governance to proceed with the project while legal challenges continue. The injunction, issued earlier by a D.C. District Court judge, was based on claims that the construction lacked congressional approval. The Supreme Court\u2019s per curiam decision found that the government is highly likely to succeed in demonstrating that the National Trust for Historic Preservation lacks legal standing to challenge the project. Justice Roberts dissented, arguing the construction likely requires congressional authorization and concerns about historic preservation. The stay remains in effect pending further legal action, such as the filing of a petition for a writ of certiorari.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The full U.S. Supreme Court on Monday paused a lower court injunction that blocked construction of President Trump\u2019s new White House ballroom. The ruling was 5-4, with Chief Justice John Roberts and the court\u2019s three Democrat appointees in dissent.<\/p>\n<p>In its <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/26a203_2b8e.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">per curiam opinion<\/a>, the high court granted the Trump administration\u2019s request to stay an injunction by D.C. District Court Senior Judge Richard Leon. Issued earlier this year, that order halted the White House\u2019s above-ground construction on the privately funded ballroom, with the Bush 43 appointee arguing that the project lacked congressional approval.<\/p>\n<p>A three-judge panel for the D.C. Circuit Court of Appeals declined (2-1) to lift the injunction earlier this month, prompting the Trump administration to <a href=\"https:\/\/thefederalist.com\/2026\/08\/17\/doj-asks-scotus-to-end-blockade-on-white-house-ballroom-construction-1\/\" target=\"_blank\" rel=\"noreferrer noopener\">appeal<\/a> to the Supreme Court. Roberts <a href=\"https:\/\/thefederalist.com\/2026\/08\/21\/scotus-pauses-blockade-on-trumps-white-house-ballroom-construction\/\" target=\"_blank\" rel=\"noreferrer noopener\">issued<\/a> an administrative stay on Leon\u2019s injunction on Aug. 21 to give the full court more time to consider the parties\u2019 filings. <\/p>\n<p>In its ruling replacing Roberts\u2019 stay, the Supreme Court found that the Trump administration \u201chas established that it is likely to succeed on the merits of a significant legal question.\u201d The majority further ruled that the government also showed that \u201cit would likely suffer irreparable harm without a stay, and that the balance of equities tips in its favor.\u201d<\/p>\n<p>Turning to the merits, the high court ruled that the administration is likely to show that the challenger (the National Trust for Historic Preservation) \u201clacks standing to challenge the East Wing project.\u201d The justices noted the absurdity of Trust member Alison Hoagland\u2019s claims that \u201chaving to view the finished ballroom the government is constructing would cause her to suffer \u2018injuries\u2019 to her \u2018aesthetic, cultural, and historical interests\u2019 because she finds the \u2018scale,\u2019 \u2018height,\u2019 and \u2018massing\u2019 of the government\u2019s design distasteful.\u201d<\/p>\n<p>\u201cThis Court has not found standing in circumstances like these before. To the contrary, we have repeatedly held that mere offense, disagreement, or distaste does not qualify as a concrete and particularized injury under Article III,\u201d the majority ruled. \u201cNor is it clear what would remain of Article III\u2019s concrete-and-particularized injury requirement if we were to extend our case law in the manner the Trust now suggests.\u201d<\/p>\n<p>When addressing the likely harms that the government would face if Leon\u2019s injunction were permitted to stand, the high court observed that the Bush appointee \u201clikely exceeded [his] Article III authority to enjoin the activities of a coordinate branch of government.\u201d The majority further noted the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/joe-biden-denies-chinese-money-story-that-hunter-biden-confirmed-thats-not-true\/\" title=\"Joe Biden denies Chinese money story that Hunter Biden confirmed: \u2018That\u2019s not true\u2019\">national security implications raised<\/a> by relevant government officials about the need for the project.<\/p>\n<p>\u201cToday, we do not pass upon the legality of the government\u2019s East Wing project. We conclude only that, based on the submissions before us, the government is likely to prevail in showing that the Trust lacks Article III standing to challenge the project in federal court and that the remaining stay factors favor relief,\u201d the court ruled.<\/p>\n<p>Writing on behalf of the dissent, Roberts argued that the president\u2019s White House ballroom construction \u201cis likely unlawful.\u201d Echoing the district court, he contended that the project likely requires congressional authorization.<\/p>\n<p>\u201cThe White House is not just any building, and \u2014 when it comes to historic preservation \u2014 Hoagland is not just any person. In failing to appreciate as much, the Court misconceives the plaintiff\u2019s injury, allowing the Executive\u2019s likely infringement of the Legislature\u2019s power of the purse and authority to regulate federal property in the District of Columbia to continue,\u201d Roberts wrote. \u201cToday\u2019s decision is no victory for the separation of powers.\u201d<\/p>\n<p>According to Monday\u2019s ruling, Leon\u2019s order is \u201cstayed pending the filing and disposition of the government\u2019s petition for a <a href=\"https:\/\/www.law.cornell.edu\/wex\/Writ_of_certiorari\" target=\"_blank\" rel=\"noreferrer noopener\">writ of certiorari<\/a>, if such writ is timely sought.\u201d The Supreme Court\u2019s stay will terminate if a petition from the administration to SCOTUS is denied by the high court or if SCOTUS agrees to consider the matter and issue a judgment on the merits of the case.<\/p>\n<hr>\n<p>      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
