pfTrackEvent(&#039;Trump Admin Asks SCOTUS To Weigh Military Restrictions On \u2018Trans\u2019 Troops&#039;); return false;\" title=\"Printer Friendly, PDF &#038; Email\">                     <span id=\"printfriendly-text2\" class=\"pf-button-text\"><i class=\"mdi mdi-printer\" aria-hidden=\"true\"><\/i><\/span>                     <\/a>                 <\/span><\/li>\n<\/ul><\/div>\n<div class=\"pf-content\">\n<p class=\"wp-block-paragraph\">The Trump administration asked the U.S. Supreme Court on Friday to consider the legality of its <a href=\"https:\/\/amzn.to\/3YuVZYV\" >policy effectively barring trans-identifying individuals<\/a> from serving in the military. <\/p>\n<p class=\"wp-block-paragraph\">In its <a href=\"https:\/\/glad-org-wpom.nyc3.cdn.digitaloceanspaces.com\/wp-content\/uploads\/2025\/01\/20260828_Talbott-USA_Writ-of-Certiorari.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">petition<\/a>, the Department of Justice (DOJ) requested the high court to determine whether the War Department\u2019s rule that \u201cgenerally disqualifies\u201d those who have \u201cgender dysphoria, a history of the condition, or a history of related interventions\u201d violates the \u201cequal-protection component\u201d of the Fifth Amendment\u2019s due process clause. The filing was made by U.S. Solicitor General John Sauer, who often represents the administration in oral arguments before the court. <\/p>\n<div id=\"fdrlst__b89e9-95461625\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">At issue is a February 2025 Pentagon <a href=\"https:\/\/www.war.gov\/Portals\/1\/Spotlight\/2025\/Guidance_For_Federal_Policies\/Prioritizing_Military_Excellence_and_Readiness_P&#038;R_Guidance.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">memo<\/a> establishing guidance implementing such a policy. The directive came as part of the agency\u2019s compliance with President Trump\u2019s January 2025 <a href=\"https:\/\/thefederalist.com\/2025\/01\/28\/trump-signs-orders-restoring-integrity-and-lethality-to-americas-military\/\" target=\"_blank\" rel=\"noreferrer noopener\">executive order<\/a> ordering War Secretary Pete Hegseth to revise the military\u2019s policy on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-signs-orders-restoring-integrity-lethality-to-the-military\/\" title=\"Trump Signs Orders Restoring Integrity, Lethality To The ...\">gender dysphoric individuals serving<\/a> within 60 days the order\u2019s implementation.<\/p>\n<p class=\"wp-block-paragraph\">Upon request from trans-identifying individuals, D.C. District Judge <a href=\"https:\/\/thefederalist.com\/tag\/ana-reyes\/\" target=\"_blank\" rel=\"noreferrer noopener\">Ana Reyes<\/a>, a Biden appointee with a laundry list of left-wing activism, <a href=\"https:\/\/thefederalist.com\/2025\/03\/19\/biden-judge-blocking-the-militarys-trans-policy-donated-thousands-to-democrat-candidates-causes\/\" target=\"_blank\" rel=\"noreferrer noopener\">issued<\/a> a preliminary injunction in March 2025 blocking the policy from taking effect. A three-judge panel for the D.C. Circuit Court of Appeals later <a href=\"https:\/\/thefederalist.com\/2025\/12\/10\/d-c-appeals-court-upholds-trumps-prohibition-on-trans-soldiers-in-the-military\/\" target=\"_blank\" rel=\"noreferrer noopener\">temporarily paused<\/a> that order in December 2025. <\/p>\n<p class=\"wp-block-paragraph\">Despite the U.S. Supreme Court <a href=\"https:\/\/thefederalist.com\/2025\/05\/06\/scotus-blocks-lower-court-injunction-on-trump-admins-military-trans-policy\/\" target=\"_blank\" rel=\"noreferrer noopener\">pausing<\/a> a similar injunction by a different district court on the policy in May 2025, a different D.C. Circuit panel upheld a portion of Reyes\u2019 injunction in June. In a <a href=\"https:\/\/courthousenews.com\/dc-circuit-rules-pentagon-policy-banning-transgender-soldiers-unconstitutional\/\" target=\"_blank\" rel=\"noreferrer noopener\">2-1 ruling<\/a>, the Democrat-appointed majority held \u201cthat the government could not enforce the ban against the challengers who were already in the military,\u201d as <a href=\"https:\/\/www.scotusblog.com\/2026\/08\/trump-administration-asks-supreme-court-to-consider-ban-on-transgender-persons-in-the-military\/\" target=\"_blank\" rel=\"noreferrer noopener\">described<\/a> by SCOTUSblog. <\/p>\n<p class=\"wp-block-paragraph\">In asking the Supreme Court to take up the case, the Trump administration argued that the lower court\u2019s holding that \u201cthe policy likely denies equal protection because it reflects invidious discrimination against trans-identifying people\u201d is a \u201cgravely erroneous\u201d decision that warrants the justices\u2019 review. It further contended that such reasoning \u201ccannot be squared with this Court\u2019s precedents or deference to the military.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cThe authority of the U.S. military to determine who may serve in the Nation\u2019s armed forces is a matter of exceptional importance,\u201d the petition reads. \u201cWhether the Constitution prohibits the military from exercising that authority by adopting a policy like the one here is a recurring issue, which has arisen before and will likely arise again absent this Court\u2019s review. The Court should thus take this opportunity to address the constitutionality of the Hegseth policy and reverse the decision below \u2026\u201d<\/p>\n<p class=\"wp-block-paragraph\">The Supreme Court is expected to begin its upcoming 2026 term in the coming weeks.
