The U.S. Court of Appeals for the 3rd Circuit, in a 2-1 decision, ruled that her legislative immunity does not apply to her alleged conduct during an altercation with federal authorities, noting that her actions-pushing and striking-were non-legislative. McIver faces three charges-two felonies and one misdemeanor-related to the incident, which she denies, asserting her actions were protected as congressional oversight under the Constitution\u2019s speech or debate clause. She was joined by U.S. Circuit Judge Stephanos Bibas, a Trump appointee. U.S. Circuit Judge Thomas Ambro, a Clinton appointee, was the sole dissenting voice in the ruling.<\/p>\n<p class=\"wp-block-paragraph\">McIver faces three charges for allegedly assaulting and interfering with <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/ice\/\" data-type=\"link\" data-id=\"https:\/\/www.washingtonexaminer.com\/tag\/ice\/\">Immigration and Customs Enforcement<\/a> officers at Delaney Hall in May 2025. She has pleaded not guilty to the charges. There is no set trial date as the defendant appeals to dismiss her case.<\/p>\n<p class=\"wp-block-paragraph\">The three-judge panel rejected her immunity argument against two of the three charges, but sent the third charge back to the lower court for reconsideration. Congressional Democrats have since had a renewed focus on the site.
