The judge has demanded the DOJ provide materials including prosecutor presentations, communications with grand jurors, witness testimonies, adn legal instructions, as part of ongoing efforts to determine whether the case against Lemon should be dismissed. This legal action stems from Lemon\u2019s involvement in a protest at a Minnesota church in January 2023, were he was accused of interfering with religious activities in violation of federal law. Lemon maintains he was reporting and not participating in the protest, and has pleaded not guilty, seeking dismissal of charges. The case highlights tensions over Frist Amendment rights,free press,and protest freedoms. Provinzino also told the DOJ to provide any introduction, legal instructions, witness testimony, closing arguments, and answers to questions from grand jurors. Demonstrators were targeting one of the pastors at the church who works for ICE. Lemon has said he accompanied the protestors at\u00a0Cities Church in St. Paul in a freelance reporting role to live-stream the episode.<\/p>\n<p class=\"wp-block-paragraph\">The government argued Lemon\u2019s actions violated the First Amendment\u2019s right to worship and freedom of religion. Lemon argued his actions were protected under the First Amendment\u2019s protections for the press and protestors.<\/p>\n<p class=\"wp-block-paragraph\">In February, Lemon was indicted alongside multiple protestors on several charges that could result in a year in prison and up to a $10,000 fine.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The charges include conspiracy against rights and injuring, intimidating, or interfering with the exercise of religious freedom at a place of worship under the Freedom of Access to Clinic Entrances Act. That law prohibits interference or intimidation of \u201cany person by force, threat of force, or physical obstruction exercising or seeking to exercise the First Amendment right of religious freedom at a place of religious worship.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The former CNN anchor has maintained <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4457764\/don-lemon-pleads-not-guilty-charges-storming-minnesota-church\/\">his not guilty plea<\/a>. He is seeking to have the charges dismissed, arguing that he was not participating in the protest, as the government alleges, but rather reporting on it.<\/p>\n<p class=\"wp-block-paragraph\">\u201cI will not be silenced. I have spent my entire career covering the news. Lemon and other protesters at one point \u201clargely surrounded\u201d the pastor \u201cin an attempt to oppress and intimidate him\u201d, they alleged.
