An earlier version of the legislation would have prohibited people from knowingly approaching within 8 feet of patients, clinics, or other demonstrators, without their consent, for purposes including protest, counseling, or education within 100 feet of a reproductive health facility, but lawmakers removed that provision from the final bill.<\/p>\n<p class=\"wp-block-paragraph\">Matt Britton, general counsel of the Institute of Law and Justice, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.40daysforlife.com\/\">40 Days for Life\u2019s<\/a> legal arm, said the law largely creates additional consequences for conduct already prohibited in New Jersey.<\/p>\n<p class=\"wp-block-paragraph\">\u201cIt does not ban prayer,\u201d Britton told the <em>Washington Examiner<\/em>. \u201cWhat it bans is illegal conduct in front of abortion facilities and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/post-roe-pro-life-activists-vow-to-protect-mothers-and-babies-while-planned-parenthood-touts-more-at-home-abortions\/\" title=\"Post-Roe: Pro-Life ... Vow to Protect Mothers and Babies While Planned Parenthood Touts More At-Home ...s\">pro-life pregnancy centers<\/a> that is already illegal.\u201d<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The underlying concern expressed by New Jersey activists is that police or prosecutors could attempt to stretch the law beyond its text, forcing peaceful demonstrators to defend constitutionally protected conduct.<\/p>\n<p class=\"wp-block-paragraph\">New Jersey Right to Life Executive Director Marie Tasy <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.lifenews.com\/2026\/08\/20\/new-jersey-gov-mikie-sherrill-signs-bill-banning-praying-outside-abortion-centers\/\">told <em>Lifenews.com<\/em><\/a>  that terms listed in the law, such as \u201cthreat,\u201d \u201cintimidate,\u201d and \u201ccoerce,\u201d are \u201cinherently subjective,\u201d creating uncertainty for people who pray, display signs, or offer alternatives to abortion outside clinics.<\/p>\n<p class=\"wp-block-paragraph\">\u201cPeaceful sidewalk counseling, prayer, holding signs, or simply offering help and alternatives outside a facility can easily be labeled \u2018intimidation\u2019 by someone who claims to feel threatened,\u201d Tasy said, warning that the possibility of criminal charges could chill protected expression.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-3\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-3\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The enacted text, however, places specific conditions on criminal liability. It applies when a person purposely or knowingly inflicts or attempts to inflict bodily injury, physically obstructs someone entering or leaving a \u201chealth care facility,\u201d damages property, or uses force or a threat of force to intimidate, threaten, or coerce a patient, provider, volunteer, or assistant.<\/p>\n<p class=\"wp-block-paragraph\">The law also requires a connection between the conduct and an effort to interfere with women seeking abortions. Its intimidation provision should therefore not be triggered solely because someone reports feeling uncomfortable or threatened by another person\u2019s peaceful presence.<\/p>\n<p class=\"wp-block-paragraph\">Britton said S2260 is closer to a state counterpart of the federal Freedom of Access to Clinic Entrances Act than a traditional buffer-zone law. Peaceful prayer, holding signs, and offering information remain lawful, he said.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-4\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-4\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-25\" data-wex-ad=\"art-dsk-inart-4\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Still, Britton acknowledged the concern that authorities could bring an unfounded charge. Even if a case is later dismissed, the accused person may incur legal expenses and experience disruption.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThe punishment is the process,\u201d Britton said.<\/p>\n<p class=\"wp-block-paragraph\">Britton previously represented Pennsylvania-based anti-abortion activist <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3017281\/anti-abortion-mark-houck-sues-doj\/\">Mark Houck<\/a>, a Catholic father who was indicted during the Biden administration for \u201cassaulting\u201d an abortion clinic monitor. Houck was acquitted by a jury and has since <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4665869\/trump-doj-settlement-anti-abortion-paul-vaughn-fbi-raid\/\">received a payout<\/a> from the federal government over the unscrupulous charges.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-5\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-5\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-26\" data-wex-ad=\"art-dsk-inart-5\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">While legal experts told the <em>Washington Examiner<\/em> that New Jersey\u2019s law is unique among other state FACE Act laws or redundant measures that add extra charges onto already-existing crimes, Houck\u2019s former attorney said he sees it as part of a broader reaction to the 2022 Supreme Court decision that found states are in charge of setting limits on abortion access.<\/p>\n<p class=\"wp-block-paragraph\">\u201cOnce <em>Dobbs<\/em> overruled <em>Roe<\/em>, it got thrown back to the states,\u201d Britton said, referring to the 2022 decision <em>Dobbs v. Jackson Women\u2019s Health Organization <\/em>that overturned <em>Roe v. Wade<\/em>. \u201cAnd once Donald Trump became president, the federal government stopped using the federal FACE Act against pro-lifers, and they applied it fairly to anybody who broke the law, right? And because of that, the states began to pass their own laws.\u201d<\/p>\n<h2 id=\"h-expansion-of-private-lawsuits\" class=\"wp-block-heading\">Expansion of private lawsuits<\/h2>\n<p class=\"wp-block-paragraph\">The law also creates civil exposure. Abortion recipients and providers may sue over conduct that violates the law\u2019s interference provisions without first obtaining a criminal conviction. Available remedies include injunctive relief, compensatory damages, punitive damages, and legal fees.<\/p>\n<p class=\"wp-block-paragraph\">Britton said the provision could have a chilling effect by making activists fear that a clinic or individual might sue even when police decline to bring charges. His institute stands ready to represent 40 Days for Life participants who follow the organization\u2019s <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.40daysforlife.com\/en\/madison\/sop\">statement of peace<\/a>, he added. Those guidelines prohibit volunteers from blocking sidewalks, threatening or touching people, damaging property, yelling, using profanity, or photographing patients and clinic workers.<\/p>\n<p class=\"wp-block-paragraph\">40 Days for Life <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.40daysforlife.com\/en\/vigil-search.aspx\">operates nine vigils<\/a> in the Garden State, including one held throughout the year, and estimates that 2,000 to 3,000 people participate annually.<\/p>\n<p class=\"wp-block-paragraph\">Shawn Carney, CEO of 40 Days for Life, said he fears the prospect of enforcement will cause some volunteers to stay home rather than risk arrest or litigation. He argued that officials must not treat opposition to abortion itself as intimidation.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThey just want to get rid of free speech,\u201d Carney said of the original stricter language under the law. \u201cThey want zero public opposition to abortion,\u201d he said. \u201cIf they deem that you are intimidating at all, they can get rid of you.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Earlier versions of the legislation included broader language addressing emotional harm and recording people within 100 feet of a facility. Those provisions were removed before passage.<\/p>\n<p class=\"wp-block-paragraph\"><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/4695727\/mikie-sherrill-easier-to-get-ar-15-than-abortion\/\">MIKIE SHERRILL CLAIMS IT\u2019S \u2018EASIER TO GET AN AR-15\u2019 THAN AN ABORTION AT BILL SIGNING CEREMONY IN NEW JERSEY<\/a><\/strong><\/p>\n<p class=\"wp-block-paragraph\">The distinction leaves <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/pro-life\/\">anti-abortion<\/a> activists confronting a narrower issue than several initial descriptions suggested. Prayer outside an abortion clinic is not prohibited, but opponents of the measure worry the new criminal and civil framework gives authorities and private litigants another avenue through which to test the boundaries of protected activity.<\/p>\n<p class=\"wp-block-paragraph\">Whether those concerns materialize will depend on how police, prosecutors, and courts apply the new law.
