<em>Washington Examiner<\/em> in February that it would take a \u201cmiracle\u201d or a dramatic reversal of Trump\u2019s <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/cryptocurrency\/\" data-type=\"post_tag\" data-id=\"1699\">cryptocurrency<\/a> policies to keep him from mounting an independent campaign. At the time, Day put the chances of running at 99% and accused Trump and congressional Republicans of accelerating what he calls a \u201cwar on crypto.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Day now argues the administration has broken promises beyond cryptocurrency, pointing to Trump\u2019s pledges to avoid new wars and \u201cdrain the swamp.\u201d He singled out Lutnick for criticism and argued the CLARITY Act would expand government <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/surveillance\/\" data-type=\"post_tag\" data-id=\"500\">surveillance<\/a> rather than protect cryptocurrency users.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cAll I\u2019m doing is asking them to do what they said they were going to do,\u201d Day said. \u201cIf they don\u2019t honor their commitments, they don\u2019t deserve to be in power.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Day still faces hurdles before he can appear on the ballot. He sued New Hampshire after the state refused to accept his declaration of candidacy over a residency and voter registration dispute. A federal magistrate judge has recommended ruling in Day\u2019s favor, but the district judge has yet to issue a final decision. The state has objected to the recommendation, and Day has filed a response.<\/p>\n<p class=\"wp-block-paragraph\">Day estimated there is a 95% chance he will ultimately make the ballot if he chooses to submit his petitions. Day received nearly 18,000 votes as an independent <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/section\/senate\/\" data-type=\"link\" data-id=\"https:\/\/www.washingtonexaminer.com\/section\/senate\/\">Senate<\/a> candidate in 2016, when now-Gov.
