The order, which directs the Department of Homeland Security to compile a list of eligible voters and mandates the Postal Service to deliver mail ballots only to those on the list, was challenged in court. District Judge Indira Talwani had issued an injunction preventing its implementation ahead of the 2026 midterms, but the Supreme Court granted a stay while the case was appealed. The Court ruled that the government is highly likely to succeed in its argument that Talwani lacked jurisdiction and that the injunction caused irreparable harm to the management. Justices Sonia Sotomayor and Ketanji Brown Jackson dissented, wiht Jackson warning that the ruling risks chaos and uncertainty in upcoming elections. The decision leaves the injunction in place temporarily, pending further legal proceedings, with the potential for the Supreme Court to review the case on its merits.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The U.S. Supreme Court agreed to pause a lower court blockade on President Trump\u2019s mail-in voting executive order on Monday. The vote was 6-3, with Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson dissenting.<\/p>\n<p>In its <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/26a124_hgci.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">per curiam ruling<\/a>, the high court granted the Trump administration\u2019s emergency application to stay a June <a href=\"https:\/\/apnews.com\/article\/trump-executive-order-elections-mail-voting-b28c3425c1dc968cd0f57c61fb7a684e\" target=\"_blank\" rel=\"noreferrer noopener\">ruling<\/a> by Massachusetts-based District Judge <a href=\"https:\/\/thefederalist.com\/tag\/indira-talwani\/\" target=\"_blank\" rel=\"noreferrer noopener\">Indira Talwani<\/a>. The Obama appointee and past <a href=\"https:\/\/thefederalist.com\/2025\/04\/15\/judge-blocking-trumps-deportation-of-foreign-nationals-donated-to-barack-obama-elizabeth-warren\/\" target=\"_blank\" rel=\"noreferrer noopener\">Democrat donor<\/a> issued an injunction barring the order from taking effect ahead of the 2026 midterms <a href=\"https:\/\/apnews.com\/article\/trump-mail-voting-appeal-executive-order-8bfb1f787f84fc60f9b6b284794b18b5\" target=\"_blank\" rel=\"noreferrer noopener\">in the states<\/a> that challenged the directive.<\/p>\n<p>As <a href=\"https:\/\/www.foxnews.com\/politics\/judge-hands-trump-mail-ballot-win-now-democrats-next-move-looms\" target=\"_blank\" rel=\"noreferrer noopener\">described<\/a> by Fox News, the president\u2019s executive order \u201cdirects the Department of Homeland Security to compile a list of all adult U.S. citizens living in each state and would direct [the U.S. Postal Service] to deliver mail ballots only to individuals appearing on the lists.\u201d<\/p>\n<p>The administration appealed Talwani\u2019s injunction to the 1st Circuit Court of Appeals but was <a href=\"https:\/\/apnews.com\/article\/trump-mail-voting-appeal-executive-order-8bfb1f787f84fc60f9b6b284794b18b5\" target=\"_blank\" rel=\"noreferrer noopener\">rejected<\/a>. The government did, however, score <a href=\"https:\/\/thefederalist.com\/2026\/07\/28\/d-c-circuit-court-hands-trump-win-in-battle-over-mail-in-voting-order\/\" target=\"_blank\" rel=\"noreferrer noopener\">a win<\/a> in a separate challenge to the order in a case before the D.C. Circuit Court of Appeals. The D.C.-based court ruled late last month that challengers\u2019 lawsuit was unreviewable at that time because the named agencies hadn\u2019t implemented their official rules as required by the president\u2019s order.<\/p>\n<p>The Postal Service published a rule mandating that states \u201cprovide lists of voters who received mail-in ballots\u201d on Friday, according to <a href=\"https:\/\/www.foxnews.com\/politics\/usps-publishes-rule-block-mail-in-ballots-states-dont-provide-voter-lists\" target=\"_blank\" rel=\"noreferrer noopener\">Fox<\/a>.<\/p>\n<p>In its Monday ruling, the Supreme Court found that the Trump administration is likely to succeed on the merits of its arguments that Talwani lacked jurisdiction to issue a judgment on the matter. It also ruled that the government is likely to succeed on the merits of its claims that Talwani\u2019s injunction \u201cis causing it irreparable harm, and that the equities do not favor leaving the injunction in place while the [its] appeal is pending.\u201d<\/p>\n<p>The majority went on to note that its ruling on the administration\u2019s application \u201cdoes not mean that any measure taken by the Government to implement the Order will necessarily be lawful.\u201d While \u201ctime will tell\u201d on that point, the justices affirmed that \u201cthe Order itself does not harm the States, so the District Court lacked jurisdiction to bar the Government from trying to implement it.\u201d<\/p>\n<p>\u201c[F]or the reasons discussed, th[e] injunction is likely to irreparably harm the Government if it remains in place while the appellate process runs its course,\u201d the court ruled. \u201cAccordingly, the application for stay presented to JUSTICE JACKSON in No. 26A124 and by her referred to the Court is granted.\u201d<\/p>\n<p>Writing behalf of herself and Kagan, Sotomayor argued that the challenges brought by the states \u201care justiciable now,\u201d and that a \u201ccommonsense reading of the Executive Order, corroborated by the Government\u2019s own representations, makes clear that the respondent States face a sufficiently concrete and imminent injury to satisfy Article III.\u201d<\/p>\n<p>\u201cBecause I believe the structure of the Executive Order, the Government\u2019s representations, and the equities counsel against emergency relief requiring the States to wait to bring their serious challenges to the Executive Order, I respectfully dissent,\u201d Sotomayor wrote. <\/p>\n<p>Meanwhile, Jackson penned a solo dissent longer than the per curiam opinion and Sotomayor\u2019s dissent combined. Across 23 pages, the junior justice contended that the Supreme Court\u2019s granting of relief \u201cviolates well-established precedents concerning this Court\u2019s equitable discretion and needlessly injects chaos and uncertainty into the upcoming midterm elections.\u201d<\/p>\n<p>\u201cI respectfully dissent. States administering elections and the voting public that relies on them to do so deserve clarity, not caginess or confusion,\u201d Jackson wrote. \u201cThe Court does a disservice to all concerned by distorting Article III standing and ripeness principles to issue a ruling that contributes to pre-election chaos instead of quashing it, and by using its equitable authority to facilitate a patently inequitable result.\u201d<\/p>\n<p>According to Monday\u2019s ruling, Talwani\u2019s order is \u201cstayed pending the disposition of the appeal in the United States Court of Appeals for the First Circuit and disposition of a petition for a writ of certiorari in this Court, if such a writ is timely sought.\u201d The Supreme Court\u2019s stay will terminate if a potential petition from the administration to SCOTUS is denied by the high court or if SCOTUS agrees to consider the matter and issue a verdict on the merits in the case. <\/p>\n<hr>\n<p>      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
