In August, President Trump signed an executive order called \u201cEnding Birth Tourism,\u201d which defines the practice as foreigners entering the U.S.on nonimmigrant visas with the primary purpose of giving birth to obtain citizenship,adn empowers authorities to deny or revoke visas and entry to prevent such cases. Although exact numbers are unkown, estimates suggest between 20,000 and 26,000 birth tourism cases in 2020, mainly involving countries like China, Russia, Turkey, and Nigeria. Birth tourism has become a profit-driven industry marked by fraud, with some families resorting to costly commercial surrogacy, especially as surrogacy is banned in China but accessible in the U.S. Underlying this trend are motivations such as access to better education, exile, and social mobility, with wealthy Chinese often viewing U.S. citizenship as an investment for their children\u2019s future. Cases of Chinese elites using surrogacy and linked to scandals, including the downfall of a former Chinese foreign minister, highlight growing security concerns. U.S. efforts include revoking visas and establishing a task force to block and prevent birth tourism, but demand is shifting toward surrogacy, which remains a loophole. Experts argue that both parties should support stronger regulations-like the proposed SAFE KIDS Act-to protect citizenship\u2019s integrity and align U.S. policies with other developed nations that largely ban commercial surrogacy. Ultimately, addressing these issues is about <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bipartisan-group-of-lawmakers-urge-joe-biden-to-immediately-evacuate-afghans-who-helped-u-s-forces\/\" title=\"Bipartisan group of lawmakers urge Joe Biden to \u2018immediately\u2019 evacuate Afghans who helped U.S. forces\">safeguarding national security<\/a>, child welfare, and the value of American citizenship.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Recent <a href=\"https:\/\/www.scmp.com\/economy\/policy\/article\/3364055\/how-us-crackdown-upending-plans-chinese-birth-tourists?utm_medium=Social&#038;utm_content=visual-style&#038;utm_source=Twitter\" target=\"_blank\" rel=\"noreferrer noopener\">news<\/a> from China shows that some Chinese women who plan to give birth in the United States solely to secure citizenship for their children are thinking twice after the Trump administration\u2019s crackdown on \u201cbirth tourism.\u201d<\/p>\n<p>In early August, President Trump signed an <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2026\/08\/ending-birth-tourism\/\" target=\"_blank\" rel=\"noreferrer noopener\">executive order<\/a> called \u201cEnding Birth Tourism.\u201d The order <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2026\/08\/ending-birth-tourism\/\" target=\"_blank\" rel=\"noreferrer noopener\">defines<\/a> \u201cbirth tourism\u201d as either a foreign national entering the United States on a nonimmigrant visa to give birth or any attempt by a foreign national to help someone else enter the country for the same reason.<\/p>\n<p>It is difficult to know exactly how many babies are born in the U.S. because of birth tourism, since the government does not keep official records and private estimates differ. In 2020, the Center for Immigration Studies (CIS) estimated there were between <a href=\"https:\/\/cis.org\/Camarota\/Revised-Estimate-Birth-Tourism\" target=\"_blank\" rel=\"noreferrer noopener\">20,000 and 26,000<\/a> birth tourism cases.<\/p>\n<p>No official ranking of nationalities for birth tourism exists, but the <a href=\"https:\/\/apnews.com\/general-news-travel-161a0db2666044dc8d42932edd9b9ce6\" target=\"_blank\" rel=\"noreferrer noopener\">media<\/a> often mention Russia, China, Turkey, and Nigeria as common countries of origin. China is cited most often in <a href=\"https:\/\/www.ice.gov\/news\/releases\/chinese-national-pleads-guilty-running-birth-tourism-scheme-helped-aliens-give-birth#:~:text=Dongyuan%2520Li%2520%2528%25E6%259D%258E%25E5%2586%25AC%25E5%25AA%259B%2529%252C%252041,one%2520count%2520of%2520visa%2520fraud.\" target=\"_blank\" rel=\"noreferrer noopener\">prominent cases and commercial networks<\/a>, especially in Southern California, where some packages cost tens of thousands of dollars.<\/p>\n<p>No matter the number of cases or the country of origin, birth tourism has become a <a href=\"https:\/\/www.ice.gov\/news\/releases\/chinese-national-pleads-guilty-running-birth-tourism-scheme-helped-aliens-give-birth#:~:text=Dongyuan%2520Li%2520%2528%25E6%259D%258E%25E5%2586%25AC%25E5%25AA%259B%2529%252C%252041,one%2520count%2520of%2520visa%2520fraud.\" target=\"_blank\" rel=\"noreferrer noopener\">profit-driven industry<\/a> rife with <a href=\"https:\/\/www.justice.gov\/usao-edny\/pr\/turkish-national-sentenced-27-months-orchestrating-birth-tourism-health-care-fraud\" target=\"_blank\" rel=\"noreferrer noopener\">fraud<\/a>. It has diminished the value of U.S. citizenship by treating it like a \u201ccommodity\u201d and thereby breaking \u201ca sacred bond between the American people and the Nation in which they live,\u201d as the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/atlanta-mayor-lance-bottoms-signs-executive-order-circumventing-ga-election-laws\/\" title=\"Atlanta Mayor Lance Bottoms Signs ... Circumventing GA Election Laws\">executive order states<\/a>.<\/p>\n<p>The executive order does not create new legislation; it enforces the <a href=\"https:\/\/www.govinfo.gov\/app\/details\/FR-2020-01-24\/2020-01218\" target=\"_blank\" rel=\"noreferrer noopener\">existing immigration rule<\/a> that \u201ctravel to the United States with the primary purpose of obtaining U.S. citizenship for a child by giving birth in the United States is an impermissible basis for the issuance of a B nonimmigrant visa.\u201d It authorizes the secretaries of state and homeland security to prevent entry or the granting of visas and travel authorizations, revoke existing ones and permanently bar entry, and take action against individuals or organizations (inside or outside the United States) who facilitate the practice.<\/p>\n<p>The State Department responded by creating a Birth Tourism Prevention Task Force. On Aug. 12, the task force <a href=\"https:\/\/www.state.gov\/releases\/office-of-the-spokesperson\/2026\/08\/state-department-establishes-task-force-to-end-birth-tourism\/\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a> it had already revoked \u201cmore than 600 visas from foreign nationals across the globe to safeguard our nation from this abuse.\u201d<\/p>\n<p>A recent South China Morning Post <a href=\"https:\/\/www.scmp.com\/economy\/policy\/article\/3364055\/how-us-crackdown-upending-plans-chinese-birth-tourists?utm_medium=Social&#038;utm_content=visual-style&#038;utm_source=Twitter\" target=\"_blank\" rel=\"noreferrer noopener\">report<\/a> shows that news of the executive order, accounts of pregnant Chinese women being turned away at ports of entry, and visa denials for women who previously gave birth in the United States are circulating widely on Chinese social media. This has created uncertainty about U.S. birth plans and led some families to consider alternatives.<\/p>\n<p>It is <a href=\"https:\/\/www.scmp.com\/economy\/policy\/article\/3364055\/how-us-crackdown-upending-plans-chinese-birth-tourists?utm_medium=Social&#038;utm_content=visual-style&#038;utm_source=Twitter\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> that wealthy Chinese parents often view birth tourism as an investment that gives their children \u201cmore options should the need arise.\u201d Many believe U.S. citizenship will make it easier for their children to escape China\u2019s grueling education system, study abroad, and reach their full potential. Hong Wang, the first Chinese female mathematician to <a href=\"https:\/\/www.quantamagazine.org\/hong-wang-wins-2026-fields-medal-the-third-woman-ever-20260723\/\" target=\"_blank\" rel=\"noreferrer noopener\">win the 2026 Fields Medal<\/a> for work done in the United States, expressed frustration with that system in an interview that was quickly censored. Her comments sparked <a href=\"https:\/\/www.washingtonpost.com\/world\/2026\/08\/14\/would-hong-wang-have-won-her-fields-medal-if-she-had-stayed-china\/\" target=\"_blank\" rel=\"noreferrer noopener\">intense debate<\/a> in China over whether she could have achieved the same success at home, reinforcing for many parents the practical value of a U.S. passport.<\/p>\n<p>Even as the Trump administration\u2019s crackdown on birth tourism has produced hesitation, demand for American-born children remains strong. The same report indicates that more wealthy Chinese families may now turn to commercial surrogacy, which is banned in China but less strictly regulated in the U.S., to achieve the same result.<\/p>\n<p>Some of China\u2019s wealthiest individuals have already been linked to troubling surrogacy arrangements. About a year ago, police <a href=\"https:\/\/thefederalist.com\/2025\/08\/13\/chinese-immigrants-create-21-surrogate-children-before-allegedly-abusing-them\/\" target=\"_blank\" rel=\"noreferrer noopener\">removed<\/a> 21 children from a Chinese couple in California who operated a surrogacy agency primarily for themselves. Most of the babies were born to American women who believed they were assisting other Chinese couples with fertility issues.<\/p>\n<p>Last December, The Wall Street Journal <a href=\"https:\/\/www.wsj.com\/us-news\/chinese-billionaires-surrogacy-pregnancy-7fdfc0c3\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> that Chinese billionaire Xu Bo has fathered more than 100 children through U.S. surrogacy, many of whom he has never met. His company later questioned the exact figure but did not deny that he wants more children this way. The Journal also detailed the case of Wang Huiwu, another wealthy businessman, who \u201chired U.S. models and others as egg donors to have 10 girls, with the aim of one day marrying them off to powerful men.\u201d These cases illustrate how some treat surrogate births as a means to personal or dynastic ends.<\/p>\n<p>Surrogacy even played a key role in the downfall of one of China\u2019s most influential figures. Qin Gang, the former Chinese foreign minister, was once a rising star close to President Xi. His career ended after it was speculated that he had <a href=\"https:\/\/www.wsj.com\/us-news\/chinese-billionaires-surrogacy-pregnancy-7fdfc0c3\" target=\"_blank\" rel=\"noreferrer noopener\">fathered a child<\/a> with his mistress, newscaster Fu Xiaotian, through surrogacy. After this came to light, Qin <a href=\"https:\/\/www.wsj.com\/podcasts\/the-journal\/the-missing-minister-the-vanishing-of-qin-gang\/1abdde16-af88-4090-baa1-edd9651d0600\" target=\"_blank\" rel=\"noreferrer noopener\">vanished<\/a> from public life. It seems Xi no longer trusted a foreign minister whose child was an American citizen.<\/p>\n<p>In the United States, many consider the use of birth tourism and commercial surrogacy by Chinese nationals to be a matter of national security. Sen. Rick Scott, R-Fla., introduced the <a href=\"https:\/\/www.rickscott.senate.gov\/2025\/11\/sen-rick-scott-introduces-safe-kids-act-to-stop-foreign-adversaries-from-exploiting-u-s-surrogacy-laws\" target=\"_blank\" rel=\"noreferrer noopener\">SAFE KIDS Act<\/a> at the end of last year to stop \u201cadversarial nations, including Communist China, from using American surrogates to obtain U.S. citizenship for their children and traffic infants abroad.\u201d The bill won the support of some Republicans but failed to pass since Senate Democrats <a href=\"https:\/\/www.rickscott.senate.gov\/2026\/7\/democrats-block-sen-scott-s-safe-kids-act-as-support-grows-for-ending-birth-tourism-loophole\" target=\"_blank\" rel=\"noreferrer noopener\">blocked<\/a> a vote in late July.<\/p>\n<p>News from China suggests that heightened scrutiny on birth tourism is starting to produce a real deterrent effect, yet the underlying demand is already migrating toward commercial surrogacy. As long as that pathway remains open to citizens of adversarial countries, American citizenship can still be acquired through U.S. wombs. Addressing birth tourism and tightening the regulations on commercial surrogacy shouldn\u2019t be partisan issues. They are about national security, child welfare, and the integrity of citizenship itself. Both Democrats and Republicans should support measures such as the SAFE KIDS Act to close the remaining loophole.<\/p>\n<p>The United States is a major exception among developed countries on this issue. France, Germany, Italy, Spain, Canada, Australia, the United Kingdom, and many others either ban commercial surrogacy outright or allow only altruistic arrangements.
