Advocates consider him among the most pro-Second Amendment presidents of the modern era. His administration has <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4632461\/doj-files-lawsuit-against-virginia-assault-weapon-ban\/\">sued Virginia over its semiautomatic weapons ban<\/a>, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4632803\/doj-launches-lawsuit-california-glock-ban\/\">challenged California\u2019s Glock restrictions<\/a>, and begun <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4549057\/doj-takes-aim-clunky-gun-regulations-atf-robert-cekada-confirmation\/\">unwinding dozens of Biden-era firearm regulations<\/a>.<\/p>\n<p class=\"wp-block-paragraph\">But the relationship has not gotten off without a hitch.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-3\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-3\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<\/div>\n<h2 id=\"h-past-breaks-on-gun-policy-complicate-trump-s-trust-meter\" class=\"wp-block-heading\">Past breaks on gun policy complicate Trump\u2019s trust meter<\/h2>\n<p class=\"wp-block-paragraph\">In one of his more controversial first-term decisions, Trump <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/3045214\/supreme-court-strikes-down-ban-on-bump-stocks\/\">banned bump stocks<\/a> after the devices were used in the 2017 Las Vegas mass shooting. Bump stocks are gun attachments meant to help semiautomatic rifles fire more rapidly. (AP Photo\/Rick Bowmer)<\/figcaption><\/figure>\n<p class=\"wp-block-paragraph\">A more recent rift emerged in September 2025 when DOJ officials reportedly <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3794023\/doj-looking-ban-transgender-people-owning-firearms\/\">considered whether transgender people could be barred from possessing guns<\/a> under a federal law governing certain people with serious mental conditions.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-4\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-4\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-25\" data-wex-ad=\"art-dsk-inart-4\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The possibility prompted <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3795944\/nra-opposes-restricting-guns-transgender-people\/\">immediate opposition from the NRA<\/a> and other gun-rights groups, which warned against disarming an entire category of people without individualized findings of dangerousness. The DOJ said no specific proposal had been advanced.<\/p>\n<p class=\"wp-block-paragraph\">The Trump administration also maintained the Biden DOJ\u2019s position in <em><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/24-1234_new_6k47.pdf\">United States v. Hemani<\/a><\/em>, urging the justices to uphold the prosecution of a Texas man who possessed a firearm while admitting to law enforcement to using marijuana \u201cabout every other day.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4568152\/supreme-court-expands-guns-marijuana-hemani\/\">Supreme Court sided with Hemani in June<\/a>, holding that the government had violated the Second Amendment through its prosecution of a regular marijuana user. The ruling did not weigh in on the legality of barring addicts or intoxicated drug users from possessing firearms. Gun Owners of America and other Second Amendment organizations had backed Hemani, placing them opposite the Trump administration once again.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-5\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-5\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-26\" data-wex-ad=\"art-dsk-inart-5\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Those episodes are fueling suspicion as the administration decides what to do in two new cases gun-rights advocates have won so far.<\/p>\n<h2 id=\"h-ghost-gun-victory-presents-the-latest-mystery\" class=\"wp-block-heading\">Ghost-gun victory presents the latest mystery<\/h2>\n<p class=\"wp-block-paragraph\">U.S. District Judge Reed O\u2019Connor ruled Monday that a 2022 <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/atf\/\">ATF<\/a> regulation governing partially completed firearm frames, receivers, and weapons-parts kits violated the Second and Fifth amendments.<\/p>\n<p class=\"wp-block-paragraph\">The Biden administration initially adopted the rule in the second year of his presidency in an effort to crack down on so-called \u201cbuy-build-shoot\u201d kits that had begun to proliferate across the country. The goal was to require commercially sold kits capable of being assembled into functioning firearms to be treated like other guns. O\u2019Connor resolved the remaining constitutional questions in favor of the Second Amendment Foundation and other plaintiffs.<\/p>\n<p class=\"wp-block-paragraph\">The DOJ said it is evaluating the ruling\u2019s impact but has not disclosed whether it will appeal.<\/p>\n<h2 id=\"h-oct-5-deadline-looms-in-suppressor-case\" class=\"wp-block-heading\">Oct. 5 deadline looms in suppressor case<\/h2>\n<p class=\"wp-block-paragraph\">The administration faces a more immediate decision in the consolidated <em>Silencer Shop Foundation v. ATF<\/em> and <em>Jensen v. ATF<\/em> litigation, which may become the clearest clue about the direction of the DOJ\u2019s litigation strategy.<\/p>\n<p class=\"wp-block-paragraph\">U.S. District Judge James Wesley Hendrix ruled Aug. 5 that the government could not enforce challenged National Firearms Act registration and approval requirements against the plaintiffs and certain covered members and customers. The DOJ declined to seek an emergency stay before Hendrix\u2019s order took effect Aug. 13, and the government has until Oct. 5 to file a conventional appeal.<\/p>\n<p class=\"wp-block-paragraph\">Additionally, two cases are still ongoing, challenging the NFA in <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.courtlistener.com\/docket\/70994240\/brown-v-bureau-of-alcohol-tobacco-firearms-and-explosives\/?filed_after=&#038;filed_before=&#038;entry_gte=&#038;entry_lte=&#038;order_by=desc\">Missouri<\/a> and <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.courtlistener.com\/docket\/72334423\/roberts-v-bureau-of-alcohol-tobacco-firearms-and-explosives\/?filed_after=&#038;filed_before=&#038;entry_gte=&#038;entry_lte=&#038;order_by=desc\">Kentucky<\/a>.<\/p>\n<p class=\"wp-block-paragraph\">The legal dispute initially arose after Congress, via the One Big Beautiful Bill Act, reduced the law\u2019s making and transfer tax from $200 to zero while leaving its paperwork requirements intact. The maneuver immediately prompted gun rights groups to sue.<\/p>\n<p class=\"wp-block-paragraph\">Hendrix found the challenged requirements could no longer be justified under Congress\u2019s taxing power when there was no tax to collect.<\/p>\n<p class=\"wp-block-paragraph\">The order is limited and does not eliminate the NFA gun attachment registration nationwide. Its practical effect depends on whether distributors are members of the NRA or GOA, as well as several notable state law prohibitions <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/help.silencershop.com\/en\/articles\/16387894-nfa-ruling-faq-how-suppressor-purchases-work-now\">in at least nine states<\/a>. Ordinary background-check requirements also remain in place.<\/p>\n<p class=\"wp-block-paragraph\">Commerford credited the victory to the NRA\u2019s work with Trump and congressional Republicans.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThis case is possible because of our work in the Big, Beautiful Bill zeroing out the tax,\u201d Commerford said.<\/p>\n<p class=\"wp-block-paragraph\">\u201cCongress\u2019s intent was zeroing out the tax,\u201d he said. \u201cSo if you\u2019re not enforcing the tax, how can you enforce the paperwork requirements?\u201d<\/p>\n<p class=\"wp-block-paragraph\">Johnston, meanwhile, was more willing to point his finger at DOJ officials such as the Civil Division\u2019s leader Brett Schumate, whom <em>The<\/em> <em>Federalist <\/em>reported earlier this month was interested in continuing to appeal the matter.<\/p>\n<p class=\"wp-block-paragraph\">\u201cI think that there is still internal struggle with Brett Schumate the head of Civil Division who apparently wants to appeal the case,\u201d he said.<\/p>\n<p class=\"wp-block-paragraph\">There are additional signs that the pressure effort could be working as well.
