A former policy director for disgraced ex-Missouri Gov. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/eric-greitens\/\">Eric Greitens<\/a>, Scharf served as a violent crimes prosecutor in the U.S. Attorney\u2019s Office for the Eastern District of Missouri before joining now-Solicitor General D. John Sauer\u2019s James Otis Law Group. (Alex Brandon\/AP)<\/figcaption><\/figure>\n<p class=\"wp-block-paragraph\">At the same time, the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/white-house\/\">White House<\/a> and sources close to the Trump administration dismiss speculation that the president is replacing current White House counsel David Warrington with Scharf in preparation for an onslaught of congressional oversight should Democrats win a majority in one or both chambers in the Nov. 3 <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/2026-election\/\" data-type=\"post_tag\" data-id=\"11675\">midterm elections<\/a>.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cThe White House is always prepared to respond to oversight requests, no matter who is in the House or Senate,\u201d a White House official told the <em>Washington Examiner<\/em>.<\/p>\n<p class=\"wp-block-paragraph\">Former <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/house-oversight-committee\/\">House oversight committee<\/a> Chairman <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/jason-chaffetz\/\">Jason Chaffetz<\/a>, a Utah Republican, described both Warrington and Scharf as \u201ctalented attorneys\u201d who \u201cboth have the trust of the president.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cEither one of them would be exceptional in that position,\u201d Chaffetz told the <em>Washington Examiner<\/em>.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-3\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-3\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">But Republican strategist John Feehery, former House Speaker Dennis Hastert\u2019s press secretary, said Scharf \u201cwill be more aggressive\u201d than his predecessor.<\/p>\n<p class=\"wp-block-paragraph\">\u201cHe has seen how Democrats operate with his experience with the Kavanaugh and Barrett nomination fights,\u201d Feehery told the <em>Washington Examiner<\/em> of how Scharf helped confirm Supreme Court Justices <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/brett-kavanaugh\/\">Brett Kavanaugh<\/a> and <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/amy-coney-barrett\/\">Amy Coney Barrett<\/a>. \u201cAlso, it is smart to get some more energy in that position because the next two years are going to be a real battle if the Democrats win. It\u2019s a big if, but rather be ready for it if it happens.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Former U.S. Attorney for the Eastern District of Arkansas Bud Cummins agreed that if Democrats retake the House, Scharf will be \u201cat the center of fights over subpoenas, document demands, testimony, and executive privilege.\u201d<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-4\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-4\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-25\" data-wex-ad=\"art-dsk-inart-4\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cScharf is a litigator who knows the president, knows the administration, and is not likely to be intimidated by congressional threats,\u201d Cummins told the <em>Washington Examiner<\/em>. \u201cI would expect him to forcefully contest demands the White House views as illegitimate rather than simply accommodate Democratic committees.\u201d<\/p>\n<p class=\"wp-block-paragraph\">To that end, Democrats have already previewed their strategy for next year if they win the House, presuming the White House will not cooperate with their investigations: target companies and financial firms with contracts, regulatory exposure, or other dealings with the administration.<\/p>\n<p class=\"wp-block-paragraph\">Ty Cobb, who served as special White House counsel during Trump\u2019s first term,\u00a0advising the president regarding <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/justice-department\/\" data-type=\"post_tag\" data-id=\"167\">Justice Department<\/a> special counsel <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/robert-mueller\/\" data-type=\"post_tag\" data-id=\"320\">Robert Mueller\u2019s<\/a> Russia investigation, concurred with Democrats\u2019 assessment.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-5\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-5\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-26\" data-wex-ad=\"art-dsk-inart-5\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cWe\u2019ll start to see real defiance of lawfully issued congressional subpoenas and the court rulings that require the enforcement of those subpoenas,\u201d Cobb told the <em>Washington Examiner<\/em>. \u201cCertainly, you\u2019re not going to see a Justice Department that honorably pursues the contempt charges that will be required in the face of that defiance. If Congress refers criminal contempt charges against somebody in the administration, they can\u2019t realistically expect DOJ to pursue those referrals as the law requires. We\u2019re just not going to see that, unlike what we have seen historically and recently experienced with [Steve] Bannon and [Peter] Navarro.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Cobb, who also predicted increased use of executive privilege, argued that White House counsels are supposed to maintain a degree of independence. The attorney pointed to Scharf\u2019s past claims that the 2020 election was stolen as cause for concern.<\/p>\n<p class=\"wp-block-paragraph\">Although Scharf was once Trump\u2019s personal attorney and has assisted him in expanding his presidential powers through executive action, he has exercised independence, reportedly criticizing a proposal from <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/stephen-miller\/\" data-type=\"post_tag\" data-id=\"2967\">Stephen Miller<\/a>, the White House deputy chief of staff for policy, to end habeas corpus for illegal immigrants.<\/p>\n<p class=\"wp-block-paragraph\">A former Trump campaign official and colleague of Scharf emphasized the new White House counsel\u2019s character, contending he is \u201cprobably one of the most popular staff members\u201d in the administration.<\/p>\n<p class=\"wp-block-paragraph\"><a target=\"_blank\" rel=\"noreferrer noopener\" href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/state\/4679728\/from-lebron-to-meek-mill-shapiro-courts-celebrities-in-campaign\/\"><strong>FROM LEBRON TO MEEK MILL, SHAPIRO COURTS CELEBRITIES IN CAMPAIGN<\/strong><\/a><\/p>\n<p class=\"wp-block-paragraph\">For instance, Scharf organized a well-attended first 100 days party last year at a bar in Washington.<\/p>\n<p class=\"wp-block-paragraph\">\u201cHe\u2019s just a really sharp, dedicated, hardworking guy,\u201d the former campaign official told the <em>Washington Examiner<\/em>. \u201cHe\u2019s one of the guys you want to be in a foxhole with because, like I said, he keeps a good amount of levity in the office around him.
