Cox is facing multiple charges, including indecent exposure, indecent liberties with a child, and loitering related to entering female locker rooms across Arlington. Cox, who is transgender and biologically male, accessed these facilities due to Arlington\u2019s policy allowing individuals to use facilities matching their gender identity. <\/p>\n<p>Initially, the Arlington judge dismissed the loitering charges, citing vagueness in the law, but the appeals court found that the judge used an incorrect legal process, as the law must be evaluated as applied to Cox\u2019s specific conduct before ruling on its constitutionality. The court emphasized the importance of analyzing Cox\u2019s conduct before assessing the law\u2019s constitutionality in general, stating that the law\u2019s lack of definition for \u201cloitering\u201d does not automatically make it invalid.<\/p>\n<p>Cox had waived legal representation and is self-representing on some charges. The case stems from incidents in October 2024, including Cox being reported nude in a high school locker room and later being found walking nude in a Fairfax County recreation center\u2019s locker room, despite being banned from such facilities. Police discovered evidence linking cox to scheduled children\u2019s activities,and <a href=\"https:\/\/amzn.to\/3YuVZYV\" >body camera footage shows<\/a> the police response to multiple complaints about Cox\u2019s inappropriate behavior.<\/p>\n<p>While Cox argues that his presence in the facilities as a transgender individual and homeless person is not illegal and constitutes discrimination and First Amendment rights, the case remains ongoing. The court will review whether the loitering law can be constitutionally applied to cox\u2019s conduct, and the trial, initially scheduled for April, has been postponed pending the legal proceedings. Cox also has a conviction for possessing child pornography. Cox had argued Virginia\u2019s loitering law was unconstitutionally vague because it does not specifically define the word \u201cloitering.\u201d Arlington County Circuit Court <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/videos\/3844278\/virginia-locker-room-suspect-richard-cox-scolds-judge-preferred-pronouns\/\">Judge Daniel T. Lopez<\/a> agreed and <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/crime\/4505473\/transgender-sex-offender-massive-win-virginia-locker-room-trial-paused\/\">dismissed the charges back in March<\/a>. Instead, the appeals court ruled Lopez used the wrong legal process when he struck down the law.<\/p>\n<p class=\"wp-block-paragraph\">The problem wasn\u2019t necessarily what Lopez decided, but how he got there, the appeals court said.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Lopez dismissed the charges without first determining whether the law was unconstitutional as applied to Cox. In other words, the judge needed to first determine whether the law was unconstitutional in the context of Cox\u2019s specific conduct in the locker rooms.<\/p>\n<p class=\"wp-block-paragraph\">The appeals court said that question must be answered before a court can decide whether the law is unconstitutional in every situation.<\/p>\n<p class=\"wp-block-paragraph\">\u201c[A] court should therefore examine the complainant\u2019s conduct before analyzing other hypothetical applications of the law,\u201d Judge Dominique A. Witnesses claim Cox, who is still a fully intact male, would walk around the locker room naked for hours in front of young girls. Police found <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4442040\/richard-cox-sex-offender-evidence-thrown-out-before-trial\/\">evidence on Cox\u2019s phone<\/a> that Cox had highlighted children\u2019s swim lessons and gymnastic classes on recreation center schedules.<\/p>\n<p class=\"wp-block-paragraph\">The <em>Washington Examiner<\/em> also obtained body camera footage showing police responding to complaints about Cox entering women\u2019s locker rooms at recreation centers in Fairfax County. Although Cox had been banned from entering the facilities countywide, the 58-year-old was <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/videos\/3833172\/jason-miyares-virginia-transgender-locker-room-policies\/\">never charged by Fairfax County Commonwealth\u2019s Attorney<\/a> Steve Descano, a progressive backed by liberal mega-donor George Soros.<\/p>\n<p class=\"wp-block-paragraph\">Cox argued, as a homeless person who used public facilities to maintain hygiene, that simply being in those facilities as a transgender person was not illegal. Instead, Cox argued that this is discrimination and a violation of the First Amendment.<\/p>\n<p class=\"wp-block-paragraph\">The case will now return to Arlington County Circuit Court. Judge Lopez has already ruled that Cox can self-represent on some of the charges and <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/videos\/4484283\/judge-allows-sex-offender-question-witnesses-locker-room-trial\/\">question witnesses during the trial<\/a>.<\/p>\n<p class=\"wp-block-paragraph\"><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/crime\/4505473\/transgender-sex-offender-massive-win-virginia-locker-room-trial-paused\/\"><strong>TRANSGENDER SEX OFFENDER GETS MASSIVE WIN AS VIRGINIA LOCKER ROOM TRIAL IS PAUSED<\/strong><\/a><\/p>\n<p class=\"wp-block-paragraph\">The trial was originally scheduled to begin April 20, but was postponed while prosecutors appealed the judge\u2019s decision to throw out the loitering charges.
