According to Rep. Harriet Hageman, R-Wyo., however, all hope of closing those loopholes, \u201cprotecting children,\u201d and \u201cpromoting national security,\u201d even after the Supreme Court\u2019s <em>Trump v. Barbara<\/em> decision, is not lost.<\/p>\n<p>President Donald Trump tried to take aim at the birth tourism industry in his <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2026\/08\/continuing-to-protect-the-meaning-and-value-of-american-citizenship\/\" target=\"_blank\" rel=\"noreferrer noopener\">August 6 executive order<\/a> when he clarified that children born to an \u201calien enemy,\u201d such as members of designated foreign terrorist organizations, are not entitled to birthplace citizenship. That executive order alone, Hageman warned in a letter to the White House on Thursday, even when paired with the Department of Justice\u2019s targeting of <a href=\"http:\/\/x.com\/TheJusticeDept\/status\/2072055062600499269\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cfraudulent birth tourism schemes,\u201d<\/a> isn\u2019t enough to keep foreigners from exploiting \u201cour laws while treating children as commodities.\u201d<\/p>\n<p>\u201cYour decision to prohibit international surrogacy is an important step, but more can and should be done to deter bad actors by eliminating the incentives that facilitate this practice,\u201d the <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/115770367420942580\" target=\"_blank\" rel=\"noreferrer noopener\">Trump-backed<\/a> Senate candidate wrote in a letter obtained by The Federalist. <\/p>\n<p>Surrogacy denies <a href=\"https:\/\/thefederalist.com\/2023\/12\/04\/the-conservative-pro-life-case-against-surrogacy\/\" target=\"_blank\" rel=\"noreferrer noopener\">children\u2019s natural rights<\/a> to life, to a mother and father, and to freedom from commodification; <a href=\"https:\/\/thefederalist.com\/2025\/08\/27\/united-nations-report-slavery-like-rent-a-womb-industry-should-be-globally-banned\/\" target=\"_blank\" rel=\"noreferrer noopener\">exploits vulnerable women<\/a>; and creates reproduction loopholes for <a href=\"https:\/\/thefederalist.com\/2025\/07\/29\/rising-popularity-of-rent-a-womb-industry-emboldens-pedophiles-to-buy-proximity-to-kids\/\" target=\"_blank\" rel=\"noreferrer noopener\">pedophiles<\/a> and other bad actors unfit to be parents. <\/p>\n<p>More imminently for the president, America\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pope-francis-is-right-every-nation-should-ban-the-despicable-rent-a-womb-industry\/\" title=\"Pope Francis: Ban the &#039;Despicable&#039; ... in All Nations\">international rent-a-womb industry<\/a> is <a href=\"https:\/\/thefederalist.com\/2026\/05\/18\/how-the-ccp-uses-birthplace-citizenship-and-surrogacy-to-manufacture-americans\/\" target=\"_blank\" rel=\"noreferrer noopener\">dominated<\/a> by foreigners \u2014 many inhabitants of the nation\u2019s sworn enemy country \u2014 to secure a child with full American citizenship. The citizenship benefits for a child born to a surrogate on American soil and then <a href=\"https:\/\/amzn.to\/3YuVZYV\" >shipped overseas include key documentation<\/a> like a birth certificate, passport, and Social Security number that make foreigners\u2019 pathway to U.S. citizenship <a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/permanent-workers\/eb-5-immigrant-investor-program\" target=\"_blank\" rel=\"noreferrer noopener\">cheaper<\/a> and <a href=\"https:\/\/www.ilrc.org\/sites\/default\/files\/2023-03\/How%20USC%20can%20petition%20their%20parents%20for%20LPR_March%202023.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">easier<\/a>.<\/p>\n<p>Hageman cited the story of <a href=\"https:\/\/thefederalist.com\/2026\/07\/22\/surrogate-mom-fights-for-custody-of-babies-she-raised-after-purchaser-abandoned-them\/\" target=\"_blank\" rel=\"noreferrer noopener\">Kyla Simpson<\/a> as evidence that surrogacy \u201carrangements are planned and coordinated by foreign nationals before they ever set foot in the United States, with U.S. surrogacy agencies facilitating the process.\u201d Simpson gestated three babies and raised them for months, even navigating one of their deaths due to respiratory complications, after the Chinese man who commissioned their creation failed to pick them up at birth. <\/p>\n<p>\u201cThis case, along with the broader challenges posed by cultural differences, language barriers, and conflicting state laws, underscores the need for federal action,\u201d Hageman wrote. \u201cYour decision to prohibit international surrogacy is an important step, but more can and should be done to deter bad actors by eliminating the incentives that facilitate this practice.\u201d<\/p>\n<p>Under the The Immigration and Nationality Act, Hageman noted, Trump has \u201cbroad authority to restrict the entry of classes of foreign nationals whose admission you determine would be \u2018detrimental to the interests of the United States.\u2019\u201d Not only that, but Hageman encouraged the White House to prompt the U.S. Department of State and U.S. Citizenship and Immigration Services to \u201cdeny visas\u201d to people known to take advantage of  \u201cinternational surrogacy<br \/>arrangements involving U.S. clinics and surrogates, including plans to commission or collect a<br \/>resulting child.\u201d<\/p>\n<p>\u201cSuch individuals could also be made permanently ineligible for entry under any visa category, asylum, refugee status, temporary protected status, lottery- or family-based immigration, or petitions for lawful permanent residency or U.S. citizenship, including through a future marriage to an American citizen,\u201d Hageman added. <\/p>\n<p>In addition to curbing foreigners participation in international surrogacy, Hageman suggested Trump also \u201chold fertility organizations and surrogacy agencies accountable for facilitating this practice.\u201d She listed organizations like Surrogate First and Creative Family Connections that advertise birth tourism loopholes to their overseas clients and warned certain agencies \u201cactively market these services to Asian clients.\u201d As The Federalist <a href=\"https:\/\/thefederalist.com\/2026\/07\/01\/citizenship-has-become-a-financial-product-ripe-for-exploitation-by-birth-tourists-and-illegals\/\" target=\"_blank\" rel=\"noreferrer noopener\">previously reported<\/a>, selling the promise of U.S. citizenship for foreigners\u2019 babies, and eventually foreigners themselves, is noticeably\u00a0profitable.<\/p>\n<p>\u201cLawmakers have also identified more than 107 Chinese-owned surrogacy agencies in Southern California that reportedly cater almost exclusively to wealthy Chinese clients, with some linked to Chinese state-owned entities.
