Azerbaijan acknowledged that this matter hasn\u2019t been settled by the Supreme Court or district courts.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-3\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-3\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">While not disputing that the U.S. government can\u2019t sue for defamation, it argued that this rule \u201cis a creature of the First Amendment\u2019s protection of the American public\u2019s right to criticize its own government free from the threat of seditious-libel liability. Its rationale has no application to a foreign sovereign, which is not accountable to the American electorate.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cAs a sovereign state recognized by the United States and with which the United States maintains peaceful relations, Azerbaijan may sue in U.S. courts; a well<a href=\"https:\/\/amzn.to\/3YuVZYV\" >-established legal principle dating back centuries<\/a>,\u201d the lawsuit said.<\/p>\n<p class=\"wp-block-paragraph\">Justifying this, it pointed to the landmark 1870 Supreme Court case <em>The Sapphire<\/em>, 78 U. S. 164 (1870), which concerned a lawsuit brought in the name of French Emperor Napoleon III against the American ship <em>Sapphire<\/em>, which collided with the French transport <em>Euryale<\/em> in San Francisco harbor in 1867.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-4\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-4\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-25\" data-wex-ad=\"art-dsk-inart-4\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cThe first question raised is as to the right of the French Emperor to sue in our courts. On this point, not the slightest difficulty exists,\u201d Supreme Court Justice Joseph Bradley <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/78\/164\/\" data-type=\"link\" data-id=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/78\/164\/\">wrote<\/a> in the court\u2019s opinion at the time. \u201cA foreign sovereign, as well as any other foreign person, who has a demand of a civil nature against any person here may prosecute it in our courts.
