County Commissioners of Boulder County case, which will decide whether local governments can use state tort law to pursue claims with implications extending far beyond their borders. A network of <a class=\"LexicalEditorTheme__link\" href=\"https:\/\/www.ourchildrenstrust.org\/\" target=\"_blank\" rel=\"noopener\">left<\/a>\u2013<a class=\"LexicalEditorTheme__link\" href=\"https:\/\/www.whenjustice.org\/\" target=\"_blank\" rel=\"noopener\">leaning<\/a> <a class=\"LexicalEditorTheme__link\" href=\"https:\/\/www.citizen.org\/\" target=\"_blank\" rel=\"noopener\">climate groups<\/a> and legal figures appear in the amicus curiae briefs in support of Boulder, adding to a long list of high-profile court cases challenging fossil fuel companies.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">\u201c[The Left\u2019s] goal is going to use courtrooms [and] lawfare to unlock their policy dreams. The faster conservatives wake up to that, the faster we can respond and not end up living in Gavin Newsom\u2019s America,\u00a0without realizing that it was happening,\u201d O.H. Skinner, executive director at Alliance For Consumers, told the Daily Caller News Foundation.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">Boulder County and the City of Boulder <a class=\"LexicalEditorTheme__link\" href=\"https:\/\/www.scotusblog.com\/cases\/suncor-energy-inc-v-county-commissioners-of-boulder-county\/\" target=\"_blank\" rel=\"noopener\">sued<\/a> Suncor Energy and ExxonMobil in 2018, alleging the fossil fuel companies contributed to climate change and seeking damages under Colorado state tort law. Suncor and ExxonMobil <a class=\"LexicalEditorTheme__link\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-170\/409590\/20260521184428959_25-170_Suncor_v_Boulder_Merits_FINAL.pdf\" target=\"_blank\" rel=\"noopener\">argue<\/a> that states cannot use their own tort laws to impose liability for harms allegedly caused by interstate and international greenhouse-gas emissions, an issue they contend is governed by federal law.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">A win for climate activists would reinvigorate the environmental left\u2019s campaign in the courts, which sustained massive losses in cases like <a class=\"LexicalEditorTheme__link\" href=\"https:\/\/law.justia.com\/cases\/federal\/district-courts\/montana\/mtdce\/2:2025cv00054\/80996\/46\/\" target=\"_blank\" rel=\"noopener\">Lighthiser v. Trump<\/a> and Mayor &#038; City Council of Baltimore v. BP.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">In\u00a0Lighthiser v. Trump, 22 young plaintiffs challenged three Trump energy executive orders on constitutional grounds, but a federal judge dismissed the case for lack of standing, a decision the Ninth Circuit unanimously affirmed in June 2026.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">In Mayor &#038; City Council of Baltimore v. BP, the Maryland Supreme Court upheld the dismissal of climate-related tort suits brought by Baltimore, Annapolis and Anne Arundel County against 26 oil and gas companies, concluding that Maryland tort law could not be used to impose liability for harms arising from <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/climate-change-activists-ditch-the-turkey-put-crickets-in-your-pie-crust-on-non-religious-thanksgiving\/\" title=\"... Activists: Ditch the Turkey, Put Crickets in Your Pie Crust on \u2018Non-Religious\u2019 Thanksgiving\u00a0\">global greenhouse-gas emissions<\/a>.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">There aren\u2019t special constitutional rules for interstate pollution, WHEN Justice, a non-profit focused on \u201caccountability,\u201d <a class=\"LexicalEditorTheme__link\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-170\/417965\/20260803140729836_WHEN%20Amicus%20Brief.pdf\" target=\"_blank\" rel=\"noopener\">claimed<\/a> in its brief supporting County Commissioners of Boulder County.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">\u201cSherlock Holmes famously calls attention to the dog that does not bark; the absence of a thing that should be there is often the most probative piece of evidence,\u201d\u00a0the brief says.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">Analysts who have closely watched the left\u2019s legal campaign over the years aren\u2019t convinced that the Suncor case will be a silver bullet.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">\u201cThe brief Boulder\u2019s lawfare attorneys submitted in late July recycles arguments which have been repeatedly rejected in various state and federal courts, including by the Supreme Court itself, in other cases that are part of this same legal grift,\u201d David Blackmon, an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/america-found-a-rare-metal-it-desperately-needs-red-tape-could-keep-it-in-the-ground-for-ages\/\" title=\"America Found A Rare Metal It Desperately Needs. Red Tape Could Keep It In The Ground For Ages\">energy public policy analyst<\/a>, told DCNF. \u201cExpecting the Supreme Court to reverse itself now is the definition of insanity regardless of how many supporting amicus briefs are filed by coordinating activists and lawfare attorneys.\u201d<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">Our Children\u2019s Trust, a left-wing nonprofit that represents young people in climate litigation trials, filed an amicus brief representing eight young people, ages 8 to 22, living in Boulder County. Its brief <a class=\"LexicalEditorTheme__link\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-170\/417919\/20260803130043205_2026.08.02.Suncor%20Amicus.Final.pdf\" target=\"_blank\" rel=\"noopener\">alleges<\/a> that these individuals \u201care being directly harmed by air pollution from fossil fuels and climate disruptions.\u201d<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">\u201cThe money is not the point of these lawsuits. The money is a means of crippling the energy industry that they don\u2019t like and funding all the things that they do like,\u201d Skinner explained. \u201cThis is being pushed by ideological donors to accomplish ideological ends, and the amicus briefs are a really good reflection of that because [a] large number of them were filed by groups or people or law firms that are receiving money from the same set of donors.\u201d<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">Blackmon noted that the lawsuits end up costing \u201ctens of millions of dollars for the defendant companies,\u201d as they have to mount a defense.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">The case has drawn attention from Ivy League law professors, including <a class=\"LexicalEditorTheme__link\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-170\/418037\/20260803165352064_25-170%20Amicus%20Brief.pdf\" target=\"_blank\" rel=\"noopener\">Harold Hongju Koh<\/a> at Yale Law School and Michael Burger at Columbia.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">\u201cSenior Republican and Democratic officials who have shaped American climate policy reject the claim of energy companies and the Trump Administration that foreign policy concerns \u2018preempt\u2019 state lawsuits like Boulder\u2019s,\u201d Koh said. \u201cThe Trump Administration has no clear climate policy with which Colorado\u2019s \u00a0aw could conflict and the Supreme Court does not apply preemption by disengagement or policy vacuum.\u00a0In earlier cases, some of the same companies told the Court that the Clean Air Act cut off federal lawsuits against their emissions. Now to escape Boulder\u2019s suit, they argue\u00a0that those emissions are \u2018inherently federal,\u2019 so that state lawsuits should be cut off too.\u201d<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">\u201cThis bait-and-switch should not allow them to escape accountability for the harm they have caused every Coloradan,\u201d Koh concluded.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">Burger, the executive director of the Sabin Center for Climate Change Law and Counsel at Sher Edling, a firm that has built more than two dozen climate-liability suits against energy companies,<a class=\"LexicalEditorTheme__link\" href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/25\/25-170\/417995\/20260803145436568_2026-08-03%20SubSov%20Amicus%20Brief%204923-9086-1764%20v.1.pdf\" target=\"_blank\" rel=\"noopener\"> appears as counsel<\/a> on an amicus brief filed on behalf of a coalition of Democratic-led cities and states.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">Burger did not respond to the DCNF\u2019s requests for comment.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">\u201cThe left is basically trying to play games to undermine the structure and order of our constitutional system to accomplish their policy goals, even though they are trying to shred the kind of core foundational fabric of how our constitutional structure operates,\u201d Skinner told the DCNF. \u201cAnd so this goes entirely against the conservative legal framework of the world.\u201d<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">Burger <a class=\"LexicalEditorTheme__link\" href=\"https:\/\/www.nationalacademies.org\/read\/26919\" target=\"_blank\" rel=\"noopener\">previous work<\/a> appears to have been used in an \u201cattribution science\u201d chapter in the fourth edition of the National Academies of Science (NAS) Reference Manual on Scientific Evidence. That chapter was <a class=\"LexicalEditorTheme__link\" href=\"https:\/\/www.nationalacademies.org\/news\/nas-to-conduct-process-review-of-chapter-in-reference-manual-on-scientific-evidence\" target=\"_blank\" rel=\"noopener\">removed<\/a> from the Federal Judicial Center\u2019s website after it received immense backlash.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">Supreme Court Associate Justice Elena Kagan wrote the foreword to the hotly contested fourth edition, in which she expressed views on climate change.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">\u201cDespite having been ongoing for almost a decade now, this lawfare campaign has yet to actually recover even a dollar on behalf of its myriad local and state \u201cplaintiffs,\u201d Blackmon said. \u201cTo this point, the only people benefitting from the campaign\u2019s myriad separate lawsuits have been the lawfare firms themselves and the leftwing conflict groups and consultants with which they coordinate.\u201d<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">Notably, the climate chapter\u2019s section on so-called \u201cattribution science,\u201d the key theory behind the climate litigation, was apparently lifted from previous work he produced.
