The wild, wild west that is third-party reproduction, however, claims to be an exception to that rule if a contract clause compelling abortion exists. <\/p>\n<p>That\u2019s exactly what happened to single mom surrogate McKenna West, who refused to abort the baby boy she was carrying after the Californians who paid to create him in a lab via in vitro fertilization (IVF) demanded it over the child\u2019s severe, yet treatable, heart condition diagnosis.<\/p>\n<p>Abortion propaganda dictates that West had the right to make that decision. Even the court that forbid West from contact with the baby after birth <a href=\"https:\/\/thefederalist.com\/2026\/08\/12\/weve-reached-the-infanticide-stage-of-commercial-surrogacy\/\" target=\"_blank\" rel=\"noreferrer noopener\">acknowledged<\/a> \u201cthat nothing in this order limits the right of the surrogate mother to make decisions to safeguard her own health or the health of the pregnancy.\u201d <\/p>\n<p>Instead, West\u2019s refusal to abort was contested by the commissioning parents, prompting her to flee her home state of Alaska to Texas to get the unborn baby the medical care and legal protection he needed to have a chance of life outside the womb.<\/p>\n<p>West succeeded, but the victory did not come without a severe cost to her and the baby. <\/p>\n<p>Gabriel was ultimately born on August 12. An order from the same Texas court that compelled doctors to treat him for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/watch-country-star-blake-shelton-invites-6-yr-old-heart-transplant-patient-onstage-for-duet\/\" title=\"Watch: Country Star Blake Shelton Invites 6...Yr...Old Heart Transplant Patient Onstage for Duet\">hypoplastic left heart syndrome<\/a> (HLHS), however, prevented West from <a href=\"https:\/\/x.com\/LilaGraceRose\/status\/2087604817850208749?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cseeing or holding the baby she carried and fought to protect.\u201d<\/a> Days later, the same people who demanded a literal death sentence for their baby boy were <a href=\"https:\/\/www.cbsnews.com\/news\/texas-surrogacy-dispute-baby-parents-custody\/?ftag=CNM-00-10aab7e&#038;linkId=994023808\" target=\"_blank\" rel=\"noreferrer noopener\">granted custody<\/a> of him.<\/p>\n<p>Even though Nausheen Gilkar and Omar Ahmed fought to abort Gabriel and deprive West of \u201cconsent to the life-saving surgery for Gabriel after he is born,\u201d they pretended <a href=\"https:\/\/www.cbsnews.com\/news\/texas-surrogacy-dispute-baby-parents-custody\/?ftag=CNM-00-10aab7e&#038;linkId=994023808\" target=\"_blank\" rel=\"noreferrer noopener\">through a statement from their lawyer<\/a> that they always wanted the best for their child. <\/p>\n<p>\u201cRight now, our clients are continuing to place their baby\u2019s health and well-being first, following the advice of the baby\u2019s medical team, as they always have and just as any loving parent would,\u201d attorney Lee Budner claimed. <\/p>\n<p>Budner further painted West\u2019s decision to save their son\u2019s life as a \u201cbaseless attempt to interfere with his medical care\u201d and Texas Attorney General Ken Paxton\u2019s involvement in securing Gabriel\u2019s emergency care as \u201cpolitical theater.\u201d CBS reprinted the claims uncritically. <\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">The baby in the Texas surrogacy dispute is in custody of his parents and getting medical care, their lawyer says.  <a href=\"https:\/\/t.co\/1jP1c9sFHg\">https:\/\/t.co\/1jP1c9sFHg<\/a><\/p>\n<p>\u2014 CBS News (@CBSNews) <a href=\"https:\/\/x.com\/CBSNews\/status\/2087985039854223690?ref_src=twsrc%5Etfw\">August 13, 2026<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p><a href=\"https:\/\/surrogate.com\/surrogates\/surrogacy-contracts\/surrogacy-contracts-termination-pregnancy\/\" target=\"_blank\" rel=\"noreferrer noopener\">A majority of rent-a-womb contracts<\/a> contain provisions that allow the people who paid to create the baby to demand abortion for <a href=\"https:\/\/nationalpost.com\/holy-post\/couple-urged-surrogate-mother-to-abort-fetus-because-of-defect\" target=\"_blank\" rel=\"noreferrer noopener\">genetic defects<\/a>, <a href=\"https:\/\/www.cbsnews.com\/news\/surrogate-mom-with-triplets-fights-biological-parents-on-abortion\/\" target=\"_blank\" rel=\"noreferrer noopener\">triplets<\/a>, or simply <a href=\"https:\/\/thefederalist.com\/2024\/11\/01\/couple-who-rented-a-womb-forces-surrogate-to-abort-in-case-the-baby-is-imperfect\/\" target=\"_blank\" rel=\"noreferrer noopener\">on a whim<\/a>. Even the agreements created specifically to cater to couples and surrogates who claim to be pro-life don\u2019t protect babies nor the women carrying them from the <a href=\"https:\/\/thefederalist.com\/2024\/01\/26\/surrogate-recalls-pain-she-and-baby-felt-after-the-childs-parents-demanded-abortion\/\" target=\"_blank\" rel=\"noreferrer noopener\">risk and harms of abortion<\/a>. The surrogates such as West who resist such calls for abortion are subject not only to emotional and mental turmoil, but also <a href=\"https:\/\/thefederalist.com\/2026\/07\/13\/same-sex-couple-sues-surrogate-after-she-refuses-to-abort-baby-with-cleft-lip\/\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuits<\/a> and custody battles that could <a href=\"https:\/\/nypost.com\/2026\/08\/14\/us-news\/cash-strapped-surrogate-mckenna-west-seeks-desperate-online-donations-after-bio-parents-allegedly-stiff-her\/\" target=\"_blank\" rel=\"noreferrer noopener\">financially ruin them<\/a>.<\/p>\n<p>Anyone with a brain knows that abortion activists\u2019 claims that bodily autonomy trumps all was always a myth. Babies in the womb, after all, have their own body which yields a detectable beating heart as early as six weeks post-conception. <\/p>\n<p>The increase in surrogacy-related disputes in the news cycle further confirms that \u201cher body, her choice\u201d was never an honest or factual claim. Insistence from intended parents that a piece of paper takes precedent over the lives and wellbeing of a surrogate and a baby because they paid for the pregnancy is the opposite of the \u201cempowerment\u201d abortion activists preach.<\/p>\n<p>Surrogacy <a href=\"https:\/\/thefederalist.com\/2025\/08\/27\/united-nations-report-slavery-like-rent-a-womb-industry-should-be-globally-banned\/\" target=\"_blank\" rel=\"noreferrer noopener\">exploits vulnerable women<\/a> and puts them at the center of <a href=\"https:\/\/thefederalist.com\/2026\/07\/22\/surrogate-mom-fights-for-custody-of-babies-she-raised-after-purchaser-abandoned-them\/\" target=\"_blank\" rel=\"noreferrer noopener\">impossible decisions<\/a>. More importantly, it denies <a href=\"https:\/\/thefederalist.com\/2023\/12\/04\/the-conservative-pro-life-case-against-surrogacy\/\" target=\"_blank\" rel=\"noreferrer noopener\">children\u2019s natural rights<\/a> to life, to a mother and father, and to freedom from commodification.<\/p>\n<p>Abortion fundamentally does the same. It is not empowering to kill off unborn babies. In fact, it\u2019s not only dehumanizing but also <a href=\"https:\/\/thefederalist.com\/2025\/10\/28\/trumps-trusted-pollster-even-pro-aborts-say-mifepristone-is-dangerous-and-needs-fda-regulation\/\" target=\"_blank\" rel=\"noreferrer noopener\">puts women in danger<\/a> and ignores data detailing the devastating consequences of <a href=\"https:\/\/thefederalist.com\/tag\/abortion-regret\/\" target=\"_blank\" rel=\"noreferrer noopener\">abortion regret<\/a>.<\/p>\n<p>Long gone are the days of \u201csafe, legal, and rare\u201d and logically bare \u201cbodily autonomy\u201d maxims. Here are the days of unlimited abortion on demand, especially for couples who are paying women to gestate their child. Even <a href=\"https:\/\/thefederalist.com\/2025\/01\/23\/democrats-confirm-abortion-extremism-by-blocking-protections-for-babies-born-alive-after-botched-abortions\/\" target=\"_blank\" rel=\"noreferrer noopener\">babies born alive<\/a> are not safe from the clutches of an ideology that prides itself on <a href=\"https:\/\/thefederalist.com\/2021\/01\/08\/abortion-supporters-are-no-longer-lying-about-their-cruelty\/\" target=\"_blank\" rel=\"noreferrer noopener\">cruelty<\/a> at any cost. <\/p>\n<p>Pro-lifers and the states partnering with them to protect unborn life have worked for decades to expose the dishonesty governing abortion activism.
