According to transcripts cited in the filing, they were present during the period when Trump spoke with then-Vice President <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/mike-pence\/\" data-type=\"post_tag\" data-id=\"88\">Mike Pence <\/a>in an unsuccessful effort to persuade Pence not to certify the 2020 election results. The BBC said last-minute additions to the speech, including remarks directed at Pence, followed that conversation.<\/p>\n<p class=\"wp-block-paragraph\">Trump Jr. and Ivanka Trump also traveled from the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/white-house\/\" data-type=\"post_tag\" data-id=\"8767\">White House<\/a> to the Ellipse and watched Trump deliver the speech and the crowd\u2019s reaction, according to testimony they gave to the House Jan. 6 committee.<\/p>\n<p class=\"wp-block-paragraph\">The BBC says Ivanka Trump then returned to the White House, where she observed Trump\u2019s reaction to news that violence had broken out at the Capitol and communicated directly with him about issuing a public response.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Trump Jr. also communicated with then-White House chief of staff Mark Meadows while the violence was underway, urging Trump to \u201ccondemn this s***. ASAP.\u201d He later spoke directly with his father, according to the testimony cited by the BBC.<\/p>\n<p class=\"wp-block-paragraph\">According to his testimony to the Jan. 6 committee, Kushner spoke with then-House Speaker <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/kevin-mccarthy\/\" data-type=\"post_tag\" data-id=\"12\">Kevin McCarthy<\/a>, who told him the situation at the Capitol was \u201cgetting really ugly.\u201d Kushner also drafted a proposed statement for Trump condemning the violence and worked with other senior officials on a statement ultimately issued as <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/congress\/\" data-type=\"post_tag\" data-id=\"31\">Congress<\/a> resumed certifying the election results early on Jan. 7.<\/p>\n<p class=\"wp-block-paragraph\">The BBC argued that the testimony makes the three family members possibly important witnesses in the defamation case.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-3\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-3\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">BBC lawyers attempted to serve subpoenas on Kushner and Ivanka Trump at their home in Miami in May, but police blocked the attempts. A Secret Service lawyer subsequently told the BBC that the agency was not authorized to accept subpoenas on behalf of the individuals.<\/p>\n<p class=\"wp-block-paragraph\">A separate attempt to serve Trump Jr. at Trump Tower in New York was also unsuccessful, with building security preventing the BBC from serving the document.
