Judge Mary Kay Holthus found insufficient evidence of fraudulent intent when they signed a certificate claiming trump had won Nevada&#8217;s electoral votes, ruling that the defendants had openly acknowledged their actions. The case, involving allegations of forgery, had been previously dismissed due to jurisdiction issues, but this was overturned by the Nevada Supreme Court, leading to the current dismissal. Holthus had <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3055153\/judge-tosses-out-nevada-electors-case-over-improper-venue\/\">initially tossed the case<\/a> in June 2024, after determining that the Democratic attorney general filed charges against the six Republicans in a county that lacked jurisdiction over the case. But the issue was revived in her court last year, when the Nevada Supreme Court unanimously overruled her decision to dismiss the case. <\/p>\n<p class=\"wp-block-paragraph\">The six Republicans pleaded not guilty when they were indicted in 2023 on felony charges, which carried punishments up to a maximum of five years in prison. Holthus said prosecutors \u201cindependently undermine[d] the integrity of the indictment\u201d against the electors by hiding certain evidence. She also determined that the state\u2019s evidence undermined its own arguments by testifying that the certificates could not be processed as genuine electoral documents.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThe purpose of the statute is to prevent public officials from acting upon such documents in the mistaken belief that they are genuine,\u201d she wrote. \u201cHere, the evidence presented to the grand jury demonstrated that the GOP Certificate was not a document that could legally be accepted, filed, registered, or recorded under Nevada or federal law.
