Resolving that its views on gender identity must override a centuries-old cultural practice and deep religious conviction, the State turned its enforcement power against a Korean family\u2019s small business,\u201d the groups continued.<\/p>\n<p class=\"wp-block-paragraph\">The two conservative legal groups argued to the Supreme Court in their petition that the justices should review whether Washington forcing the spa to admit biological males into female-only spaces violates the free exercise clause of the First Amendment, and whether \u201ca policy that differentiates based on anatomy discriminates \u2018based on gender identity or transgender status.&#8217;\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cA family of Christian immigrants \u2014 who fled Korea hoping for greater religious freedom \u2014 now stand to lose their livelihood or the ability to practice their faith because the State of Washington insists on dictating that males who identify as women be admitted into a female-only nude spa,\u201d the groups\u2019 petition said.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Lawyers for the groups backing the Olympus Spa have stated that the case comes down to whether women\u2019s spaces may remain exclusive to biological women.<\/p>\n<p class=\"wp-block-paragraph\">\u201cIt is an abuse and perversion of the public accommodation laws to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-tide-has-turned-on-dei-in-nearly-every-major-institution-but-teachers-and-educators-refuse-to-ditch-it\/\" title=\"The Tide Has Turned on DEI in Nearly Every Major Institution, But Teachers and Educators Refuse to Ditch It\">give biological males access<\/a> to the intimate spaces of unconsenting females in a state of full or partial undress. That\u2019s wrong, and it puts women and girls in harm\u2019s way,\u201d PJI chief counsel Kevin Snider said.<\/p>\n<p class=\"wp-block-paragraph\">The spa owners lost at both the federal district court and federal appeals court levels and are now taking their case to the Supreme Court and hoping the justices will take it up.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-3\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-3\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">In the U.S. Court of Appeals for the 9th Circuit, a bitterly divided full court declined to review a three-judge panel\u2019s decision to side with Washington and toss the case. The ruling from the full bench included an unorthodox dissent from U.S. Circuit Judge Lawrence VanDyke, an appointee of President Donald Trump, in which he stated that the case was about the state allowing \u201cswinging d***s,\u201d referring to male genitalia, in women\u2019s spaces, such as spas.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThis is a case about swinging d***s. The Christian owners of Olympus Spa \u2014 a traditional Korean, women-only, nude spa \u2014 understandably don\u2019t want them in their spa. Their female employees and female clients don\u2019t want them in their spa either. But Washington State insists on them. You\u2019re not wrong. But as much as you might understandably be shocked and displeased to merely encounter that phrase in this opinion, I hope we all can agree that it is far more jarring for the unsuspecting and exposed women at Olympus Spa \u2014 some as young as thirteen \u2014 to be visually assaulted by the real thing,\u201d VanDyke said in his dissent.<\/p>\n<p class=\"wp-block-paragraph\">The Supreme Court will return to holding closed-door conferences to weigh which cases to take up beginning on Sept. 28, and the high court\u2019s next term will begin on Oct. 5, with oral arguments in a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4675555\/supreme-court-next-term-cases-climate-immigration\/\" data-type=\"link\" data-id=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4675555\/supreme-court-next-term-cases-climate-immigration\/\">key climate change case<\/a>. A decision on whether the Supreme Court will hear arguments in the case <em>Olympus Spa v.
