Miller filed the emergency CPO in february, alleging harassment by Moreno, who has accused him of abusing her and their 2-year-old daughter-charges he denies. During a court appearance, Miller assured the judge he would attend all hearings but cited his legislative duties and the political climate as reasons for potential absences. <\/p>\n<p>Miller has refused to withdraw from his reelection campaign despite losing support from colleagues amid a custody battle that has gained national attention. He released personal files, including a nude photo of his daughter, in his defense, prompting moreno to file a lawsuit against him for recklessly sharing the image. A nude photo of their young daughter was included in those photos, and Emily Moreno on Wednesday<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4685548\/emily-moreno-max-miller-nude-photo-daughter\/\" data-type=\"link\" data-id=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4685548\/emily-moreno-max-miller-nude-photo-daughter\/\"> filed a lawsuit against Miller<\/a>, alleging he \u201crecklessly and intentionally\u201d authorized the photo\u2019s release.<\/p>\n<p class=\"wp-block-paragraph\">Miller has been accused by Emily Moreno of throwing hot water from a skillet at her body, holding a gun to her head, and fracturing their daughter\u2019s collarbone. When requesting the emergency order, Miller said he had \u201csubstantial evidence\u201d that Emily Moreno had put him in danger, but his lawyers later retracted those claims.<\/p>\n<p class=\"wp-block-paragraph\">Miller filed for divorce in August 2024.
