The DOJ argues that states cannot offer such benefits based solely on residency to individuals who are not lawfully present in the U.S., and challenges laws that allow illegal immigrants to access in-state tuition and associated benefits. These legal actions are part of a broader effort, with the DOJ having already sued 17 states over similar policies, and additional lawsuits pending against several others. The department emphasizes that these policies undermine legal and constitutional principles, asserting that they grant illegal immigrants benefits denied to U.S. citizens. Some past cases have resulted in successful rulings against states offering reduced tuition to illegal immigrants.

The Justice Department on Monday sued New York, Connecticut, and Vermont, alleging that the states unlawfully provide in-state tuition rates and other financial benefits to illegal immigrants.

The lawsuits seek to block enforcement of state laws, regulations, and policies that allow immigrants who are not lawfully present in the United States to receive in-state tuition rates at public colleges and universities based on their state residency.
