However, the 2025 change <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/in_focus\/4074769\/inside-hemp-industry-impending-ban\/\">shifted the language to set the legal limit at<\/a> 0.4 mg of total hemp-derived THC per container, which, when it goes into effect on Nov. 12, would wipe out nearly all hemp products on the market.<\/p>\n<p class=\"wp-block-paragraph\">However, after the 2025 language was put into place by Congress and signed into law by President <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\" data-type=\"post_tag\" data-id=\"4\">Donald Trump<\/a>, the Trump administration shifted its relationship with the hemp industry and cannabis sativa products. Trump signed an executive order <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/white-house\/3926048\/trump-exeuctive-order-medical-marijuana-restricting-products\/\">rescheduling marijuana<\/a> as he touted the benefits of CBD in December 2025, while Oz unveiled a new CMS pilot program on CBD.<\/p>\n<p class=\"wp-block-paragraph\">Oz\u2019s pilot program allows eligible Medicare beneficiaries at participating healthcare providers to purchase $500 worth of\u00a0hemp-derived products\u00a0annually for medical purposes. That program, called the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/healthcare\/4510521\/what-to-know-medicare-hemp-pilot-program-challenge-court\/\">Substance Access Beneficiary Engagement Incentive<\/a>, uses the 2018 Farm Bill language to define hemp.
