The Supreme Court&#8217;s decision declared existing executive and legislative interpretations unconstitutional, but the orders emphasize that these branches retain the authority to interpret the Constitution independently.The orders reaffirm that U.S. citizenship is a valuable inheritance and clarify that certain categories of children-for example, those born to alien enemies, foreign diplomats, or in territories where citizenship isn&#8217;t automatically granted-are ineligible for citizenship. they also target the birth tourism industry, which facilitates foreigners traveling to the U.S. to have babies for citizenship benefits by exposing deceptive practices and proposing measures to deny entry or deport those involved. Notably, the orders aim to prevent authorities from granting citizenship to children born to invaders, terrorists, or foreign officials, and they seek to curb abuse by birth tourism operators, especially in areas like the Northern Mariana Islands, where Chinese nationals often give birth in large numbers to gain American citizenship for their children.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>President Donald Trump signed two new executive orders to help rein in the birthplace citizenship crisis Thursday in the wake of a Supreme Court ruling that read automatic U.S. citizenship for illegal aliens into the Constitution.<\/p>\n<p>The Supreme Court <a href=\"https:\/\/thefederalist.com\/2026\/06\/30\/grotesque-results-of-birth-tourism-allow-foreign-invaders-to-seize-control-of-u-s-from-the-inside\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> in June that any random foreigner has the right to American citizenship simply by being born in the country. That decision declared unconstitutional a day-one executive order from Trump correctly interpreting the 14th Amendment to stop the practice. Notably, both the executive and legislative branches <a href=\"https:\/\/thefederalist.com\/2026\/07\/29\/white-house-congress-need-to-assert-their-dominance-over-supreme-court-on-birthplace-citizenship\/\" target=\"_blank\" rel=\"noreferrer noopener\">are<\/a> constitutional entities with their own responsibilities to interpret the Constitution. The president is not required to follow unconstitutional edicts from the Supreme Court, but the orders are structured to maintain consistency with the court\u2019s <em>Barbara <\/em>ruling.<\/p>\n<p>\u201cUnited States citizenship is among the greatest inheritances the Nation can bestow,\u201d one of the orders <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2026\/08\/ending-birth-tourism\/\" target=\"_blank\" rel=\"noreferrer noopener\">states<\/a>. \u201cIt embodies a sacred bond between the American people and the Nation in which they live, and carries profound rights, privileges, and responsibilities reflective of the enduring allegiance of citizens to the United States and our Constitution.\u201d<\/p>\n<p>The first order, \u201c<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2026\/08\/continuing-to-protect-the-meaning-and-value-of-american-citizenship\/\" target=\"_blank\" rel=\"noreferrer noopener\">Continuing to Protect the Meaning and Value of American Citizenship<\/a>,\u201d clarifies situations the president does not believe are covered by the high court\u2019s ruling, including cases of children born to an \u201calien enemy,\u201d such as the children of terrorists, namely those found to be members of a Foreign Terrorist Organization or Specially Designated Global Terrorist.<\/p>\n<p>It is unclear how large that class is, but the order addressing alien enemies eems to signal a move toward a much more effective way to designate that a child does not obtain American citizenship: declaring ineligible children being born to noncitizens deemed to be invaders.<\/p>\n<p>As the Federalist <a href=\"https:\/\/thefederalist.com\/2026\/07\/29\/white-house-congress-need-to-assert-their-dominance-over-supreme-court-on-birthplace-citizenship\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, not only did the Supreme Court\u2019s <em>Barbara <\/em>decision not address the question of children born to invaders, the court does not have the jurisdiction to <a href=\"https:\/\/amzn.to\/3YuVZYV\" >block executive branch action repelling<\/a> an invasion. As Iowa Solicitor General Eric Wesson noted, Trump and Gov. Greg Abbott, R-Texas, have both declared an invasion at the southern border, which took place under the Biden administration and prior. Given that reality, those who flooded in and had children \u2014 anchor babies \u2014 acted as invaders and would have no right to citizenship for themselves or their children.<\/p>\n<p>The new order also clarifies that the children of foreign government employees, like ambassadors and embassy workers, are not entitled to birthplace citizenship. Some diplomats have reportedly been <a href=\"https:\/\/thefederalist.com\/2026\/07\/29\/white-house-congress-need-to-assert-their-dominance-over-supreme-court-on-birthplace-citizenship\/\" target=\"_blank\" rel=\"noreferrer noopener\">obtaining<\/a> citizenship for their children while they are posted to the United States.<\/p>\n<p>Anyone engaged in a commercial enterprise to obtain American citizenship is also banned from being afforded the privilege, as is \u201cthe person \u2026 born in a territory or territorial waters of the United States where citizenship is not conferred by Federal statute.\u201d American Samoa is the only territory in which children born to noncitizens are not <a href=\"https:\/\/www.lawfaremedia.org\/article\/constitutional-citizenship-us-territories\" target=\"_blank\" rel=\"noreferrer noopener\">conferred<\/a> automatic U.S. citizenship.<\/p>\n<p>The second order, \u201c<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2026\/08\/ending-birth-tourism\/\" target=\"_blank\" rel=\"noreferrer noopener\">Ending Birth Tourism<\/a>,\u201d goes into more detail about the birth tourism industry.<\/p>\n<p>\u201cCitizenship is not a commodity to be acquired through calculated exploitation and evasion of the immigration laws, such as by entering the United States on a nonimmigrant visa for the purpose of giving birth within the Nation\u2019s borders,\u201d it states. \u201cBirth tourism operators use deceptive advertisements and inducements to entice foreign nationals to travel to the United States for the purpose of giving birth on American soil. They promise citizenship; access to public benefits; and short-term stays in specialized facilities, hotels, or rentals, but often fail to deliver on these promises. These operators coach their clients to misrepresent the purpose and duration of their travel to consular and border officials to obtain visas authorizing entry into the United States.\u201d<\/p>\n<p>One <a href=\"https:\/\/tiffany.house.gov\/media\/editorials-letters-and-articles\/china-linked-birth-tourism-under-scrutiny-gop-lawmakers-press\" target=\"_blank\" rel=\"noreferrer noopener\">major hub<\/a> for birth tourism is the Northern Mariana Islands, a U.S. territory close to China where there are <a href=\"https:\/\/thefederalist.com\/2026\/07\/29\/white-house-congress-need-to-assert-their-dominance-over-supreme-court-on-birthplace-citizenship\/\" target=\"_blank\" rel=\"noreferrer noopener\">currently<\/a> more births to Chinese nationals \u2014 all of whom obtain U.S. citizenship \u2014 than Americans. Those new \u201cAmerican citizens\u201d then return to China and are raised there, but are fully free to come back to the U.S. as an adult and full-fledged citizen.<\/p>\n<p>The order seeks to stop that practice, but also has a retroactive clause that would require the \u201cdenial of entry to, or removal of, any alien who previously engaged or plans to engage in birth tourism.\u201d<\/p>\n<hr>\n<p>      Breccan F.
