During his July 15 confirmation hearing, Blanche said he would \u201ccarefully evaluate every lawful action available to ensure the faithful enforcement of the Comstock Act.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The letter was organized by Advancing American Freedom, an organization founded by former Vice President <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/mike-pence\/\">Mike Pence<\/a>. Signatories include SBA Pro-Life America, Students for Life of America, Americans United for Life, Concerned Women for America, the Human Coalition, and the Ethics and Religious Liberty Commission.<\/p>\n<p class=\"wp-block-paragraph\">The groups\u2019 notice to the acting attorney general follows a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.politico.com\/news\/2026\/08\/03\/blanche-pledged-abortion-pill-crackdown-private-call-01023304\">report<\/a> on Tuesday from <em>Politico <\/em>about a leaked recording of Blanche\u2019s discussion with religious faith leaders last week, which has <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.youtube.com\/watch?v=GSgPBOlRyuU\">since been deleted<\/a>, while certain clips remain on social media. In it, he discussed making \u201cthe <em>Dobbs <\/em>decision permanent in every single state,\u201d referencing the 2022 <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/Supreme-Court\/\">Supreme Court<\/a> ruling that returned abortion policy to elected officials and the states by overturning <em>Roe v. Wade<\/em>.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The Biden-era DOJ opinion addressed the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.congress.gov\/42\/llsb\/S.1572v3.pdf\">Comstock Act<\/a>, a 19th-century anti-obscenity law that bars mailing an \u201carticle or thing designed, adapted, or intended for producing abortion.\u201d Under former Attorney General Merrick Garland, the department reasoned that the drugs have lawful uses in every state, including miscarriage treatment, and that a sender, therefore, cannot necessarily know they will be used illegally.<\/p>\n<p class=\"wp-block-paragraph\">But the coalition\u2019s letter argued that interpretation adds an intent requirement not found in the law, and thereby renders it practically unenforceable.<\/p>\n<p class=\"wp-block-paragraph\">\u201cA sender\u2019s subjective intent and a recipient\u2019s intended use are unknowable, making the Comstock Act a dead letter,\u201d the groups wrote.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-3\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-3\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The <em>Dobbs<\/em> decision unleashed a patchwork of state abortion laws and intensified disputes over abortion pills prescribed online and mailed across state lines. In June, the Food and Drug Administration <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/healthcare\/4596644\/fda-mifepristone-study-pressure-trump-right-flank\/\">began its latest safety study<\/a> and data review regarding mifepristone distribution and usage. Current federal rules allowing telehealth prescribing remain in effect. <\/p>\n<p class=\"wp-block-paragraph\">Pressure on the FDA to be its reexamination hit a fever pitch after the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/section\/supreme-court\/\">Supreme Court<\/a> in may left in place the<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/op-eds\/4587564\/mail-order-mifepristone-abortion-pill-midterm-elections\/\"> current rules <\/a>governing abortion-pill access while <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/louisiana\/\">Louisiana\u2019s <\/a>challenge to the agency\u2019s mifepristone regulations continued in lower courts.<\/p>\n<p class=\"wp-block-paragraph\">Since then, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/sbaprolife.org\/newsroom\/press-releases\/80-pro-life-groups-leaders-sign-letter-urging-acting-ag-blanche-to-resolve-abortion-drug-lawsuit-immediately\">more than 80 anti-abortion groups<\/a> have called on Blanche to the lawsuit <em>Louisiana v.
