The hospital previously announced a settlement with the Department of Justice and the Texas Attorney General\u2019s Office, but the final agreement, now signed, reveals serious misconduct. According to court documents, TCH and its doctors committed Medicaid fraud by billing for gender-related treatments under false diagnoses, effectively obscuring procedures with dishonest billing codes to receive Medicaid payments. <\/p>\n<p>As part of the settlement, TCH has agreed to cease all sex-rejecting procedures, terminate the privileges of involved doctors, and establish compliance measures to prevent recurrence. The hospital also committed to opening a clinic within 90 days to provide medical care tailored to children who have undergone gender-related surgeries. Financial penalties include paying over $8.5 million to the state of texas and additional compensation to whistleblower Vanessa Sivadge,a former nurse who reported the misconduct. Texas Attorney General ken Paxton emphasized that the settlement underscores a crackdown on claims that prioritize ideology over children&#8217;s health.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The legacy media are carefully avoiding this point, but Texas Children\u2019s Hospital (TCH) has just formally admitted to deceitful and potentially fraudulent behavior during the years they <a href=\"https:\/\/amzn.to\/3YuVZYV\" >spent providing illegal sex-rejecting medical procedures<\/a> to children. They lied, repeatedly and aggressively, and they\u2019ve been forced to say so. <\/p>\n<p>As The Federalist <a href=\"https:\/\/thefederalist.com\/2026\/06\/12\/the-texas-childrens-hospital-trans-kids-settlement-hasnt-happened-yet\/\" target=\"_blank\" rel=\"noreferrer noopener\">previously reported<\/a>, the announcement in May of a settlement between TCH and both the Department of Justice and the Texas Attorney General\u2019s Office was premature. The agreement in May was an agreement in principle on a set of topics that still required negotiation to produce a signed and executed agreement. <\/p>\n<p>That final settlement agreement has now been signed and released, and it\u2019s damning. As a <a href=\"https:\/\/burkegroup.law\/wp-content\/uploads\/2026\/07\/Sivadge-Disclosure-Statement.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">summary<\/a> filed in federal court reads, \u201cThis case concerns fraud on Medicaid. Texas Children\u2019s Hospital and doctors there provided \u2018gender-affirming care\u2019 to patients in violation of Texas\u2019s Medicaid program requirements and by attributing treatments to false diagnoses. Those patients were primarily part of Texas Children\u2019s Health Plan, a Medicaid managed care organization, which knowingly or recklessly failed to stop the fraud. These entities and the doctors who committed the fraud violated the False Claims Act and the Texas Medicaid Fraud Prevention Act.\u201d<\/p>\n<p>You can read the complaint and settlement agreements in the case <a href=\"https:\/\/burkegroup.law\/news\/burke-law-group-secures-landmark-false-claims-act-settlement-and-sets-national-precedent\/\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a> (scroll down for the list of documents), in an announcement from the Burke Law Group, which represented former TCH nurse Vanessa Sivadge in a whistleblower lawsuit.<\/p>\n<p>Coverage in publications like the Houston Chronicle <a href=\"https:\/\/archive.is\/9ACsn\" target=\"_blank\" rel=\"noreferrer noopener\">say<\/a> only that TCH has agreed to stop providing transgender procedures, and then they fudge the rest with sentences like this: \u201cThe probe into the hospital was then expanded in 2024 after a nurse alleged the hospital was obscuring its care for transgender youth by intentionally miscoding patients\u2019 treatments in order to receive Medicaid payments.\u201d<\/p>\n<p>But this is no longer an allegation. By signing the settlement agreement, TCH has agreed to a description that says it obscured transgender procedures with dishonest billing codes:<\/p>\n<figure><figcaption>\n<div>\n<p>         <span>Image Credit<\/span>Screenshot       <\/p>\n<\/div>\n<\/figcaption><\/figure>\n<p>To pay for transgender procedures for children, TCH and its providers pretended that those children had illnesses that they didn\u2019t have. Then they billed insurance for the treatment of the fake illnesses.<\/p>\n<p>Under the terms of the settlement, TCH agrees to the \u201cPermanent Cessation of Sex-Rejecting Procedures,\u201d and to \u201cirrevocably terminate\u201d the appointments and clinical privileges of a list of doctors who participated in those procedures. The hospital has also agreed to implement a long series of administrative and compliance procedures that will assure no recurrence of sex-rejecting procedures, including the creation of \u201ca compliance and ethics program.\u201d<\/p>\n<p>Agreeing to open a destransition clinic to provide medical treatment to children mutilated by sex-rejecting procedures, TCH has committed to opening that clinic within 90 days.<\/p>\n<p>Finally, the hospital will pay $8,576,000 to the State of Texas, and an additional $1,715,200 to Sivadge, the former TCH nurse, while also making a separate payment in an undisclosed amount for her attorneys\u2019 fees and legal costs. Those costs will likely mean very little to a hospital that <a href=\"https:\/\/projects.propublica.org\/nonprofits\/organizations\/741100555\/202502269349301555\/full\" target=\"_blank\" rel=\"noreferrer noopener\">reports<\/a> annual revenue of a little over $3.8 billion, with total assets near $8.5 billion.<\/p>\n<p>\u201cThis settlement sends an unmistakable message: if you put radical ideology over children\u2019s health, my office will go after you,\u201d Texas Attorney General Ken Paxton <a href=\"https:\/\/www.texasattorneygeneral.gov\/news\/releases\/attorney-general-paxton-finalizes-historic-settlement-texas-childrens-hospital-creating-first-ever\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> in a statement released by his office.<\/p>\n<hr>\n<p>      Chris Bray is a senior correspondent at The Federalist and a former infantry sergeant in the U.S. Army.
