Selections, argued that the federal court should certify a class out of \u201can abundance of caution\u201d to ensure that businesses do not have to file their own lawsuits to get their full <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/tariffs\/\" data-type=\"post_tag\" data-id=\"584\">tariff<\/a> refunds, adding that it would streamline the process and avoid thousands of small business from having to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/victims-of-florida-condo-collapse-reach-1-billion-settlement\/\" title=\"Victims of Florida Condo Collapse Reach  Billion Settlement\">file individual claims<\/a> and pay the court\u2019s filing fee.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-1\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-1\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-15\" data-wex-ad=\"art-dsk-inart-1\"><\/div>\n<\/div>\n<\/div>\n<div class=\"article-paywall\">\n<p class=\"wp-block-paragraph\">\u201cRather than doing that, the court can certify a class and issue a single class-wide injunction that just says you need to reliquidate the entries with IEEPA tariffs across the board,\u201d Sinzdak told the judge. \u201cWe are not aware of any law that prevents a reliquidation order from being on a class-wide basis, and it would certainly accomplish all of the fundamental goals of class actions, which is judicial efficiency and fairness.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cBecause again, rather than having courts and litigants be burdened with loads and loads and loads of different suits and this whole detailed process with envelopes floating back and forth and everything to that, you just have a single order that says for all plaintiffs in this class, the entries with IEEPA tariffs must be reliquidated,\u201d she added.<\/p>\n<p class=\"wp-block-paragraph\">Justice Department lawyers argued to the court that the request to approve a class action came too late in the process, but suggested other ways to ensure that small businesses receive their refunds, including waiving the court\u2019s filing fee or creating a template complaint for International Emergency Economic Powers Act tariff claims.
