U.S. district Judge Ana Reyes stated that her previous February ruling was invalidated following the Supreme Court\u2019s 6-3 decision allowing the administration to proceed with ending TPS for Haiti, which affects about 350,000 Haitians in the U.S. Despite the court ruling,efforts to challenge the termination continue,with attorneys asserting that their constitutional claims remain active and litigation will proceed. The Supreme Court\u2019s decision was based on statutory limitations that exclude judicial review of such administrative determinations. The case has been sent back to lower courts for further proceedings,marking the first official acknowledgment by Judge Reyes that her earlier order had been voided. data-type=\"post_tag\" data-id=\"339\">Trump administration<\/a> from ending temporary protected status for <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/haiti\/\" data-type=\"post_tag\" data-id=\"2784\">Haiti<\/a> was no longer in effect, more than a month after the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/section\/supreme-court\/\" data-type=\"link\" data-id=\"https:\/\/www.washingtonexaminer.com\/section\/supreme-court\/\">Supreme Court<\/a> allowed the administration to move forward with doing so.<\/p>\n<p class=\"wp-block-paragraph\">U.S. District Judge Ana Reyes, an appointee of former President Joe Biden, said in an <a counsel for the Haitians who sued over the administration\u2019s decision to terminate TPS, called Wednesday a \u201cbad day for America and a devastating day for our clients.\u201d<\/p>\n<div Although the Supreme Court ruled against our clients, it did not foreclose all avenues to relief. Plaintiffs\u2019 constitutional claim remains live,\u201d Pipoly said in a statement, asserting that they will continue litigation despite TPS being allowed to end.<\/p>\n<p class=\"wp-block-paragraph\">\u201cWe intend to litigate the discovery issues in this case, obtain further discovery, and assess whether the facts support relief on our constitutional claim. For the moment, Haitian TPS holders find themselves in essentially the same position that Venezuelan TPS holders did in the summer and fall of 2025:\u00a0the termination is in effect while the case continues to be litigated,\u201d Pipoly added.<\/p>\n<p class=\"wp-block-paragraph\">The Supreme Court issued its <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4604161\/supreme-court-allows-trump-end-tps-haiti-syria\/\" data-type=\"link\" data-id=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4604161\/supreme-court-allows-trump-end-tps-haiti-syria\/\">6-3 ruling<\/a> in <em>Trump v. Miot<\/em> on June 25, allowing the Trump administration to end TPS for Haiti and Syria, but also clearing the way for officials to end TPS for any country without worrying about judicial review of the administration\u2019s decision.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cThe TPS statute plainly bars consideration of respondents\u2019 non-constitutional claims,\u201d Alito said. \u201cIt allows \u2018no judicial review of any determination \u2026 with respect to the \u2026 termination\u2019 of a TPS designation. The term \u2018determination\u2019 can be used to describe either an individual decision or the whole process leading to a final decision, and under either understanding of the term, \u00a71254a(b)(5)(A) squarely bars all of respondents\u2019 non-constitutional claims.\u201d<\/p>\n<p class=\"wp-block-paragraph\"><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4675555\/supreme-court-next-term-cases-climate-immigration\/\" data-type=\"link\" data-id=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/4675555\/supreme-court-next-term-cases-climate-immigration\/\">SUPREME COURT TO OPEN NEXT TERM WITH MAJOR CLIMATE CHANGE CASE<\/a><\/strong><\/p>\n<p class=\"wp-block-paragraph\">As is customary, the Supreme Court issued its judgment 32 days after its ruling was released, sending the case back to the U.S. Court of Appeals for the D.C. Circuit, which then remanded the case back to the U.S. District Court for the District of Columbia and Reyes to continue or conclude the case consistent with the high court\u2019s ruling.
