But there are also a bunch of quiet maneuvers you don\u2019t see, producing change through obscure bureaucratic procedures. <\/p>\n<p>To begin your introduction to one of those little-noticed avenues of change, take a moment to read the Independent Medical Review (IMR) obtained by California health care regulators in 2025 on behalf of a biological male (in the record, a \u201ctransgender female\u201d) who wanted his health insurance company to buy him a prosthetic \u201cvagina\u201d:<\/p>\n<figure><figcaption>\n<div>\n<p>         <span>Image Credit<\/span>Screenshot       <\/p>\n<\/div>\n<\/figcaption><\/figure>\n<p>The transgender patient had a history of depression, \u201cwith possible psychotic features,\u201d and was <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/lake-forest-man-convicted-of-killing-stepmom-with-pick-axe-a-decade-ago\/\" title=\"Lake Forest Man Convicted of Killing Stepmom with Pick Axe a Decade Ago\">taking anti-psychotic medication<\/a> when his insurer denied coverage for a surgically created artificial vagina. (Surgical neo-vaginas are created by <a href=\"https:\/\/www.mtfsurgery.net\/mtf-vaginoplasty.htm\" target=\"_blank\" rel=\"noreferrer noopener\">penile inversion<\/a>, or less frequently by cutting out <a href=\"https:\/\/www.stilleraesthetics.com\/our-services\/colovaginoplasty\" target=\"_blank\" rel=\"noreferrer noopener\">a piece of the patient\u2019s bowels<\/a> and sewing it into a surgical hole between his legs.) <\/p>\n<p>Appealing that decision, the potentially psychotic patient asked the <a href=\"https:\/\/www.dmhc.ca.gov\/AboutUs.aspx\" target=\"_blank\" rel=\"noreferrer noopener\">California Department of Managed Health Care<\/a> (DMHC), which regulates health insurance plans, to conduct a review in which an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/novak-djokovic-to-defend-australian-open-title-after-being-granted-medical-exemption-from-vaccine\/\" title=\"Novak Djokovic To Defend Australian Open Title After Being Granted ... Exemption From Vaccine\">independent medical expert<\/a> would decide if his surgery was medically necessary.<\/p>\n<p>A finding on an IMR is binding. Insurers <em>must<\/em> cover procedures an \u201cindependent expert\u201d finds \u201cmedically necessary.\u201d As the state\u2019s <a href=\"https:\/\/www.dmhc.ca.gov\/Portals\/0\/Docs\/HC\/AccessibleIMRFormEnglish.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">IMR request form<\/a> says: \u201cHealth plans must follow the IMR decision and promptly provide the service.\u201d<\/p>\n<p>In this case, a psychiatrist reviewed the patient\u2019s surgical request, with no review by a surgeon. The psychiatrist overturned the insurer\u2019s refusal to pay. A male on anti-psychotic medications got a surgically implanted fake vagina, in a procedure covered by insurance, because a psychiatrist found the surgery to be medically necessary.<\/p>\n<p>You can see these medical reviews for yourself. The DMHC maintains a <a href=\"https:\/\/wpso.dmhc.ca.gov\/imr\/\" target=\"_blank\" rel=\"noreferrer noopener\">searchable public database<\/a> of IMR outcomes. Try searching with different terms to see how the results vary, like \u201cdysphoria,\u201d \u201cgender identity,\u201d and \u201ctransgender.\u201d The results will look like this screenshot, and on the DMHC page you can click the plus sign on the left to read the details of each case:<\/p>\n<figure><figcaption>\n<div>\n<p>Screenshot<\/p>\n<div>\n<p>         <span>Image Credit<\/span>Screenshot       <\/p>\n<\/div>\n<\/div>\n<\/figcaption><\/figure>\n<p>In the single \u201cupheld\u201d decision above, with the case number ending in 46638, a patient sought \u201cfacial feminization surgery\u201d and a hair transplant (\u201cfollicular unit transplantation\u201d) to be performed at the same time.<\/p>\n<p>The second reviewer in the case, a plastic surgeon, warned that doing both procedures during the same treatment session would require\u00a0\u201cboth prone and supine positioning, which would unnecessarily prolong general anesthesia\u2026but the technical concerns described above would not apply if the procedures were staged separately.\u201d No concerns are noted from the first reviewer, a psychiatrist.<\/p>\n<p>A biological male identifying as a transgender woman can get hair transplants through health insurance, because they\u2019re cosmetic for a man but supposedly become medically necessary for a man who identifies as a woman, as long as the procedure isn\u2019t combined with others. And insurers must cover medically necessary procedures.<\/p>\n<p><a href=\"https:\/\/www.linkedin.com\/in\/rchiea\/\" target=\"_blank\" rel=\"noreferrer noopener\">Renee Chiea<\/a> has worked in both of the worlds where these decisions are contested. A former DMHC employee, she left for a private health insurance company in 2011. In the first years she worked for an insurance company in California, she told The Federalist, insurers were almost entirely \u201cdenying everything\u201d that transgender patients sought in order to change their appearance, rejecting those procedures as cosmetic and elective.<\/p>\n<p>But state officials, Chiea says, wanted those procedures to be covered. Rather than serving as ideologically neutral regulators, she told The Federalist, they were \u201cabsolutely pushing the trans agenda 100 percent.\u201d\u00a0The IMR was one of their tools for forcing change.<\/p>\n<p>\u201cIn the early days,\u201d Chiea says, \u201cthere were a lot of discussions about boob jobs.\u201d\u00a0Men taking female hormones grow breasts, supposedly affirming their new identity as women, but trans patients were demanding bigger breasts. An absurd discussion took place inside health insurance companies: Is it <em>medically necessary<\/em> for a \u201ctrans woman\u201d with a B-cup to receive D-cup breasts?<\/p>\n<p>Other cosmetic procedures were repackaged as \u201cgender-affirming.\u201d Liposuction became a part of transgender \u201cbody contour surgery,\u201d a \u201cmedically necessary\u201d reconstructive procedure.<\/p>\n<p>The process appears to have changed over time. Initially, Chiea says, DMHC asked surgeons alone to conduct IMRs for surgical procedures. Over time, though, Chiea saw more and more transgender IMRs being conducted by psychiatrists. <\/p>\n<p>Surgical decisions were more likely to be made by mental health practitioners. Records appear to support the claim, as the importance of psychiatrists in transgender IMRs is easy to see in the outcome reports listed on the state website.<\/p>\n<p>As Chiea saw it from her position inside a health insurance company, IMRs for transgender patients conducted by psychiatrists became easier for patients to win and insurers to lose. Then the insurers became more likely to just approve coverage of transgender medical procedures, knowing that the IMR process was likely to go poorly for them. At least in part, a cultural change \u2013 the increasing prevalence of transgender identity that\u2019s socially affirmed by medical and surgical procedures \u2013 happened in and through a little-noticed bureaucratic procedure.<\/p>\n<p>As part of the background behind changes in the IMR, you can see what California regulators were thinking about transgender medical procedures by reading their \u201cAll-Plan Letters,\u201d or APLs. To use just one of several available examples: <a href=\"https:\/\/www.dhcs.ca.gov\/wp-content\/uploads\/2025\/10\/APL16-013.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">APL 16-013<\/a>, dated October 6, 2016, directs all managed care health plans (MCPs) to use nationally recognized medical standards to determine what transgender procedures to cover. The letter offers a single example to illustrate the point: the <a href=\"https:\/\/wpath.org\/publications\/soc8\/\" target=\"_blank\" rel=\"noreferrer noopener\">standards of care<\/a> established by the <a href=\"https:\/\/wpath.org\/about\/mission-and-vision\/\" target=\"_blank\" rel=\"noreferrer noopener\">activist pro-trans organization<\/a> WPATH.<\/p>\n<p>As the letter adds, \u201cNationally recognized medical experts in the field of transgender health care have identified the following core services in treating gender dysphoria: behavioral health services; psychotherapy; hormone therapy; and a variety of surgical procedures that bring primary and secondary gender characteristics into conformity with the individual\u2019s identified gender.\u201d<\/p>\n<p>Chiea describes the imposition of standards by regulators applying WPATH guidance as \u201csub-regulatory pressure,\u201d not imposed through law or a <a href=\"https:\/\/amzn.to\/3YuVZYV\" >formal administrative rules-making process<\/a> but rather through bureaucratic wishcasting: Everybody has to do what WPATH says, because we sent you a letter that says we want you to.<\/p>\n<p>Not surprisingly, state regulators dispute Chiea\u2019s description. Kevin Durawa, a senior media officer at DMHC, told The Federalist that the IMR process simply meets a federal requirement: \u201cStates are required by federal law to have an independent external review process of health plan denials and California meets this requirement through the Independent Medical Review (IMR) program.\u201d<\/p>\n<p>Durawa also sent these search results to dispute the claim that the IMR process is rigged to favor transgender patients, although Chiea noted that the use of a ten-year time span makes it impossible to assess change over time using these numbers:<\/p>\n<figure><figcaption>\n<div>\n<p>         <span>Image Credit<\/span>Screenshot       <\/p>\n<\/div>\n<\/figcaption><\/figure>\n<p>In any case, the statistics provided to The Federalist by California regulators show that a considerable majority of insurer decisions to deny coverage for transgender medical procedures have been overturned through the IMR process.<\/p>\n<p>Similarly disputing Chiea\u2019s description, a psychiatrist who has participated in significant numbers of IMRs for transgender patients in California says he has become <em>more<\/em> likely to uphold insurance company denials over time as those companies have become more careful about applying California-compliant standards to their decisions. Upheld insurance denials, <a href=\"https:\/\/www.dankarasic.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Dr. Dan Karasic<\/a> told The Federalist, \u201cnow make up a large share of my reviews.\u201d<\/p>\n<p>Although he\u2019s been <a href=\"https:\/\/alliancehealthproject.ucsf.edu\/blog\/activist-psychiatrist-dan-karasic-md-retiring\" target=\"_blank\" rel=\"noreferrer noopener\">praised as an activist<\/a>, Karasic rejects that description. \u201cJust because I believe that appropriate transgender care can be beneficial, does not mean that I am unable to use my expertise to determine whether criteria of medical necessity have been met,\u201d Karasic told The Federalist. \u201cAny determination must be supported by a literature review and citations. My reviews are overseen by an independent company and its medical director.\u201d<\/p>\n<p>In California today, a transgendered surgical patient has a new \u201cvagina\u201d to go with a prescription for anti-psychotic medications.
