He has expressed transgender ideation in court documents shortly before sentencing.<\/p>\n<p>The Biden administration has launched a comprehensive program providing taxpayer-funded transgender surgeries within federal prisons, a shift from the previous Trump administration\u2019s ban on such procedures. While Trump\u2019s executive order aimed to prohibit transgender medical interventions in federal prisons, a court injunction temporarily blocked its enforcement, leading the BOP to implement policies limiting surgeries and hormone therapies. The status of Roske\u2019s treatments remains unclear due to ongoing legal restrictions and confidentiality protocols.<\/p>\n<p>Roske\u2019s placement at FMC Fort Worth bypassed the recommended prison in Los Angeles based on the 500-mile policy, which considers proximity to inmates\u2019 release residences and medical needs. his sentence is currently under appeal, and there are impeachment efforts against Judge Boardman related to her sentencing decision.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Nicholas Roske, the would-be assassin of Supreme Court Justice Brett Kavanaugh who now identifies as a woman, has been assigned to Federal Medical Center (FMC) Fort Worth, a detention center the Biden administration turned into a <a href=\"https:\/\/dallasexpress.com\/national\/taxpayers-funding-trans-surgeries-for-fort-worth-prisoners\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u201ctransgender\u201d medical intervention facility<\/a>, offering inmates taxpayer-funded \u201cgender reassignment\u201d surgeries.<\/p>\n<p>Judge Deborah Boardman, a Biden appointee, <a href=\"https:\/\/thefederalist.com\/2025\/10\/04\/biden-judge-gives-would-be-kavanaugh-assassin-light-sentence-as-left-wing-violence-skyrockets\/\" target=\"_blank\" rel=\"noreferrer noopener\">shirked the federal guidelines<\/a> for sentencing Roske, who now goes by \u201cSophie.\u201d Those recommend 30 years to life in prison. Instead, Boardman gave him only eight years.<\/p>\n<p>Boardman persistently referred to Roske, a male, with female pronouns. She added, \u201cI take into consideration the conditions of pre-trial confinement and the fact that she [sic] is a transgender woman and will be sent to a male-only [Bureau of Prisons] facility.\u201d<\/p>\n<p>FMC Fort Worth is a male-only <a href=\"https:\/\/dallasexpress.com\/national\/taxpayers-funding-trans-surgeries-for-fort-worth-prisoners\/\" target=\"_blank\" rel=\"noreferrer noopener\">facility<\/a>. Its sister facility for females, FMC Carswell, is also in the Fort Worth, Texas, area.<\/p>\n<p>FMC Fort Worth is designed to care for inmates with \u201ccomplex medical considerations,\u201d a Biden administration spokeswoman for the Federal Bureau of Prisons (BOP) <a href=\"https:\/\/dallasexpress.com\/national\/taxpayers-funding-trans-surgeries-for-fort-worth-prisoners\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>. It is a Care Level 4 facility. The BOP defines that as involving conditions in which an inmate is \u201cseverely impaired and may require daily nursing care. Examples of such conditions are those with cancer in active treatment, dialysis, quadriplegia, stroke or head injury patients, major surgical patients, acute psychiatric illness requiring inpatient treatment, and high-risk pregnancy.\u201d<\/p>\n<p>Roske has filed <a href=\"https:\/\/www.courtlistener.com\/docket\/63392380\/106\/19\/united-states-v-roske\/\" target=\"_blank\" rel=\"noreferrer noopener\">letters<\/a> to the court discussing his transgender ideation, and the BOP <a href=\"https:\/\/www.bop.gov\/policy\/progstat\/5260_001.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">considers<\/a> his identification as \u201ctransgender\u201d a \u201cpsychiatric condition.\u201d He is also about 30 years old, and only started identifying as female in September 2025, as far as <a href=\"https:\/\/www.courtlistener.com\/docket\/63392380\/106\/united-states-v-roske\/\" target=\"_blank\" rel=\"noreferrer noopener\">court documents<\/a> show, about a month before he was sentenced.<\/p>\n<p>FMCs Fort Worth and Carswell were the male and female prisons where the Biden administration <a href=\"https:\/\/dallasexpress.com\/national\/taxpayers-funding-trans-surgeries-for-fort-worth-prisoners\/\" target=\"_blank\" rel=\"noreferrer noopener\">launched<\/a> a comprehensive, taxpayer-funded transgender surgery program for convicted criminals.<\/p>\n<p>\u201cThe Federal Bureau of Prisons is pursuing a contract for gender-affirming surgery in Texas, as the Dallas-Fort Worth area is home to both male and female Federal Medical Centers,\u201d a Biden administration spokeswoman told The Dallas Express in 2024. \u201cThis will allow us to provide specialized and comprehensive care at a facility already equipped to care for individuals with complex medical considerations.\u201d<\/p>\n<p>When President Donald Trump took office, he signed an <a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/01\/30\/2025-02090\/defending-women-from-gender-ideology-extremism-and-restoring-biological-truth-to-the-federal\" target=\"_blank\" rel=\"noreferrer noopener\">executive order<\/a>, \u201cDefending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government,\u201d banning \u201ctransgender medical interventions\u201d within the federal prison system. Two subsequent BOP <a href=\"https:\/\/www.courtlistener.com\/docket\/69717615\/1\/2\/kingdom-v-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">memos<\/a> <a href=\"https:\/\/www.courtlistener.com\/docket\/69717615\/1\/1\/kingdom-v-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">implemented<\/a> the order. One banned federal funds from paying for \u201cany medical procedure, treatment, or drug for the purpose of conforming an inmate\u2019s appearance to that of the opposite sex.\u201d<\/p>\n<p>Federal Judge Royce Lamberth of the U.S. District Court in Washington, D.C., <a href=\"https:\/\/www.courtlistener.com\/docket\/69717615\/68\/kingdom-v-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">blocked<\/a> the executive order and both memos from being implemented across all BOP facilities in June 2025. He stated the Trump administration is \u201cenjoined from enforcing Executive Order 14168 as applied to medical hormone therapy and social accommodations for people in the custody of the BOP and from enforcing the BOP\u2019s memoranda implementing Executive Order 14168, and \u2026 shall provide and continue providing Plaintiffs and members of the class gender-affirming hormone therapy and social accommodations in accordance with BOP policy and practice in effect immediately prior to Defendant Trump\u2019s issuance of Executive Order 14168 on January 20, 2025.\u201d<\/p>\n<p>In February 2026, the BOP published the \u201c<a href=\"https:\/\/www.bop.gov\/policy\/progstat\/5260_001.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Management of Inmates with Gender Dysphoria<\/a>\u201d policy. It blocked \u201ctransgender\u201d surgeries and hormone therapies for inmates who had not already had such interventions, and created a tapering plan for those who had been on transgender drugs prior to the policy, subject to medical approval on a case-by-case basis. Complications from surgeries already completed would also be treated under the policy.<\/p>\n<p>However, a memo from Elisa Mason, who is general counsel for the BOP, essentially preempted the enforcement of that policy based on Lamberth\u2019s injunction, claiming it only covers \u201chormones and social accommodations.\u201d<\/p>\n<p>While that case, <em>Kingdom v. Trump<\/em>, mentions surgeries in the complaint, the injunction does not. It is therefore unclear if surgeries stopped, pursuant to the executive order. But it appears that cross-sex hormone replacement is still going on.<\/p>\n<p>BOP declined to comment on the matter. Spokesman Emery Nelson told The Federalist, \u201cFor privacy, safety, and security\u00a0reasons,\u00a0the Federal Bureau of Prisons does not comment on\u00a0matters related to pending\u00a0litigation or ongoing legal proceedings.\u201d Under the Health Insurance Portability and Accountability Act (HIPAA), it is <a href=\"https:\/\/www.ecfr.gov\/current\/title-45\/subtitle-A\/subchapter-C\/part-164\/subpart-E\/section-164.512\" target=\"_blank\" rel=\"noreferrer noopener\">impossible<\/a> to know what sorts of treatment which inmates receive, and Roske\u2019s attorneys did not respond to a request for comment from The Federalist.<\/p>\n<p>Roske\u2019s placement in FMC Fort Worth raises even more questions, particularly since such placement also disregards BOP sentencing preferences. In the October 2025 sentencing, Boardman initially recommended that Roske be sent to Federal Correctional Institution (FCI) Terminal Island, a <a href=\"https:\/\/barragan.house.gov\/2025\/11\/26\/long-beach-post-citing-decaying-conditions-feds-say-they-will-close-terminal-island-prison\/\" target=\"_blank\" rel=\"noreferrer noopener\">facility<\/a> in the Los Angeles area that was shut down in June 2026.<\/p>\n<p>FCI Terminal Island made sense because Roske is <a href=\"https:\/\/www.justice.gov\/opa\/pr\/nicholas-roske-sentenced-over-eight-years-prison-attempted-murder-supreme-court-justice\" target=\"_blank\" rel=\"noreferrer noopener\">from<\/a> just outside of Los Angeles, and sentencing generally follows the \u201c<a href=\"https:\/\/www.bop.gov\/foia\/docs\/FSA_500_Miles_Designation.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">500 mile policy<\/a>.\u201d That part of the 2018 First Step Act states inmates should \u201cto the extent practicable\u201d be placed in a prison within 500 driving miles from their release residence. Factors such as \u201cmedical and mental health care levels\u201d are part of the consideration as to whether to place inmates in a facility outside that distance.<\/p>\n<p>Even if that policy were not followed, it might make the most sense to have Roske serve out his time at a facility close to where his crime was committed, which is Maryland. Applying the 500-mile logic to California or Maryland would not land an inmate in Texas \u2014 but it would if that inmate were receiving some form of Care Level 4-type medical treatment.<\/p>\n<p>The Trump administration is appealing Roske\u2019s short sentence, and there are <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-resolution\/818\/text\" target=\"_blank\" rel=\"noreferrer noopener\">impeachment proceedings<\/a> filed against Boardman in the House of Representatives.<\/p>\n<hr>\n<p>      Breccan F.
