Reps. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/Andy-Barr\/\">Andy Barr<\/a> (R-KY) and <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/congressional\/4664292\/tim-walz-wife-endorses-angie-craig-minnesota-senate-primary\/\">Angie Craig<\/a> (R-MN), each running for <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/senate\/\">Senate<\/a> in their states, introduced the <em>Lawful Hemp Protection Act<\/em> this month to roll back the November 2025 language, while adding reforms to the hemp industry. <\/p>\n<p class=\"wp-block-paragraph\">\u201cWe worked closely with <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/business\/4523663\/hemp-farmer-planting-season-ban-gamble\/\">Kentucky farmers<\/a>, industry stakeholders, and House Agriculture Committee Ranking Member Angie Craig to develop a commonsense, bipartisan framework that supports American agriculture while protecting consumers and children,\u201d Barr told the <em>Washington Examiner<\/em>.<\/p>\n<p class=\"wp-block-paragraph\"><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/in_focus\/4074769\/inside-hemp-industry-impending-ban\/\"><strong>HEMP INDUSTRY BRACES FOR UPHEAVAL THANKS TO LITTLE-NOTICED BUDGET PROVISION<\/strong><\/a><\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The hemp-banning language passed in November 2025 cut down the allowable hemp-derived THC per product container to 0.4 milligrams from the prior 2018 Farm Bill language that made hemp with less than 0.3% delta-9 THC legal, meaning a typical serving could have up to <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.cms.gov\/priorities\/innovation\/substance-access-beneficiary-engagement-incentive\">three milligrams<\/a>. <\/p>\n<p class=\"wp-block-paragraph\">Barr and Craig\u2019s bill sets a limit of 1% total THC on a dry-weight basis at the crop level, marking a significant increase from the currently enforced 2018 Farm Bill language and the stricter 2025 regulation. However, the Barr\/Craig bill calls for the Food and Drug Administration to establish milligram caps at the final product level, and instates a cap of 5 milligrams for oral products and 50 milligrams for inhalable and topical products if the agency does not establish standards within a year\u2019s time.<\/p>\n<p class=\"wp-block-paragraph\">The <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.congress.gov\/119\/bills\/hr9830\/BILLS-119hr9830ih.pdf\">60-page bill<\/a> includes several regulatory boundaries to address some of the biggest concerns about the largely unregulated 2018 language.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-3\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-3\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The bill would require THC limit testing throughout multiple stages of production, prohibit synthetic cannabinoids, set a 21-year-old age limit for purchase, and set package and marketing standards aimed at ensuring products are not marketed toward children. The latter point is one Sen. <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/Mitch-McConnell\/\">Mitch McConnell<\/a> (R-KY) took issue with as he championed the 2025 ban.<\/p>\n<p class=\"wp-block-paragraph\">The bill also instructs the Treasury to impose a five-cents-per-milligram tax on hemp-derived beverages, carving out beverages from a flat 5% tax on other hemp-derived products, thereby gaining the support of several <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.wswa.org\/news\/wswa-applauds-congressman-barrs-hemp-beverage-regulation-framework-calls-clear-trade-practice\">alcohol trade<\/a> groups for the bill.<\/p>\n<p class=\"wp-block-paragraph\">\u201cWe believe this strikes the right balance \u2014 allowing farmers to continue growing a profitable, legitimate crop while ensuring intoxicating hemp products are appropriately regulated as adult-only products with strict age restrictions for individuals under 21 and a ban on marketing towards children,\u201d Barr told the <em>Washington Examiner<\/em>.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-4\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-4\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-25\" data-wex-ad=\"art-dsk-inart-4\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Craig called it a bill that \u201cwill give regulatory clarity to Minnesota farmers, brewers and small business owners and provide an alternative to short-sighted federal policies that threaten Minnesota jobs and consumer choice,\u201d in a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/craig.house.gov\/media\/press-releases\/rep-angie-craig-introduces-comprehensive-regulatory-framework-hemp\">statement<\/a>.<\/p>\n<p class=\"wp-block-paragraph\"><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/business\/4523663\/hemp-farmer-planting-season-ban-gamble\/\"><strong>HEMP FARMERS PREPARE FOR PLANTING SEASON AHEAD OF IMPENDING BAN: \u2018WE ARE 100% TAKING A GAMBLE\u2019<\/strong><\/a><\/p>\n<p class=\"wp-block-paragraph\">Barr also addressed the 1% total THC standard, saying that by adopting a total standard, \u201crather than focusing on a single cannabinoid, the bill provides a practical, science-based approach to regulating intoxicating products.\u201d <\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-5\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-5\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-26\" data-wex-ad=\"art-dsk-inart-5\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Barr and Craig\u2019s bill, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/9830\/text?s=1&#038;r=1&#038;hl=%22lawful+hemp+protection+act%22\">summarized<\/a> as a bill to \u201cpreserve lawful hemp commerce while protecting consumers from high-THC synthetic intoxicants,\u201d has enjoyed the backing of most of the hemp industry. Hemp producers were largely looking for a bill that would reform the ban language but outline more regulations than the 2018 farm bill, to root out bad actors.<\/p>\n<p class=\"wp-block-paragraph\">Jim Higdon, co-founder of Kentucky-based Cornbread Hemp, touted the bill in a conversation with the <em>Washington Examiner<\/em>, calling it a \u201cresponsible framework for responsible products.\u201d He also noted how significant it is for the industry to have Barr and Craig\u2019s names on the bill.<\/p>\n<p class=\"wp-block-paragraph\">\u201cTo have two middle America states with prominent members stand up as co-sponsors for this is, you know, really sort of an indication of how far this conversation has come,\u201d Higdon said. \u201cSpeaking as a Kentuckian running a Kentucky-based business, having the odds-on favorite of replacing Senator McConnell being on our side in a demonstrable way is incredibly important in this moment.\u201d<\/p>\n<p class=\"wp-block-paragraph\">But on the drug safety side of the hemp conversation, advocates are frustrated with the continued efforts by members of Congress to roll back a standard they see as fair and safe for Americans. <\/p>\n<p class=\"wp-block-paragraph\">Kevin Sabet, the president and CEO of the drug safety policy advocacy group Smart Approaches to Marijuana, called the hemp industry a \u201cpublic health disaster\u201d in a statement to the <em>Washington Examiner<\/em>. He added that he believes Congress \u201cshould be closing this loophole once and for all \u2013 not making it permanent.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cLast year, 76 U.S. Senators voted to crack down on this failed policy because they recognized it wasn\u2019t working,\u201d Sabet said, referring to the 2025 vote on the hemp-banning language, which was passed as part of a deal to fund the government after a 43-day shutdown. <\/p>\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s deeply disappointing to see lawmakers like Sen. Tim Sheehy, Rep. Andy Barr and Rep. Angie Craig not only trying to reverse that bipartisan progress, but also trying to undo one of the strongest bipartisan votes Congress has taken on drug policy in years by expanding the very market that\u2019s putting more addictive, high-potency THC products within reach of kids,\u201d Sabet said. <\/p>\n<p class=\"wp-block-paragraph\">According to <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.marijuanamoment.net\/gop-senator-says-keeping-hemp-thc-products-legal-is-an-issue-that-can-unite-lawmakers-at-a-hyperpartisan-time\/\"><em>Marijuana Moment<\/em><\/a>, Sen. Tim Sheehy (R-MT) spoke in support of a regulatory hemp bill to replace the 2025 language in a call with the organization Hemp Industry and Farmers of America in July.<\/p>\n<p class=\"wp-block-paragraph\">Reps. Tim Moore (R-NC) and Mark Veasey (D-TX) have joined Barr and Craig as cosponsors of the bill. Introduced on July 22, it has been referred to the House Ways and Means, Energy and Commerce, Agriculture, and Transportation and Infrastructure Committees for now. <\/p>\n<p class=\"wp-block-paragraph\">The other bills introduced on the topic, including a bill to <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/4420630\/comer-backs-initiative-delay-hemp-ban-going-into-effect-november\/\">delay the ban<\/a> from going into effect in November, have not progressed in either chamber.<\/p>\n<p class=\"wp-block-paragraph\">The current Senate farm bill negotiations have seemingly shut out any amendments to the hemp language on the farm bill itself. Senate Agriculture Committee Chairman <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/john-boozman\/\">John Boozman<\/a> (R-AR) released <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/senate\/4671751\/boozman-farm-bill-draft-snap-cuts\/\">an updated draft <\/a>of the proposed <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/farm-bill\/\">farm bill<\/a> on Friday ahead of the committee markup next week.
