Justice Barrett&#8217;s experiences reflect the broader principle that parents are primary protectors of their children&#8217;s well-being, a concept rooted deeply in American constitutional tradition. You\u00a0don\u2019t\u00a0need to be a parent to see that danger.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">But it\u2019s Barrett, a Catholic mother of seven, who\u2019s also sitting closest to a different, quieter question the Court has been answering: how parents protect their children when the threats they face come not only from violence, but from government policies that intrude on family life. It clearly helps to have a\u00a0parent\u00a0part of making that call.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">Start with <a class=\"LexicalEditorTheme__link\" href=\"https:\/\/url.avanan.click\/v2\/r01\/___https:\/\/www.supremecourt.gov\/opinions\/24pdf\/24-297_4f14.pdf___.YXAzOmNyY2E6YTpvOmFiOWY3ODZlY2RiNmRhM2QzMmY4ZTliMWRhOWU1OTQ0Ojc6MThmNjowMjJjMGVlZWVlODIwY2UzMTJmZTQ2NzZhNjgxNzY2NDliOTFlYzJjZWIyN2EyOWI5NGI0OWE5NGVjOWM0OWMyOmg6VDpG\" target=\"_blank\" rel=\"noopener\"><u><i><em class=\"LexicalEditorTheme__textItalic LexicalEditorTheme__textUnderline\">Mahmoud v. Taylor<\/em><\/i><\/u><\/a> last year, which Barrett joined. Montgomery County, Maryland parents wanted an opt-out from LGBTQ-themed storybooks in their kids\u2019 classrooms, and they got it. Justice Alito\u2019s opinion grounded the win in the right to direct your child\u2019s religious upbringing. Limited, but real: the win belonged to families whose objection was specifically religious.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">Then came <a class=\"LexicalEditorTheme__link\" href=\"https:\/\/url.avanan.click\/v2\/r01\/___https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25a810_b97d.pdf___.YXAzOmNyY2E6YTpvOmFiOWY3ODZlY2RiNmRhM2QzMmY4ZTliMWRhOWU1OTQ0Ojc6Njc4OTpjYzUwMGUyZWFkY2NjYTIzMmE2ZTg1ZWIyNzQ2Y2I2NTQ0N2QwMTU0YWRlM2ZmMjk4MmJlMmJkNTRhYjAwOGIyOmg6VDpG\" target=\"_blank\" rel=\"noopener\"><u><i><em class=\"LexicalEditorTheme__textItalic LexicalEditorTheme__textUnderline\">Mirabelli v. Bonta<\/em><\/i><\/u><\/a> out of California, where parents challenged the state\u2019s policy to keep hidden students\u2019 \u201cgender transitions\u201d at school. That case could have been a carbon copy of <i><em class=\"LexicalEditorTheme__textItalic\">Mahmoud<\/em><\/i>. Instead, the Court, with Barrett concurring, also found that California\u2019s policy violated something in addition to Free Exercise: the basic\u00a0due-process\u00a0right\u00a0every parent\u00a0has to\u00a0be involved in decisions about their own kid.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">An agnostic parent could bring that claim as easily as a devout one. The theory stepped outside the church door.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">And now a third case pushes further still. This coming term the Supreme Court will hear <a class=\"LexicalEditorTheme__link\" href=\"https:\/\/url.avanan.click\/v2\/r01\/___https:\/\/becketfund.org\/case\/st-mary-catholic-parish-v-roy\/___.YXAzOmNyY2E6YTpvOmFiOWY3ODZlY2RiNmRhM2QzMmY4ZTliMWRhOWU1OTQ0Ojc6NzgxMjo5Y2ZkZGQ0NDg2Y2RhMjcxNzI0YmNlZDNhMGJiM2M4OGRkY2JhNDI1MmRlYWQzNGY1MmU5ZGI1MDVmY2NhMGJjOmg6VDpG\" target=\"_blank\" rel=\"noopener\"><u><i><em class=\"LexicalEditorTheme__textItalic LexicalEditorTheme__textUnderline\">St. Mary Catholic Parish v. Roy<\/em><\/i><\/u><\/a>, out of Colorado. This one might be the most relatable yet.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">Colorado rolled out a \u201cuniversal\u201d preschool program, a tuition subsidy for\u00a0basically every\u00a0family in the state wanting to enroll their child in preschool. Except if you want to send your child to a Catholic preschool that still teaches Catholic doctrine on marriage and gender,\u00a0you\u2019re\u00a0out. Any preschool taking the money must admit every child on identical terms, no exceptions for a school\u2019s religious convictions.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">So\u00a0a parish like St. Mary\u2019s in Littleton either abandons what it believes or\u00a0forfeits\u00a0the same benefit every secular preschool down the road keeps. Families are already feeling\u00a0it. Archdiocese enrollment has dropped, and a couple of schools have closed outright.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">Notice the pattern. <i><em class=\"LexicalEditorTheme__textItalic\">Mahmoud<\/em><\/i> was about what your kid reads in class. <i><em class=\"LexicalEditorTheme__textItalic\">Mirabelli<\/em><\/i> was about what your kid\u2019s teacher is allowed to tell you. <i><em class=\"LexicalEditorTheme__textItalic\">St. Mary<\/em><\/i> is about whether your family gets locked out of a benefit everyone else qualifies for, purely because your school takes its faith seriously.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">Each dispute asks whether parents\u00a0remain\u00a0free to protect and form their children according to their own convictions or whether the state gets the final word. And each of these cases includes religious families stepping up first to test the ground, clearing the path every other parent eventually gets to walk down too.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">Storybooks. Confidential school policies. Preschool tuition. These may seem like separate controversies, but they all ask who bears the first responsibility for safeguarding children.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">Again and again, it has been religious parents willing to take on the criticism and financial costs of defending their ability to protect and guide the children entrusted to them. In doing so, they have secured protections that extend well beyond the faithful to every American family.<\/p>\n<p class=\"LexicalEditorTheme__paragraph\">Perhaps that\u2019s\u00a0why Justice Barrett\u2019s testimony lingers. Her story\u00a0wasn\u2019t\u00a0simply about the dangers of public service.
