Even though the Department identified California&#8217;s violations of FERPA and had not yet revoked federal funds, the fight continues, with similar concerns raised about Washington&#8217;s policies.<\/p>\n<p>In addition, the Department of Justice is involved in enforcement actions against Maryland\u2019s Anne Arundel County and Michigan\u2019s Ann Arbor districts for concealing \u201ctransgender identities\u201d from parents, including potential loss of federal funds. The Administration is threatening to take legal action against districts that bypass FERPA requirements, highlighting ongoing disputes over parental rights in education on gender issues. Despite past setbacks in withholding federal funds from some states over other issues, the Department signals it may pursue more aggressive strategies to enforce compliance.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Since the beginning of the Trump administration, the Department of Education has been trying to get left-wing school districts to stop hiding changes in students\u2019 claimed \u201cgender identity\u201d from their parents, always with the threat of revoking federal funds. A year and a half in, schools are still noncompliant, or dragging their feet, and it is time for the federal government to make good on the threat.<\/p>\n<p>The department on Thursday said it was \u201cdemand[ing] clarity\u201d from California and Washington on how they will \u201crevise\u201d their policies, so that the two states start informing parents of serious medical concerns, like whether their children start to show signs of gender dysphoria, instead of encouraging and advancing the delusion.<\/p>\n<p>\u201cSchools must end the practice of concealing vitally important information about students from parents who love them,\u201d <a href=\"https:\/\/www.ed.gov\/about\/news\/press-release\/us-department-of-education-demands-clarity-california-and-washington-plans-revise-transgender-policies\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> Frank Miller, director of the Student Privacy Policy Office.\u00a0\u201cWe are providing California and Washington the opportunity to explain to the Department and the families they serve how they are revising their policies to come into compliance with federal law. SPPO is determined to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-administration-targets-failing-colleges-and-for-profits-with-new-regulations-2\/\" title=\"New regulations by the Biden ... aim to address struggling colleges and for-profit institutions.\">hold educational institutions accountable<\/a> and ensure the protection of parental rights.\u201d <\/p>\n<p>The Education Department stated that the U.S. Supreme Court <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25a810_b97d.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruling<\/a> in <em>Mirabelli v. Olson<\/em> recognized that \u201cunder long-established precedent, parents \u2014 not the State \u2014 have primary authority with respect to the upbringing and education of children.\u201d It also pointed to a 9th Circuit <a href=\"https:\/\/cdn.ca9.uscourts.gov\/datastore\/opinions\/2025\/04\/21\/23-3694.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">decision<\/a>, based on <em>Mirabelli<\/em>, stating that California\u2019s law hiding such information from parents is likely unconstitutional.<\/p>\n<p>However, despite those cases, and despite the fact that the department <a href=\"https:\/\/thefederalist.com\/2026\/01\/28\/ed-department-california-violated-family-rights-law-by-secretly-transitioning-students\/\" target=\"_blank\" rel=\"noreferrer noopener\">found<\/a> California in violation of the Family Educational Rights and Privacy Act (FERPA) back in January, the department has still not revoked California\u2019s funding because of its efforts to push radical gender ideology in schools while hiding the fallout from concerned parents.<\/p>\n<p>Washington appears similarly situated to drag out the conflict, with State Superintendent Chris Reykdal releasing a lengthy <a href=\"https:\/\/ospi.k12.wa.us\/about-ospi\/news-center\/news-releases\/state-superintendent-chris-reykdals-statement-todays-sham-announcement-trump-white-house\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a> Thursday calling attempts to restore parental rights, and stop <a href=\"https:\/\/thefederalist.com\/2025\/03\/13\/exclusive-linda-mcmahon-meets-with-detransitioners-to-discuss-schools-pushing-gender-transition\/\" target=\"_blank\" rel=\"noreferrer noopener\">grooming children at school<\/a>, a \u201cstunt,\u201d claiming that the state really does comply with federal law, before stating, \u201cmight we suggest they demand charges against any number of persons identified in the Epstein files or those who allegedly committed abuses of the \u2018ring boys\u2019 at the World Wrestling Entertainment company?\u201d<\/p>\n<p>But California and Washington are not the only states with these problems. As The Federalist <a href=\"https:\/\/thefederalist.com\/2025\/03\/28\/exclusive-education-department-investigates-maine-for-hiding-gender-dysphoria-from-parents\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> in March 2025, Maine has nearly the exact same policy, which prompted a Department of Education investigation and similar <a href=\"https:\/\/www.ed.gov\/about\/news\/press-release\/us-department-of-education-directs-schools-comply-parental-rights-laws\" target=\"_blank\" rel=\"noreferrer noopener\">direction<\/a> to comply with FERPA.<\/p>\n<p>On Monday, the department put Maryland\u2019s Anne Arundel County Public Schools and Michigan\u2019s Ann Arbor Public Schools on <a href=\"https:\/\/www.ed.gov\/about\/news\/press-release\/trump-administration-cracks-down-school-districts-secretly-transitioning-students-and-hiding-it-parents\" target=\"_blank\" rel=\"noreferrer noopener\">notice<\/a> that the Department of Justice is now involved with \u201cenforcement action\u201d for their policies hiding claimed \u201ctransgender identities\u201d from parents.<\/p>\n<p>According to the Education Department, \u201cparents in Anne Arundel County who discovered that the school was secretly helping their daughter pretend to be male at school after the parents received an email that referred to their daughter by male pronouns. When the parents approached school administrators about the matter, the principal declined to provide details about the student\u2019s \u2018gender transition,\u2019 and the assistant principal refused to turn over the child\u2019s relevant records.\u201d<\/p>\n<p>Enforcement action against Anne Arundel would include \u201capplicable judicial proceedings and potential loss of federal funding.\u201d Ann Arbor, on the other hand, has been given until Aug. 10 \u201cto demonstrate why ED and DOJ should not move forward with enforcement.\u201d<\/p>\n<p>\u201cFERPA is not optional, and any districts that attempt to bypass or distort its requirements should expect immediate federal action,\u201d Assistant Attorney General for Civil Rights Harmeet Dhillon said. \u201cIn partnership with the Department of Education, the Department of Justice will initiate enforcement proceedings with districts that fail to comply.\u201d<\/p>\n<p>Some attempts to revoke federal funding from states for other issues in the past have seen <a href=\"https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-bonta-secures-agreement-protecting-49-billion-funding\" target=\"_blank\" rel=\"noreferrer noopener\">defeats<\/a> in court, but that may just be a signal that the department needs to be more creative with how funds are being withheld.<\/p>\n<hr>\n<p>      Breccan F.
