A judge issued a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-georgia-update-judge-issues-restraining-order-for-10-days-preventing-defendants-from-destroying-or-erasing-dominion-voting-machines\/\" title=\"BREAKING GEORGIA UPDATE: Judge Issues Restraining ... for 10 Days Preventing Defendants from Des...ying or Erasing Dominion Voting Machines\">temporary restraining order<\/a> (TRO), preventing state officials from enforcing the law against the plaintiffs while the court considers further legal motions. The lawsuit concerns New York\u2019s Medical Aid in Dying Act (MAID), which allows terminally ill patients to request life-ending medication, and the associated Palliative Care Information act (PCIA), which requires providers to inform patients about this option. The plaintiffs argue that thes laws violate their First amendment rights by requiring them to participate in procedures they oppose on religious grounds and to promote euthanasia, conflicting with Catholic teachings. The TRO restricts the state from compelling the plaintiffs to provide information or counseling related to assisted suicide before the law takes effect on August 5, 2026. The directive will remain in effect as Nardacci considers the plaintiffs\u2019 motion for emergency relief and the state\u2019s cross-motion to dismiss the complaint. <\/p>\n<div id=\"fdrlst__b89e9-2856434647\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">At issue in <em><a href=\"https:\/\/becketnewsite.s3.amazonaws.com\/20260720172325\/Complaint-in-Carmelite-Sisters-for-the-Aged-and-Infirm-v.-James.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Carmelite Sisters for the Aged and Infirm v. James<\/a><\/em>  is New York\u2019s recently passed <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2025\/S138\" target=\"_blank\" rel=\"noreferrer noopener\">Medical Aid in Dying Act (MAID)<\/a>, which grants terminally ill adults the ability to request that their <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/utm_sourcerssutm_mediumrssutm_campaigncatholic-nuns-take-on-new-yorks-coercive-physician-assisted-suicide-law-in-court\/\" title=\"... Take On New York&#039;s &#039;Coercive&#039; ... ...\">physician administer life-ending drugs<\/a>. The statute lays out the process by which patients may do so, as well as the form language they must use when filing such a request.<\/p>\n<p class=\"wp-block-paragraph\">The plaintiff Catholic nuns and health care ministries <a href=\"https:\/\/thefederalist.com\/2026\/07\/28\/catholic-nuns-take-on-new-yorks-coercive-physician-assisted-suicide-law-in-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">allege<\/a> that the law \u2014 in conjunction with the state\u2019s <a href=\"https:\/\/www.health.ny.gov\/professionals\/patients\/patient_rights\/palliative_care\/information_act.htm\" target=\"_blank\" rel=\"noreferrer noopener\">Palliative Care Information Act<\/a> \u2014 \u201cconscript[s] even religious healthcare providers and institutions to participate in the provision of physician-assisted suicide.\u201d They claim that these statutes\u2019 provisions violate their First Amendment rights because they require \u201cmedical providers caring for terminally ill New Yorkers \u2026 to proactively inform and counsel their patients about their \u2018option\u2019 to kill themselves,\u201d a mandate at odds with the Catholic Church\u2019s teachings.<\/p>\n<p class=\"wp-block-paragraph\"><strong>[READ:[READ:<a href=\"https:\/\/thefederalist.com\/2026\/07\/28\/catholic-nuns-take-on-new-yorks-coercive-physician-assisted-suicide-law-in-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">Catholic Nuns Take On New York\u2019s \u2018Coercive\u2019 Physician-Assisted Suicide Law In Court<\/a>]<\/strong><\/p>\n<p class=\"wp-block-paragraph\">In their initial lawsuit, the plaintiffs asked Nardacci to grant their requests to bar the state and its officials from enforcing the contested provisions against them before the MAID Act takes effect on Aug. 5. They additionally requested that the court declare that the MAID Act and PCIA \u201cviolate the First Amendment by impermissibly infringing on Plaintiffs\u2019 authority to govern their internal religious affairs free from government interference.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Nardacci\u2019s TRO temporarily bars New York from forcing the Catholic plaintiffs, as well as their providers and employees, to \u201cprovide information and counseling about the use of medication for aid in dying\u201d or \u201cestablish policies and procedures governing how information and counselling about the use of medication for medical aid in dying will be provided.\u201d It also stops the state from compelling the plaintiffs to perform a host of other actions and speech that seemingly adhere to MAID. New York\u2019s agreement to the TRO is \u201cnot an admission or representation\u201d that such conduct \u201cis required by law,\u201d according to the directive.<\/p>\n<p class=\"wp-block-paragraph\">Nardacci noted that the agreed-to order does not prevent the Empire State from \u201cadopting, developing or promulgating policies and procedures\u201d related to MAID and the PCIA.
