pfTrackEvent(&#039;After SCOTUS Ruling, Michigan Agrees To End \u2018Talk Therapy\u2019 Ban For Gender-Confused Kids&#039;); return false;\" title=\"Printer Friendly, PDF &#038; Email\">                     <span id=\"printfriendly-text2\" class=\"pf-button-text\"><i class=\"mdi mdi-printer\" aria-hidden=\"true\"><\/i><\/span>                     <\/a>                 <\/span><\/li>\n<\/ul><\/div>\n<div class=\"pf-content\">\n<p class=\"wp-block-paragraph\">The Democrat-run state of Michigan agreed on Thursday to end its prohibition on licensed therapists providing counseling to children struggling with issues related to sexual orientation and gender dysphoria.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThis is a major victory for children, counselors, and common sense,\u201d\u00a0Luke Goodrich, senior counsel at Becket and lead attorney for the counselors, said in a <a href=\"https:\/\/becketfund.org\/media\/michigan-drops-effort-to-muzzle-counselors-who-help-children-struggling-with-their-biological-sex\/\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>. \u201cKids who are hurting deserve compassion, not a one-way ticket to harmful drugs, hormones, and surgery. Now counselors can offer compassionate counseling without fearing that state bureaucrats will come knocking.\u201d <\/p>\n<div id=\"fdrlst__b89e9-1658817596\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Known as <em>Catholic Charities v. Whitmer<\/em>, the case dealt with several Michigan-based counselors\u2019 challenge to state laws barring them from engaging in talk therapy with minor clients facing discomfort with their sex. The challengers argued that such a prohibition violated their First Amendment rights. <\/p>\n<p class=\"wp-block-paragraph\">The 6th Circuit Court of Appeals <a href=\"https:\/\/becketfund.org\/media\/michigan-drops-effort-to-muzzle-counselors-who-help-children-struggling-with-their-biological-sex\/\" target=\"_blank\" rel=\"noreferrer noopener\">handed<\/a> plaintiffs a favorable ruling in the case late last year, which was subsequently followed by the U.S. Supreme Court\u2019s <em>Chiles v. Salazar<\/em> decision. In <em>Chiles<\/em>, the high court <a href=\"https:\/\/thefederalist.com\/2026\/03\/31\/8-1-scotus-nukes-egregious-colorado-ban-on-therapists-helping-gender-confused-clients\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> that a similar Colorado law \u201cregulates speech based on viewpoint, and the lower courts erred by failing to apply sufficiently rigorous First Amendment scrutiny.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201c[T]he First Amendment stands as a shield against any effort to enforce orthodoxy in thought or speech in this country. It reflects instead a judgment that every American possesses an inalienable right to think and speak freely, and a faith in the free marketplace of ideas as the best means for discovering truth. However well-intentioned, any law that suppresses speech based on viewpoint represents an \u2018egregious\u2019 assault on both of those commitments,\u201d Justice Neil Gorsuch wrote for an 8-1 majority. <\/p>\n<p class=\"wp-block-paragraph\">In Thursday\u2019s <a href=\"https:\/\/becketnewsite.s3.amazonaws.com\/20260730120411\/Stipulated-Order-Final-Judgment-in-Catholic-Charities-v-Whitmer.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">stipulated order<\/a>, Biden-appointed Judge Jane Beckering noted that, in light of the 6th Circuit and Supreme Court\u2019s rulings, the <em>Catholic Charities<\/em> plaintiffs have \u201cdemonstrated success on the merits\u201d of their claim that Michigan\u2019s laws represent an unlawful viewpoint-based restriction on speech. She further observed that the plaintiffs have \u201cestablished irreparable injury and that an injunction is in the public interest.\u201d <\/p>\n<p class=\"wp-block-paragraph\">As such, both parties agreed to the stipulated order and final judgement, which prohibits Michigan from enforcing the talk therapy ban against counselors in the state. <\/p>\n<p class=\"wp-block-paragraph\">\u201cThe Court hereby DECLARES that HB 4616, as applied to licensed mental health professionals engaged in therapy that consists exclusively of talking, violates the Free Speech Clause of the First Amendment to the United States Constitution,\u201d Beckering wrote. \u201cThe Court hereby PROHIBITS Defendants, their successors, agents, and all those acting in concert with them from enforcing HB 4616 against licensed professionals who engage in therapy that consists exclusively of talking.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The court\u2019s permanent injunction will take effect immediately, according to the order. <\/p>\n<p class=\"wp-block-paragraph\">\u201cMichigan is now admitting its law is unconstitutional,\u201d\u00a0Goodrich said. \u201cIts surrender confirms that the Constitution and the best available science are on the side of counselors who help children find peace with their bodies. States still trying to censor that care should take note.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The Great Lakes State\u2019s agreement to end enforcement of the contested laws is a noticeably different path taken than that of neighboring Wisconsin. Months after the Supreme Court handed down its <em>Chiles<\/em> ruling, Democrat Gov. Tony Evers <a href=\"https:\/\/thefederalist.com\/2026\/06\/03\/gov-evers-doubles-down-on-forcing-therapists-to-lie-about-sex-and-gender\/\" target=\"_blank\" rel=\"noreferrer noopener\">doubled down<\/a> on seemingly defying the decision. <\/p>\n<p class=\"wp-block-paragraph\">\u201cI have no intention of repealing the ban on \u2026 conversion therapy on kids. Period. End of story.
