Circuit Greenlights IRS Policy Aimed At Boosting Deportations\">federal appellate court shot<\/a> down on Wednesday attempts by a pair of rogue judges to sidestep a recent Supreme Court immigration ruling.<\/p>\n<p class=\"wp-block-paragraph\">In its <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ca1.53950\/gov.uscourts.ca1.53950.00108483752.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">newly released<\/a> <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ca1.54076\/gov.uscourts.ca1.54076.00108483783.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">orders<\/a>, a three-judge panel on the 1st Circuit Court of Appeals overturned Massachusetts-based Judges Patti Saris and Brian Murphy\u2019s administrative pauses against the Trump administration. Those directives <a href=\"https:\/\/thefederalist.com\/2026\/07\/28\/rogue-judges-are-helping-temporary-migrants-sidestep-key-scotus-ruling\/\" target=\"_blank\" rel=\"noreferrer noopener\">sought<\/a> to stop the government from ending <a href=\"https:\/\/thefederalist.com\/tag\/temporary-protected-status\/\" target=\"_blank\" rel=\"noreferrer noopener\">Temporary Protected Status (TPS)<\/a> for foreign nationals from South Sudan and Ethiopia, respectively.<\/p>\n<div id=\"fdrlst__b89e9-508524285\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The panel was comprised of Judges Julie Rickelman and Seth Aframe, both Biden appointees, and Joshua Dunlap, a Trump appointee. <\/p>\n<p class=\"wp-block-paragraph\">Saris and Murphy\u2019s actions were seen as an effort to effectively <a href=\"https:\/\/thefederalist.com\/2026\/07\/28\/rogue-judges-are-helping-temporary-migrants-sidestep-key-scotus-ruling\/\" target=\"_blank\" rel=\"noreferrer noopener\">sidestep<\/a> the U.S. Supreme Court, which <a href=\"https:\/\/thefederalist.com\/2026\/06\/25\/supreme-court-affirms-temporary-status-for-foreign-migrants-is-temporary\/\" target=\"_blank\" rel=\"noreferrer noopener\">sided<\/a> with the administration on the TPS issue last month. In a 6-3 ruling by Justice Samuel Alito, the high court held that the TPS statute bars federal courts from reviewing non-constitutional claims against the government\u2019s TPS decisions and further shot down a constitutional claim by one of the respondents that the president\u2019s termination of TPS for Haitians was racially motivated.<\/p>\n<p class=\"wp-block-paragraph\">CNN subsequently <a href=\"https:\/\/www.cnn.com\/2026\/07\/27\/politics\/temporary-protected-status-supreme-court-decision\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> on Monday about challengers\u2019 efforts to repackage their prior procedural arguments \u201cinto new constitutional claims or signaled plans to do so soon\u201d in an apparent attempt to runaround <em>Mullin<\/em>. Saris and Murphy \u2014 the latter of whom has a track record of <a href=\"https:\/\/thefederalist.com\/2026\/07\/28\/rogue-judges-are-helping-temporary-migrants-sidestep-key-scotus-ruling\/\" target=\"_blank\" rel=\"noreferrer noopener\">defying<\/a> SCOTUS \u2014 <a href=\"https:\/\/www.foxnews.com\/politics\/dhs-accuses-rogue-clinton-judge-open-defiance-supreme-court\" target=\"_blank\" rel=\"noreferrer noopener\">indicated<\/a> their administrative stays were issued to give challengers time to amend their initial complaints against the government. <\/p>\n<p class=\"wp-block-paragraph\">The 1st Circuit panel said that its decision to reverse those postponement orders is \u201cin light of\u201d the <em>Mullin v. Doe<\/em> ruling.<\/p>\n<p class=\"wp-block-paragraph\">\u201c<em>Mullin<\/em> held that \u2018the TPS statute\u2019s judicial-review bar applies to all non-constitutional claims\u2019 challenging the Secretary of Homeland Security\u2019s determination with respect to the termination of a TPS designation. \u2026 Claims of that nature were the only basis for the postponement order on appeal,\u201d the court ruled. \u201cAccordingly, the government\u2019s request for summary reversal is allowed. Its additional request for a stay pending appeal is denied as moot.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The circuit panel additionally remanded the cases back to the district courts \u201cfor further proceedings in light of and consistent with <em>Mullin<\/em>.\u201d<\/p>\n<p class=\"wp-block-paragraph\">While favorable for the Trump administration, the Department of Homeland Security is warning that Wednesday\u2019s rulings likely won\u2019t mark the end of rogue judges\u2019 efforts to runaround <em>Mullin v. Doe<\/em>. In response to the 1st Circuit\u2019s reversal of Saris on X, DHS General Counsel James Percival <a href=\"https:\/\/x.com\/DHSGenCounsel\/status\/2082573166937862504?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">noted<\/a> that while the overturning of the district judge\u2019s stay is a \u201cgreat win to be sure,\u201d Saris \u201calready indicated that she would enter a new order postponing the termination on remand.\u201d<\/p>\n<p class=\"wp-block-paragraph\">\u201cThat is the absurdity we are facing,\u201d Percival added. <\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-x wp-block-embed-x\">\n<div class=\"wp-block-embed__wrapper\"> <span class=\"wClr2VHmqKZgfwhAsk7oMc97ptj85NI2FHR1l6MBL83YyKAzJqbdouhTm6BNp5FbeOryngWGZ\"><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">I&#39;m suspicious about these two orders.
