Jean Carroll\u2019s defamation suit overturned.<\/p>\n<p>In their <a href=\"https:\/\/www.documentcloud.org\/documents\/28521632-scotus726-petition\/\" target=\"_blank\" rel=\"noopener\">petition<\/a>, Trump\u2019s legal team argued that in upholding the penalty, the Second U.S. Circuit Court of Appeals failed to apply the presidential immunity to his statements made during his first term.<\/p>\n<p>Trump had called her claims in her 2019 book \u2014 that he had sexually assaulted her in a Bergdorf Goodman dressing room in Manhattan during the mid-1990s \u2014 a \u201c<a href=\"https:\/\/justthenews.com\/government\/courts-law\/trump-asks-supreme-court-overturn-83m-payment-carroll\" target=\"_blank\" rel=\"noopener\">hoax<\/a>\u201d that was politically and financially motivated, <a href=\"https:\/\/www.nytimes.com\/2026\/07\/28\/us\/politics\/trump-supreme-court-carroll.html\" target=\"_blank\" rel=\"noopener\">The New York Times<\/a> reported.<\/p>\n<p>Trump further stated the Carroll \u201cwas trying to sell a new book\u201d that \u201cshould be sold in the fiction section,\u201d and that her accusations were \u201ctotally false.\u201d<\/p>\n<p>In January 2024, a Manhattan jury awarded Carroll $83.3 million, including $65 million in punitive damages and $18.3 million for her suffering.<\/p>\n<p>Trump\u2019s Tuesday petition to the Supreme Court said the Second Circuit\u2019s ruling \u201cwrongly eviscerates Presidential immunity.\u201d<\/p>\n<p>\u201cThis is the first case in our Nation\u2019s history in which a court has imposed damages liability on a President for his conduct in office. Yet, in upholding the exorbitant $83.3 million defamation judgment here, the Second Circuit never even decided whether Presidential immunity applies to President Trump\u2019s allegedly defamatory statements \u2014 statements made from the White House, in response to press questions, denying allegations of personal misconduct, directly questioning his fitness for office,\u201d the attorneys argued.<\/p>\n<p>The Second Circuit\u2019s <a href=\"https:\/\/ww3.ca2.uscourts.gov\/decisions\/OPN\/24-644_2_opn.pdf\" target=\"_blank\" rel=\"noopener\">ruling<\/a> came over a year after the Supreme Court found that presidents have broad immunity from criminal prosecution for actions taken while in office.<\/p>\n<p>The context of that 2024 case was whether Trump could be held criminally liable for statements he made and actions he took following the 2020 election. The Court held in Trump v. United States that the President is entitled to <a href=\"https:\/\/www.westernjournal.com\/turley-scotus-immunity-decision-produces-cardiac-arrest-jack-smith-trump-case\/\" target=\"_blank\" rel=\"noopener\">presumptive immunity<\/a> for official acts taken while in office when they fall outside his core responsibilities as president.<\/p>\n<p>In their Tuesday petition, Trump\u2019s legal team said the Second Circuit \u201crefused to apply presidential immunity even after this court recognized that \u2018most of a president\u2019s public communications are likely to fall comfortably within\u2019 that protection.\u201d<\/p>\n<p>\u201cThe Second Circuit instead engaged in procedural contortions to avoid addressing Presidential immunity,\u201d the petition read.<\/p>\n<p>\u201cIf left standing, the decision below will cause significant damage, not only to this President and future Presidents, but also to \u2018the Nation that the Presidency was designed to serve.\u2019\u201d<\/p>\n<p><a href=\"https:\/\/www.scotusblog.com\/2026\/07\/trump-asks-supreme-court-to-hear-appeal-of-83-million-defamation-verdict-against-him\/\" target=\"_blank\" rel=\"noopener\">SCOTUS Blog<\/a> reported, \u201cTuesday\u2019s filing is the second one involving Carroll to come to the justices. On June 29, the Supreme Court turned down Trump\u2019s appeal in a separate [2023] case in which a jury found him liable for sexually abusing and defaming Carroll and awarded her $5 million.\u201d<\/p>\n<p>\u201cOn July 8, Trump filed a petition for rehearing, asking the justices to consider their denial of review. The court has not yet acted on that petition, although it could do so as soon as Aug. 17. However, Carroll has already received the $5 million award (plus interest), which had been set aside in an escrow account after the verdict.\u201d<\/p>\n<p>Following the <a href=\"https:\/\/www.westernjournal.com\/late-breaking-trump-rape-accuser-e-jean-carroll-gets-horrible-news-83-million-verdict-trump\/\" target=\"_blank\" rel=\"noopener\">2024 defamation case<\/a>, in which a jury awarded Carroll the $83.3 million, Trump, who was running for a second term as president, responded on social media, calling the verdict \u201cabsolutely ridiculous,\u201d according to The New York Times.<\/p>\n<p>\u201cOur Legal System is out of control, and being used as a Political Weapon,\u201d he added, and pledged to appeal. \u201cThey have taken away all First Amendment Rights.\u201d<\/p>\n<p>Strengthening Trump\u2019s political weapon argument, New York <a href=\"https:\/\/19thnews.org\/2023\/05\/e-jean-carroll-trump-new-law-justice-assault-survivors\/\" target=\"_blank\" rel=\"noopener\">passed a law<\/a> in 2023, after he declared his candidacy, that created a one-time, one-year window for those claiming to be victims of sexual assault to bring their cases that fall outside the normal statute of limitations.<\/p>\n<p>Carroll would not have brought her suit otherwise, which stems from the 1990s.<\/p>\n<p>Further, <a href=\"https:\/\/www.cnn.com\/2019\/06\/27\/politics\/carroll-friends-deflate-law-order-episode\" target=\"_blank\" rel=\"noopener\">CNN<\/a> reported in 2019 that Carroll\u2019s account of the sexual assault in a Bergdorf\u2019s dressing room mirrored the plot of a 2012 \u201cLaw &#038; Order: SVU\u201d episode.<\/p>\n<p>\u201cIt tickled me to death,\u201d she told CNN at the time when this was pointed out to her. \u201cIt\u2019s a great, huge coincidence, but it is a magnificent one, I must say.\u201d<\/p>\n<p>\u201cIt\u2019s very ironic because \u2018Law &#038; Order\u2019 happens to be one of my favorite shows,\u201d Carroll said. \u201cI love \u2018Law &#038; Order: Criminal Intent.\u2019\u201d<\/p>\n<p>Finally, Trump argued in a 2024 social media post that Carroll at first said that she was wearing a dress that hadn\u2019t been made yet.<\/p>\n<p>\u201cShe originally claimed that the \u2018event\u2019 happened in 1994, and that she wore the Donna Karan dress on that day. The problem is that New York Times Fact Checkers found the dress wasn\u2019t even made by Donna Karan until long after 1994. The truth is that she doesn\u2019t know the day, month, season, year, or decade \u2014 because it did not happen.
