These recordings also expose his disregard for classified information, highlighting that Biden, unlike Trump, lacked authority to declassify and unlawfully retained sensitive records. The report and audio evidence suggest a pattern of cognitive deterioration and legal violations, which some critics argue were overlooked due to a biased two-tier justice system influenced by political interests. Biden&#8217;s behavior and the inquiry have sparked discussions about accountability and the influence of the so-called &#8220;swamp&#8221; in American politics.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>President Joe Biden was just a \u201csympathetic, well-meaning elderly man with a poor memory.\u201d At least that\u2019s how <a href=\"https:\/\/www.justice.gov\/archives\/sco-hur\" target=\"_blank\" rel=\"noreferrer noopener\">Special Counsel Robert Hur<\/a> described the Autopen President. Hur concluded as much in his <a href=\"https:\/\/www.justice.gov\/storage\/report-from-special-counsel-robert-k-hur-february-2024.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">2024 report<\/a> that let Biden off the hook for mishandling classified documents because a liberal Washington, D.C., jury would most likely not convict the senile old man. <\/p>\n<p>Now, the long-awaited release of the <a href=\"https:\/\/thefederalist.com\/2026\/07\/21\/appeals-court-shoots-down-bidens-bid-to-hide-recordings-of-memoir-interviews\/\" target=\"_blank\" rel=\"noreferrer noopener\">audio recordings<\/a> of Biden\u2019s conversations with his memoir ghostwriter paints a picture of a politician in the throes of cognitive decline before he became commander-in-chief \u2014 a former vice president who broke the law and got away with it. <\/p>\n<h2>Early Signs of Decline<\/h2>\n<p>The recordings come compliments of the <a href=\"https:\/\/itsyourgov.org\" target=\"_blank\" rel=\"noreferrer noopener\">Oversight Project,<\/a> a government watchdog that fought in courtrooms for more than two years to bring them to the public.   <\/p>\n<p>\u201cWe filed this case on March 6, 2024. It has been a very long, hard fight for transparency,\u201d Kyle Brosnan, the Oversight Project\u2019s general counsel said Tuesday in an interview on <a href=\"https:\/\/www.iheart.com\/podcast\/477-the-dan-odonnell-show-27550539\/now-playing\" target=\"_blank\" rel=\"noreferrer noopener\"><em>The Dan O\u2019Donnell Show<\/em><\/a>. <\/p>\n<p>All six audio files, more than two hours of Biden losing his train of thought to contracted writer Mark Zwonitzer, are available on the Oversight Project\u2019s <a href=\"https:\/\/www.youtube.com\/playlist?list=PLZ-4dWVwWsFI\">website<\/a>. The page also includes a searchable transcript of the conversations. <\/p>\n<p>In his 2023 interview with Hurr, Biden showed what the Democratic Party and corporate media outlets labored to cover up: a president in steep cognitive decline. They attacked Hur, a former attorney in President Donald Trump\u2019s Department of Justice, accusing him of running a politically motivated investigation. Vice President Kamala Harris at the time was one of the most vehement defenders of her boss, calling Hur\u2019s report \u201cinaccurate and inappropriate.\u201d <\/p>\n<p>\u201cThe way that the President\u2019s demeanor in that report was characterized could not be more wrong on the facts,\u201d she said. It was all so \u201cgratuitous\u201d Harris said. Of course, later that year Biden\u2019s ever-loyal vice president would be anointed as a presidential candidate after the Democratic National Committee threw the old codger under the bus when his senility became impossible to hide.  <\/p>\n<p>The sessions with his ghostwriter point to where Biden was heading in the days immediately following his two terms as President Barack Obama\u2019s No. 2. He meanders and forgets key facts. In one portion, Biden can\u2019t remember the name of <a href=\"https:\/\/clyburnforcongress.com\/how-rep-james-clyburn-a-south-carolina-icon-helped-biden-score-his-big-comeback\/\" target=\"_blank\" rel=\"noreferrer noopener\">Rep. James Clyburn,<\/a> the South Carolina Democrat who saved Biden\u2019s bacon in 2020, when his goose seemed cooked in the early primaries. <\/p>\n<p>\u201cThese tapes show that the autopen presidency was not born when he was inaugurated president in 2021 but in the intervening years between when he left as vice president and the 2020 election,\u201d Brosnan said. <\/p>\n<h2>\u2018The Swamp Always Wins\u2019<\/h2>\n<p>More damning is that the new audio details in real time the future president\u2019s disregard for the laws on classified documents. <\/p>\n<p>While \u201csympathetic\u201d Biden was treated with kid gloves, Trump was subjected to a 40-count superseding indictment and prosecution by Special Counsel Jack Smith, who ignored the law to get his man. Biden showed up on <em>60 Minutes<\/em> to blast Trump for his handling of classified documents.<\/p>\n<p>\u201cHow could that possibly happen?\u201d Biden said. \u201cHow anyone could be that irresponsible?\u201d<\/p>\n<p>We would learn not long after that the Democrat was about to have to answer his own question. <\/p>\n<p>As Brosnan notes, Trump was president and a former president when he declassified the documents Biden\u2019s FBI found at his Mar-a-Lago home. <\/p>\n<p>Biden, on the other hand, had no authority to declassify, hold on to, and share classified records with ghostwriters. <\/p>\n<p>\u201cThere\u2019s a big difference between the president and the vice president. And there are also multiple points throughout the audio where Biden himself says, \u2018Oh boy, I\u2019m not supposed to have this. Or \u2018Hey, this is classified,\u2019\u201d Brosnan said. <\/p>\n<p>At a 2024 Judiciary Committee hearing into the Hur investigation, chairman Jim Jordan said that the matter \u201cboiled down to a few key facts.\u201d <\/p>\n<p>\u201cJoe Biden kept classified information. Joe Biden failed to properly secure classified information and Joe Biden shared classified information with people he wasn\u2019t supposed to. Joe Biden broke the law because he\u2019s a forgetful old man who would appear sympathetic to a jury. Mr. Hur chose not to bring charges,\u201d Jordan said. <\/p>\n<p>Brosnan said there\u2019s a bigger reason why Biden got a pass: a two-tiered justice system driven by politics. <\/p>\n<p>\u201cBecause the swamp always wins,\u201d the attorney said. \u201cI mean this is coming of the heels of Hilary Clinton and her private email server and the declination to prosecute her.\u201d<\/p>\n<p>\u201cThere\u2019s a two-tier system of justice in this country where Republicans get thrown through the ringer, whether it be Jack Smith\u2019s prosecution of Trump or all the barfare against people like my colleague<a href=\"https:\/\/thefederalist.com\/2026\/05\/14\/trump-doj-challenges-leftist-barfare-with-lawsuit-targeting-jeff-clarks-dc-persecutors\/\" target=\"_blank\" rel=\"noreferrer noopener\"> Jeff Clark <\/a>or Dr. <a href=\"https:\/\/thefederalist.com\/2026\/04\/16\/california-bar-strips-john-eastman-of-livelihood-for-representing-a-client-with-views-it-dislikes\/\" target=\"_blank\" rel=\"noreferrer noopener\">John Eastman<\/a>,\u201d he added. <\/p>\n<hr>\n<p>      Matt Kittle is a senior elections correspondent for The Federalist.
