Circuit Court of Appeals unanimously favored President Trump in a dispute over his mail-in voting executive order. The court dismissed efforts by Democrats to block the order, which directs federal agencies to develop rules for mail voting in upcoming elections. The lawsuit was filed shortly after the order was issued, but the court noted that it was premature to review the case as the agencies had not yet implemented the directives. The court emphasized that issues would only be addressed if the agencies take actions that violate law or the Constitution. Ducks ... in Tennessee Abortion Case\">ongoing legal battle<\/a> over his mail-in voting executive order.<\/p>\n<p class=\"wp-block-paragraph\">In a unanimous ruling, a three-judge panel for the D.C. Circuit Court of Appeals <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cadc.43216\/gov.uscourts.cadc.43216.01208873377.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">shot down<\/a> Democrats\u2019 lawfare against Trump\u2019s March elections order. That <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2026\/03\/ensuring-citizenship-verification-and-integrity-in-federal-elections\/\" target=\"_blank\" rel=\"noreferrer noopener\">directive<\/a>, as summarized by the court, \u201cdirects the Department of Homeland Security, the United States Postal Service, and other agencies to begin developing new rules and procedures for mail voting in the upcoming midterm and future elections.\u201d<\/p>\n<div id=\"fdrlst__b89e9-549644367\" class=\"d-flex justify-content-center fdrlst__b89e9-paragraph-2 fdrlst__b89e9-entity-placement\">\n<div id=\"div-gpt-ad-1463670073398-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The Democrat plaintiffs filed their lawsuit a day after the order was issued. They subsequently asked the U.S. District Court for the District of Columbia a week later to issue a preliminary injunction blocking its enforcement.<\/p>\n<p class=\"wp-block-paragraph\">The district court rejected that request.<\/p>\n<p class=\"wp-block-paragraph\">In affirming the lower court\u2019s ruling, the D.C. Circuit panel noted that \u201cwhile Plaintiffs have identified a number of serious questions concerning the lawfulness of <em>proposed<\/em> actions <em>if<\/em> implemented on the threshold of the upcoming federal election, this case likely is <a href=\"https:\/\/www.law.cornell.edu\/wex\/ripe\" target=\"_blank\" rel=\"noreferrer noopener\">unripe<\/a> for review in its present posture.\u201d In other words, the case is unreviewable at this time because the named agencies haven\u2019t implemented their official rules as required by the president\u2019s order.<\/p>\n<p class=\"wp-block-paragraph\">\u201cIn particular, Plaintiffs\u2019 request for preliminary relief \u2018is premised on the threatened impact\u2019 of the Executive Order <em>after<\/em> it is implemented and <em>if<\/em> in violation of federal law,\u201d the court ruled. \u201cIn addition, the Executive Order, which is not self-executing, directs the agencies to act only to \u2018the extent feasible and consistent with applicable law, including but not limited to the Privacy Act of 1974,\u2019 and so requires compliance with the very legal limitations about which Plaintiffs are concerned.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The appellate court said that plaintiffs may seek relief \u201c[i]f the defendant agencies take steps to implement the Executive Order in a manner that violates federal law or the Constitution.\u201d The panel was comprised of Judges Patricia Millett (Obama appointee), Robert Wilkins (Obama appointee), and Gregory Katsas (Trump appointee). <\/p>\n<p class=\"wp-block-paragraph\">The ruling was handed down a day after the Trump administration filed an <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/26\/26A124\/417370\/20260727144320600_Trump%20v.%20California%20Application%20and%20Appendix.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">emergency application<\/a> with the U.S. Supreme Court to pause a Massachusetts-based judge\u2019s injunction against the mail-in voting order. Similar to the D.C. Circuit, the Justice Department argued that \u201cthe injunction is especially indefensible because the agencies are still deliberating over how (if at all) to implement the Order.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Justice Ketanji Brown Jackson, who oversees emergency applications from the 1st Circuit Court of Appeals, has <a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/26a124.html\" target=\"_blank\" rel=\"noreferrer noopener\">given<\/a> respondents until 4 p.m. ET on Aug. 3 to file a response to the government\u2019s application.<\/p>\n<p class=\"wp-block-paragraph\">\n<p class=\"wp-block-paragraph\">\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">      Shawn Fleetwood is a staff writer for The Federalist and a graduate of the University of Mary Washington.
