Salgado Araujo was a Houston homebuilder and Mexican citizen who had lived in the U.S. as 1998 and was in the process of applying for a work permit. The government is not permitted to detain noncitizens without \u201cindividualized justification,\u201d according to Ellison\u2019s order, which states that the DHS must seek a predetention hearing before it seeks to redetain Rojas Pliego.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-1\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-1\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-15\" data-wex-ad=\"art-dsk-inart-1\"><\/div>\n<\/div>\n<\/div>\n<div class=\"article-paywall\">\n<p class=\"wp-block-paragraph\">Rojas Pliego has applied for a U-visa, a special status for crime victims who assist law enforcement that is sponsored by the Harris County District Attorney\u2019s Office, according to Ellison. Rojas Pliego would receive a four-year work permit, protection from deportation, and a path to a green card if the application is granted.<\/p>\n<p class=\"wp-block-paragraph\">Raed Gonzalez, one of Rojas Pliego\u2019s attorneys,<a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.texastribune.org\/2026\/07\/27\/texas-houston-ice-shooting-witness-release\/\"> told<\/a> the<em> Texas Tribune <\/em>that the two other passengers in the van who were detained, Daniel Tirado Pantoja and Salgado Araujo\u2019s brother, Victor Hugo Salgado Araujo, have filed similar petitions for their release. He said it was still too early to tell whether the judge would grant their requests for release.<\/p>\n<p class=\"wp-block-paragraph\">The debacle began on the morning of July 7, when several ICE vehicles that appeared to be unmarked began chasing Salgado Araujo\u2019s white work van. Officials have said the Houston homebuilder was not the target of ICE\u2019s original operation, but that they began the chase because they believed the white vehicle could have been the one officers had previously identified at the site they were headed to.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">After chasing the van down Houston streets, the government said that Salgado Araujo sought to weaponize his van against officers and ram it into ICE\u2019s vehicle. Agents fatally shot Salgado Araujo in self-defense, officials said. In an initial assessment of the case, the FBI claimed there was a possibility of drugs being in the van, saying that after the shooting, an agent looking at the vehicle from the outside spotted what he thought could have been meth.<\/p>\n<p class=\"wp-block-paragraph\">The Trump administration\u2019s account of the incident has been heavily disputed by passengers in the car, who said ICE never identified themselves during the deadly incident.<\/p>\n<p class=\"wp-block-paragraph\">Narcotics testing confirmed that the substance in white bags seen by the FBI was merely salt for the homemade electrolyte mix Salgado Araujo\u2019s wife prepared for the work crew every day, Harris County District Attorney Sean Teare <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/immigration\/4663558\/texas-construction-worker-fatally-shot-ice-didnt-have-drugs-despite-fbi-claims\/\">said Friday<\/a>. Salgado Araujo was afraid for his life because he did not realize the agents were with ICE, as they were wearing unmarked clothing and vehicles, according to his brother, who was in the work van. He was also concerned about his tools and workers, as the work van had been stolen in the past, according to Salgado Araujo\u2019s son, Ronaldo Salgado. He got his van, but no tools. Before the shooting, he had been in the process for months of applying for a work permit in the U.S. and was close to obtaining legal status, according to his family.<\/p>\n<p class=\"wp-block-paragraph\">\u201cWe crossed every T, dotted every I, filled out every document, went to every appointment,\u201d Ronaldo said. \u201cThe last appointment he went to was for his fingerprints, and we\u2019re just waiting to hear back from the lawyers to hear that he got his work permit. He was excited about that. Why did they choose him? Why did they choose to follow him? Like, what? What was the premise? My dad had no criminal history. My dad, you know, wasn\u2019t doing anything illegal.
