The claims allege that both organizations engaged in race-based hiring and program allocation, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/top-republican-senator-warns-fbi-losing-the-trust-of-the-american-people\/\" title=\"Top Republican Senator Warns FBI \u2018Losing the Trust of the American People\u2019\">potentially violating federal laws<\/a> such as the Civil Rights Act of 1964 and Section 1557 of the Affordable Care Act.Atlantic Health\u2019s Minority Visiting Clerkship program and Nemours\u2019 Visiting Student Scholar Program are designed to support underrepresented groups in medicine, but DNH argues these programs constitute race-based favoritism. The organizations, both nonprofits receiving federal funding, deny any wrongdoing. DNH has previously sued medical institutions over similar discrimination issues. The DOJ has also initiated investigations into medical schools\u2019 DEI practices, and Atlantic and Nemours have yet to respond publicly.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Medical advocacy organization <a href=\"https:\/\/donoharmmedicine.org\" target=\"_blank\" rel=\"noreferrer noopener\">Do No Harm<\/a> filed complaints Tuesday against <a href=\"https:\/\/donoharmmedicine.org\/wp-content\/uploads\/Complaint-DNH-v.-Atlantic-Health-7-28-26-final.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Atlantic Health System<\/a> and <a href=\"https:\/\/donoharmmedicine.org\/wp-content\/uploads\/Complaint-DNH-v.-Nemours-7-28-26-final.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Nemours Children\u2019s Health<\/a>, alleging discriminatory DEI practices. The complaints, filed with the U.S. Department of Health and Human Services Office for Civil Rights (HHS-OCR), accused these organizations of race-based hiring practices that may <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-administration-combating-politicized-purposes-at-colleges-byron-york-washington-examiner\/\" title=\"Trump administration combating \u2018politicized purposes\u2019 at colleges: Byron York - Washington Examiner\">violate federal anti-discrimination laws<\/a>.<\/p>\n<p>Atlantic Health\u2019s <a href=\"https:\/\/www.atlantichealth.org\/professionals\/medical-student-programs\/morristown-medical-center#tab=pediatrics\" target=\"_blank\" rel=\"noreferrer noopener\">Minority Visiting Clerkship Program (MVCP)<\/a> for fourth-year medical students is a program specifically for groups \u201cunderrepresented in medicine.\u201d According to Atlantic Health, these groups include \u201cAfrican American, Hispanic\/Latino and American Indian\/Alaska Native.\u201d<\/p>\n<p>\u201cStudents selected to participate are awarded inpatient residency rotations, an interview for full-time residency after medical school, mentorship, and valuable networking opportunities with hospital staff,\u201d according to a Do No Harm (DNH) press release obtained by The Federalist.<\/p>\n<p>Similarly, <a href=\"https:\/\/www.nemours.org\/education\/orlando-medical-student-rotations\/orlando-visiting-rotation-program.html\" target=\"_blank\" rel=\"noreferrer noopener\">Nemours Children\u2019s Visiting Student Scholar Program<\/a> is limited to those \u201cunderrepresented in medicine as any racial, ethnic, religious, socioeconomic, or ability status group whose numbers in medicine are not reflective of that group\u2019s population of the United States.\u201d Therefore, only members of minority groups qualify for this program, which offers a stipend, several rotation options, and networking opportunities.<\/p>\n<p>DNH alleges that these two organizations are in violation of the Civil Rights Act of 1964, which prohibits race-based hiring practices. As nonprofits that take federal funds, both organizations are prohibited under <a href=\"https:\/\/www.justice.gov\/crt\/fcs\/TitleVI#1\" target=\"_blank\" rel=\"noreferrer noopener\">Title VI<\/a> from <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-assembly-pushes-new-amendment-in-favor-of-racial-discrimination\/\" title=\"California Assembly Proposes Amendment Supporting ...\">race-based preferential treatment<\/a>.<\/p>\n<p>DNH also alleges that these organizations are in violation of <a href=\"https:\/\/www.hhs.gov\/civil-rights\/for-individuals\/section-1557\/fs-sex-discrimination\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">Section 1557<\/a> of the Affordable Care Act, a provision which prevents healthcare organizations from engaging in discrimination.<\/p>\n<p>\u201cThese programs are especially important for fourth-year medical students, <a href=\"https:\/\/amzn.to\/3YuVZYV\" >offering meaningful clinical training experiences<\/a>, while also giving students the chance to showcase their skills at potential future residency sites,\u201d DNH Chief Medical Officer Kurt Miceli told The Federalist. \u201cOne\u2019s race has no bearing on whether he or she is able to provide high-quality care.\u201d<\/p>\n<p>This is not the first time DNH has sued medical organizations for racial discrimination practices. In May of last year, DNH <a href=\"https:\/\/thefederalist.com\/2025\/05\/09\/ucla-med-school-slapped-with-class-action-lawsuit-over-alleged-race-based-admissions\/\" target=\"_blank\" rel=\"noreferrer noopener\">filed suit<\/a> against the medical school at the University of California, Los Angeles, for allegedly maintaining race-based admissions after the Supreme Court overturned affirmative action. The Department of Justice (DOJ) <a href=\"https:\/\/thefederalist.com\/2026\/01\/30\/department-of-justice-backs-lawsuit-against-ucla-medical-schools-race-based-admissions\/\" target=\"_blank\" rel=\"noreferrer noopener\">backed<\/a> the suit this January by <a href=\"https:\/\/donoharmmedicine.org\/wp-content\/uploads\/2026\/01\/77_USA-Motion-to-Intervene.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">filing to intervene<\/a>.<\/p>\n<p>The DOJ\u2019s Civil Rights Division, led by Assistant Attorney General Harmeet Dhillon, has pursued investigations into several other medical schools and organizations over alleged DEI admissions practices. The division recently announced an investigation into over 15 medical schools for racial discrimination <\/p>\n<p>The Federalist reached out to Atlantic Health System and Nemours Children\u2019s Health for comment outside working hours, but they have not responded to the request.<\/p>\n<hr>\n<p>      Skye Graham is an intern at The Federalist.
