Despite the Supreme court&#8217;s 6-3 ruling in Mullin v. Doe, which restricts federal courts from reviewing non-constitutional claims related to TPS decisions and affirmed DHS\u2019s authority to terminate protections, these attorneys are reformulating their legal strategies to challenge the ruling, including raising constitutional arguments even though Justice Alito highlighted the Secretary of Homeland Security&#8217;s duty for TPS decisions. Some judges, including biden appointee Brian Murphy and others appointed by Democratic presidents, have issued orders that temporarily block or stay the enforcement of the Supreme court&#8217;s decisions and the Trump administration&#8217;s efforts to revoke TPS. This pattern indicates a broader effort by certain judges and legal advocates to undermine or circumvent the court&#8217;s authority, supporting the notion that manny on the left aim for the permanent retention of these protections and are willing to challenge the judiciary to do so. The article concludes that this ongoing legal controversy illustrates a persistent push by the left to keep noncitizens in the U.S. indefinitely, reflecting broader political and judicial conflicts over immigration enforcement.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Left-wing attorneys representing temporarily-present migrants are trying to sidestep a key U.S. Supreme Court decision effectively greenlighting their clients\u2019 deportation \u2014 and a cabal of rogue judges are seemingly helping them do it.<\/p>\n<p>The ploy was disclosed in a <a href=\"https:\/\/www.cnn.com\/2026\/07\/27\/politics\/temporary-protected-status-supreme-court-decision\" target=\"_blank\" rel=\"noreferrer noopener\">CNN report<\/a> published Monday about ongoing efforts to keep foreign nationals under the <a href=\"https:\/\/thefederalist.com\/tag\/temporary-protected-status\/\" target=\"_blank\" rel=\"noreferrer noopener\">Temporary Protected Status (TPS)<\/a> program in the United States, well, permanently. Titled, \u201cInside the fights to maintain TPS status for thousands after the Supreme Court sided with Trump,\u201d the article delves into how these <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dismissal-of-kari-lakes-election-lawsuit-proves-voter-disenfranchisement-no-longer-matters\/\" title=\"Dismissal of Kari Lake&#039;s Election Lawsuit Proves Voter Disenfranchisement No Longer Matters\">left-wing attorneys<\/a> are looking for ways to essentially skirt the high court\u2019s <em><a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25-1083_f204.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Mullin v. Doe<\/a><\/em>  ruling from last month. <\/p>\n<p>In its 6-3 decision, SCOTUS <a href=\"https:\/\/thefederalist.com\/2026\/06\/25\/supreme-court-affirms-temporary-status-for-foreign-migrants-is-temporary\/\" target=\"_blank\" rel=\"noreferrer noopener\">affirmed<\/a> that the TPS statute bars federal courts from reviewing non-constitutional claims against the government\u2019s TPS decisions. The majority further shot down the constitutional claim by one of the challengers that Trump\u2019s termination of TPS for Haitians was racially motivated. <\/p>\n<p>According to CNN, the left-wing lawyers representing various foreign national groups have since \u201crepackaged their earlier procedural arguments into new constitutional claims or signaled plans to do so soon\u201d in an apparent attempt to runaround <em>Doe<\/em>. This even includes some attorneys embracing \u201cnovel, non-constitutional arguments about whether the [Department of Homeland Security] has the authority in the first place to terminate the protections.\u201d<\/p>\n<p>To call such arguments \u201cnovel\u201d is being generous. Justice Samuel Alito explicitly <a href=\"https:\/\/x.com\/ShawnFleetwood\/status\/2081836273317146686?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a> in <em>Doe<\/em> that, \u201cResponsibility for TPS decisions rests with the Secretary of Homeland Security.\u201d<\/p>\n<p>While such antics may seem ripe for dismissal, several rogue judges have shown a willingness to entertain such chicanery.<\/p>\n<p>The latest incident came on Friday, when Massachusetts-based District Judge Brian Murphy, a Biden appointee, issued an administrative stay blocking the Trump administration\u2019s bid to revoke TPS for Ethiopians. According to the <a href=\"https:\/\/www.courtlistener.com\/docket\/72178312\/african-communities-together-v-noem\/\" target=\"_blank\" rel=\"noreferrer noopener\">court filing<\/a>, Murphy granted the request so that challengers can amend their complaint against the government.<\/p>\n<p>If Brian Murphy\u2019s name sounds familiar, it should. He\u2019s the same rogue judge the Supreme Court previously <a href=\"https:\/\/thefederalist.com\/2025\/07\/07\/if-justice-kagan-wants-respect-from-lower-courts-she-should-shut-down-their-judicial-coup\/\" target=\"_blank\" rel=\"noreferrer noopener\">rebuked<\/a> for telling the Trump administration to ignore the high court\u2019s decision to pause one of his overreaching injunctions.<\/p>\n<p>The clash happened last year, when Murphy issued an injunction blocking the government\u2019s deportation of illegal aliens to \u201cthird countries\u201d (aka countries not of their origin). After SCOTUS \u2014 in a 6-3 decision along ideological lines \u2014 granted team Trump\u2019s request to temporarily stay his order, Murphy told the administration hours later that the stay didn\u2019t apply to his injunction. <\/p>\n<p>The government went back to the Supreme Court to clarify its order. This time, in a 7-2 ruling, the justices confirmed that its decision did, in fact, apply to Murphy\u2019s order. <\/p>\n<p>The Biden appointee\u2019s rebellion against the high court prompted a stinging rebuke from Justice Elena Kagan. The Obama appointee said that while she didn\u2019t agree with the majority\u2019s decision to pause the injunction, she joined the majority in the motion to clarify because she does \u201cnot see how a district court can compel compliance with an order that this Court has stayed.\u201d<\/p>\n<p>The 1st Circuit Court of Appeals <a href=\"https:\/\/thefederalist.com\/2026\/03\/12\/1st-circuit-halts-rogue-judges-bid-to-stop-trumps-third-country-deportations\/\" target=\"_blank\" rel=\"noreferrer noopener\">blocked<\/a> Murphy\u2019s <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4471956\/biden-judge-strikes-third-country-deportation-high-court-allowed\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruling<\/a> against the administration on the merits of the issue earlier this year. <\/p>\n<p>Per CNN, Massachusetts-based Judge Patti Saris and Illinois-based Judge Matthew Kennelly, both Clinton appointees, have also issued orders since <em>Doe<\/em>\u2018s release keeping TPS designations in place (for now) for individuals from South Sudan and Burma, respectively. <\/p>\n<figure><\/figure>\n<p>This ongoing legal debacle underscores a few points.<\/p>\n<p>The first is that the biggest supporters of Temporary Protected Status never intended for foreign nationals brought into the U.S. under the program to just stay here on a \u201ctemporary\u201d basis. They always intended for these noncitizens to remain here permanently, and the continuing lawfare against the administration\u2019s bid to end existing designations is further proof of that. <\/p>\n<p>The second is that the left\u2019s judicial coup is alive and in full force. With help from left-wing activists in black robes, Democrats\u2019 lawfare machine will stop at nothing to kneecap the will of 2024 voters and grind the president\u2019s agenda to a halt.
