No classified information was alleged to have appeared in the published book.<\/p>\n<p class=\"wp-block-paragraph\">The tapes became the subject of intense scrutiny after Hur referenced them in his <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.justice.gov\/storage\/report-from-special-counsel-robert-k-hur-february-2024.pdf\">February 2024 report<\/a>. Hur began investigating after <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/justice-department-releases-redacted-trump-mar-a-lago-warrant\/\" title=\"Justice Department Releases Redacted Trump Mar-a-Lago Warrant\">documents bearing classification markings<\/a> from Biden\u2019s years in the Senate and the vice presidency were found at his Delaware home and private office.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Hur ultimately declined to recommend criminal charges.<\/p>\n<p class=\"wp-block-paragraph\">The special counsel described Biden, who interviewed with the special counsel during the investigation, as \u201cstruggling to remember events,\u201d exhibiting \u201cdiminished faculties,\u201d and engaging in conversations that were sometimes \u201cpainfully slow.\u201d Biden speaks haltingly in portions of the recordings, although signs that he was struggling with his memory, seven years before the special counsel investigation, are sometimes subtle.<\/p>\n<p class=\"wp-block-paragraph\">During one exchange, Biden appears to lose his train of thought.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-3\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-3\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cAll right \u2014 what was I going to ask you? Something else,\u201d Biden said. \u201cUh \u2026 um. Oh gosh. I can\u2019t think of anything else.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Other recordings include Biden describing potentially sensitive meetings, including \u201ca big meeting with the CIA and everyone,\u201d \u201ca big meeting down in the Situation Room,\u201d and \u201ca long meeting where DOD brief \u2026 POTUS.\u201d<\/p>\n<p class=\"wp-block-paragraph\">During an Oct. 10, 2016, conversation, Biden told Zwonitzer he possessed extensive notes that the White House did not know he had.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-4\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-4\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-25\" data-wex-ad=\"art-dsk-inart-4\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cI have extensive notes over this period of time,\u201d Biden said. \u201cThey didn\u2019t know I have this.\u201d<\/p>\n<p class=\"wp-block-paragraph\">In a Feb. 16, 2017, recording, Biden said, \u201cI just found all the classified stuff downstairs.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Hur cited that remark as evidence that Biden possessed classified material at his Virginia rental home after leaving office. The special counsel called Biden\u2019s tone \u201cmatter-of-fact\u201d but said it was possible he quickly forgot about the documents.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-5\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-5\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-26\" data-wex-ad=\"art-dsk-inart-5\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Other portions show Biden exercising caution. While still serving as vice president, he referred during a November 2016 conversation to the \u201cnonclassified part of my discussion with POTUS.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Hur\u2019s report said Biden showed Zwonitzer \u201cclassified notes from a National Security Council meeting\u201d during the Obama administration. The special counsel nevertheless concluded that the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/justice-department\/\">Justice Department<\/a> would be unlikely to secure a conviction because prosecutors could not prove beyond a reasonable doubt that Biden acted willfully.<\/p>\n<p class=\"wp-block-paragraph\">Hur wrote that jurors might instead view Biden as \u201ca sympathetic, well-meaning, elderly man with a poor memory.\u201d<\/p>\n<p class=\"wp-block-paragraph\">When the report was released, Biden denied sharing classified information with Zwonitzer.<\/p>\n<p class=\"wp-block-paragraph\">\u201cI did not share classified information,\u201d Biden told reporters. \u201cI did not share it with my ghostwriter.\u201d<\/p>\n<p class=\"wp-block-paragraph\">The <em>Washington Examiner<\/em> contacted Biden\u2019s representatives for comment on the recordings.<\/p>\n<p class=\"wp-block-paragraph\">\u201cLast, ask yourself, why didn\u2019t Special Counsel Robert Hur seek a prosecution and then (A) the forfeiture the $8 million book advance that Joe Biden got for Promise Me, Dad; and (B) his Delaware house and any other Biden property where he kept classified information?\u201d Oversight Project Vice President Jeff Clark <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/x.com\/JeffClarkUS\/status\/2081843738112892974\">posted<\/a> on X.<\/p>\n<p class=\"wp-block-paragraph\">Clark also pointed out Biden\u2019s \u201ctwo years of stonewalling\u201d over the release of the tapes, saying almost nothing he\u2019s come across had anything to do with private family matters.<\/p>\n<p class=\"wp-block-paragraph\">The tapes were released following a two-year court battle brought by the Oversight Project, a conservative nonprofit organization that says its mission is to \u201cexpose and root out corruption in government.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Biden\u2019s lawyers sought to block the disclosure, but the former president abandoned the effort after a divided federal appeals court <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/static.itsyourgov.org\/Tapes_Case_Ruling.pdf\">ruled against him<\/a> on July 20.<\/p>\n<p class=\"wp-block-paragraph\">Biden could have requested reconsideration by the full appeals court or asked the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\/\">Supreme Court<\/a> to intervene.
