The purpose of this voluntary review is to responsibly strengthen the historical record of this dark period in human history, with the aim that, through knowledge and reflection, the atrocities of Nazism are never repeated.\u201d<\/p>\n<h1 id=\"h-thumbing-its-nose-at-the-u-s-congress\" class=\"wp-block-heading\">\u2018Thumbing its nose at the U.S. Congress\u2019<\/h1>\n<p class=\"wp-block-paragraph\">The Simon Wiesenthal Center, an investigative group <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.influencewatch.org\/non-profit\/simon-wiesenthal-center\/\">named after<\/a> the late Nazi hunter, kicked off the latest inquiry into Credit Suisse\u2019s connection to the Holocaust in 2020, according to a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.budget.senate.gov\/ranking-member\/newsroom\/press\/credit-suisse-maintained-nazi-linked-accounts-into-21st-century-subpoenaed-records-show\">Senate summary<\/a>. After buying Credit Suisse in 2023, UBS agreed to reinstate Barofsky that year amid bipartisan Senate pressure, the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/senate-banking-committee\/\">Senate Banking Committee<\/a> announced <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.budget.senate.gov\/chairman\/newsroom\/press\/credit-suisse-reinstates-independent-ombudsperson-to-review-nazi-linked-accounts-as-a-result-of-budget-committee-investigation-\">in December 2023<\/a>.<\/p>\n<p class=\"wp-block-paragraph\">The findings he testified about in February were already groundbreaking: Credit Suisse held accounts for a Nazi-controlled manufacturer that armed the military, a German office that transferred <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/jews\/\">Jews<\/a> to concentration camps, the Nazi-controlled <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.clarku.edu\/holocaust-and-genocide-studies\/post-cards\/the-german-red-cross-postcard\/\">German Red Cross<\/a>, and agents of the murderous Schutzstaffel, or SS. The SS clients included convicted war criminal Leo Volk, though Credit Suisse denied having an account for him in 2001 when asked by a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.uek.ch\/en\/\">Switzerland commission<\/a>, according to Barofsky. There were also \u201cpreviously unreported examples of Credit Suisse executing forced transfers of Jewish clients\u2019 assets\u201d to Nazis, the attorney told lawmakers.<\/p>\n<p class=\"wp-block-paragraph\">Barosky testified that he could not honestly consider his inquiry complete unless UBS releases the withheld files, which it <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.judiciary.senate.gov\/imo\/media\/doc\/95317009-9c96-3e8f-f63d-04b7f29ef02f\/2026-02-03_QFR-Responses_Barofsky_supplemental.pdf\">deems<\/a> private attorney work documents or protected by attorney-client privilege. The Treasury Department did not respond to multiple requests for comment.<\/p>\n<p class=\"wp-block-paragraph\">UBS claims the concealed records do not contain anything meaningful to Barofsky\u2019s work.<\/p>\n<p class=\"wp-block-paragraph\">\u201cImportantly, this does not impact the investigation into the role Credit Suisse played during World War II and its aftermath, as the privileged documents being withheld were created in the 1990s and 2000s,\u201d the firm said in a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/wp-content\/uploads\/2026\/07\/20260521-ubs-statement.pdf\">May statement<\/a>.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-4\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-4\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-25\" data-wex-ad=\"art-dsk-inart-4\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cCredit Suisse voluntarily and without any legal obligation agreed to work with the [Simon Wiesenthal Center] to examine the SWC\u2019s allegations,\u201d UBS said. \u201cThe Bank did so out of a desire to pursue historical truth for its own sake \u2014 to ascertain if any material facts could contribute to a better understanding of events that occurred approximately 80 years earlier, including why they occurred.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Barofsky agreed in 2023 to complete his project in three months but has since dragged it on, according to UBS. The bank expects his final report to be released by the end of the year. Barofsky did not respond to the <em>Washington Examiner\u2019s<\/em> request for comment.<\/p>\n<p class=\"wp-block-paragraph\">\u201cHis role is not that of a prosecutor or government-appointed monitor,\u201d UBS said of Barofsky. \u201cThe Ombudsperson is not entitled to interpret his mandate any way he pleases or to make threats, veiled or otherwise, in order to impose his view or interest.\u201d<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-5\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-5\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-26\" data-wex-ad=\"art-dsk-inart-5\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cIt is time to conclude the investigation and bring the findings to the public,\u201d UBS said in May.<\/p>\n<h1 id=\"h-bankers-brace-for-more-possible-lawsuits\" class=\"wp-block-heading\">Bankers brace for more possible lawsuits<\/h1>\n<p class=\"wp-block-paragraph\">Amid the backdrop of Grassley and Barofsky\u2019s inquiries, more potential legal troubles remain for UBS stemming from the Holocaust.<\/p>\n<p class=\"wp-block-paragraph\">UBS asked the same New York federal judge who approved the 1999 victim settlement, Edward Korman, to issue a ruling in January clarifying the scope of the settlement to shield from further lawsuits, <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/wp-content\/uploads\/2026\/07\/UBSApril2026Ruling.pdf\">court records show<\/a>. While the $1.25 billion payout pertained to stolen Jewish assets, UBS wanted Korman to affirm that it also covered claims related to the recently uncovered Nazi accounts so that groups such as the Simon Wiesenthal Center could not bring new lawsuits.<\/p>\n<p class=\"wp-block-paragraph\">However, the bank was merely describing \u201chypothetical events and events that are not before me,\u201d Korman said in an April ruling that denied its request.<\/p>\n<p class=\"wp-block-paragraph\">\u201cUBS may well believe that it would benefit from a court\u2019s analysis of the 1999 Settlement Agreement \u2014 but unless and until a genuine case or controversy arises that requires judicial interpretation of its terms, the Agreement will continue to speak for itself,\u201d Korman wrote.<\/p>\n<p class=\"wp-block-paragraph\"><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/investigations\/4662014\/state-department-un-agency-investigate-hamas\/\"><strong>STATE DEPARTMENT DEMANDS US-FUNDED UN AGENCY \u2018FULLY INVESTIGATE\u2019 HAMAS INVOLVEMENT IN AID PROGRAMS<\/strong><\/a><\/p>\n<p class=\"wp-block-paragraph\">The Simon Wiesenthal Center <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.judiciary.senate.gov\/imo\/media\/doc\/responses_to_questions_for_the_record.pdf\">told senators<\/a> after Korman\u2019s ruling that it is not currently threatening to sue UBS, though it opposed the bank\u2019s attempt to prevent all future cases about the Nazi accounts.
