Reyes took notice Wednesday of War Secretary <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/pete-hegseth\/\">Pete Hegseth\u2019s<\/a> recent announcement that troops 30 and older would be screened annually for testosterone deficiency and could voluntarily receive testosterone replacement therapy. Reyes, who is overseeing a challenge to the transgender <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/military\/\">military<\/a> executive order in <em><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.courtlistener.com\/docket\/69583866\/talbott-v-trump\/?filed_after=&#038;filed_before=&#038;entry_gte=&#038;entry_lte=&#038;order_by=desc\">Talbott v. Trump<\/em> to address the screening, monitoring, cost, and administration of TRT. She also directed the government to explain \u201cthe Department\u2019s basis for treating trans men and other service members differently\u201d under the two policies.<\/p>\n<p class=\"wp-block-paragraph\">The orders create a new predicament for the government, which has argued since the inception of the second <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/trump-administration\/\" type=\"post_tag\" id=\"339\">Trump administration<\/a> against providing hormone-related treatments for military members, while now simultaneously encouraging similar treatments for other individuals not diagnosed with gender dysphoria.<\/p>\n<p class=\"wp-block-paragraph\">In a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.276845\/gov.uscourts.dcd.276845.38.0.pdf\">52-page filing<\/a> opposing a preliminary injunction submitted by the Justice Department in February 2025, the Trump administration invoked the military\u2019s need for troops who can deploy without requiring \u201croutine medical treatment or special provisions.\u201d It also cited the cost, monitoring requirements, and potential \u201cnon-deployability\u201d associated with gender transitions.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Hegseth\u2019s initiative could weaken those arguments, though it is far from a forfeiture of the administration\u2019s legal battle.<\/p>\n<p class=\"wp-block-paragraph\">TRT for testosterone deficiency and testosterone therapy for biological women who identify as men can both require continuing prescriptions, laboratory testing, and medical supervision. Some critics have argued Hegseth\u2019s TRT initiative may function as a tacit admission that hormone treatment alone is not necessarily incompatible with military readiness.<\/p>\n<p class=\"wp-block-paragraph\">However, the government\u2019s arguments in the case have drawn on several different reasons for banning transgender troops. For example, the Trump administration characterized gender dysphoria in court filings as a condition involving \u201cclinically significant distress or impairment\u201d and argued that transition-related procedures can make troops nondeployable for significant periods.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-3\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-3\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-17\" data-wex-ad=\"art-dsk-inart-3\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The government has also cited concerns beyond military readiness, including complications that come from allowing transgender-identifying members in the military, such as problems with privacy, sleeping and bathing facilities, physical-fitness standards, and unit cohesion.<\/p>\n<p class=\"wp-block-paragraph\">Therefore, the government may yet still have ample room to argue that those considerations are large enough to distinguish transgender hormone drugs from TRT provided for testosterone deficiency.<\/p>\n<p class=\"wp-block-paragraph\">The government may also contend that the two groups are not similarly situated. The February filing expressly argued that men and biological women who identify as men can be treated differently under equal-protection principles and emphasized the large degree of deference <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/courts\/\">courts<\/a> traditionally give military judgments.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-4\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-4\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-25\" data-wex-ad=\"art-dsk-inart-4\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">Still, Reyes\u2019s order puts pressure on the medical portion of the administration\u2019s defense, and the Pentagon may have difficulty relying on those same arguments to justify offering hormone treatments in some cases but not in others.<\/p>\n<p class=\"wp-block-paragraph\">Beyond Reyes\u2019s Wednesday order, both sides were told to have their briefs prepared by Aug. 7 to address how the <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/section\/news\/supreme-court\/\" type=\"category\" id=\"11310\">Supreme Court\u2019s<\/a> ruling in <em>B.P.J. v. West Virginia<\/em>, the landmark case allowing states to bar men from competing in women\u2019s sports, implicates the dispute over the transgender troops executive order. Parties were also told to make their service discovery requests ready before Aug. 14.<\/p>\n<p class=\"wp-block-paragraph\"><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/defense\/4650079\/pete-hegseth-testosterone-initiative-what-to-know\/\">HEGSETH\u2019S \u2018HIGH-T\u2019 TESTOSTERONE INITIATIVE: WHAT TO KNOW<\/a><\/strong><\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-5\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-5\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-26\" data-wex-ad=\"art-dsk-inart-5\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">The ban on transgender troops in the armed forces <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4589592\/appeals-court-strikes-down-war-department-ban-transgender-troops\/\">remains in effect<\/a> for transgender-identifying people not already in the military who are seeking to join, despite Reyes and an appeals court finding that the Pentagon policy is likely illegal.<\/p>\n<p class=\"wp-block-paragraph\">In June, a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cadc.41889\/gov.uscourts.cadc.41889.1208855359.0.pdf\">2-1 decision<\/a> by a three-judge panel of the U.S. Court of Appeals for the D.C.
