The Buckeye Institute supports the appeal, arguing that the law exceeds Congress\u2019s constitutional powers, particularly under the commerce clause, by criminalizing a noncommercial, local activity-home distilling-that has historically been a hobby. The Sixth Circuit accepted that theory and upheld the prohibition. Ream said he filed the lawsuit because he wishes to make spirits at home but does not want to face the penalties imposed by the 158-year-old federal law for doing so.
