The committee sought information about Navarro\u2019s public claims that he helped develop a plan to block Congress from certifying Trump\u2019s 2020 election loss.<\/p>\n<p class=\"wp-block-paragraph\">He served a <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/2913321\/ex-trump-aide-peter-navarro-ordered-prison\/\">four-month federal prison sentence<\/a> in 2024 but has continued challenging the conviction <a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3086717\/peter-navarro-released-prison-speak-rnc\/\">after his release in July<\/a> that year. Navarro argued that Trump told him during a brief phone call that he did not need to comply with the committee\u2019s demands because of executive privilege.<\/p>\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dem-amnesty-would-protect-domestic-abusers-republicans-say\/\" title=\"Dem Amnesty Would Protect Domestic Abusers, Republicans Say\">appeals court found<\/a> no documentation that Trump had formally invoked executive privilege or directed Navarro to defy the subpoena. The ruling said a Trump attorney and adviser who testified before a grand jury also said Trump had not made a formal decision to shield Navarro from the committee.<\/p>\n<div class=\"wex-inarticle-ad wex-inarticle-ad-art-dsk-inart-2\">\n<div class=\"wex-ad-wrap wex-ad-art-dsk-inart-2\" style=\"min-height:90px\"><span class=\"wex-ad-label\" hidden>Advertisement<\/span><\/p>\n<div id=\"div-gpt-ad-3182201-16\" data-wex-ad=\"art-dsk-inart-2\"><\/div>\n<\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">\u201cDr. Navarro immediately and categorically asserted executive privilege without consulting anyone,\u201d the court wrote. \u201cHe did so before even seeing the subpoena and its cover letter that made clear the subpoena sought some information that Dr. Navarro concedes is not privileged because he had discussed it publicly\u201d in his book and media interviews.<\/p>\n<p class=\"wp-block-paragraph\">The panel said those facts undermined Navarro\u2019s argument that he acted in good faith and did not \u201cwillfully\u201d default on the subpoena, as required under the federal contempt statute.<\/p>\n<p class=\"wp-block-paragraph\">Millett, Judge Cornelia Pillard, and Judge J. Michelle Childs also pointed to the agreement between Congress and the executive branch at the time of Navarro\u2019s prosecution. And the Executive both informed Dr. Navarro that his assertion of executive privilege was unjustified and exercised its exclusive authority to bring this prosecution.\u201d<\/p>\n<p class=\"wp-block-paragraph\"><strong><a target=\"_blank\" rel=\"noopener noreferrer\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/4643815\/peter-navarro-seeks-precedent-for-years-to-come-with-renewed-contempt-fight\/\">PETER NAVARRO SEEKS \u2018PRECEDENT FOR YEARS TO COME\u2019 WITH RENEWED CONTEMPT FIGHT<\/a><\/strong><\/p>\n<p class=\"wp-block-paragraph\">Navarro\u2019s appeal proceeded even after the Trump administration withdrew the government\u2019s appellate defense of his conviction.
